Just called and got straight through, decision was made on Monday and it was declined. He read the decision letter out to me and it doesn't mention anything about SMI, its all about his walking, so I don't understand. I've asked for a statement of reason and he is sending that out to me and the paperwork to complete an MR. I'm absolutely gutted, but atleast now I know and can move forward, just another 6 month wait!

I had the same fear too, the long wait was just for us to be told 'no'.

Can I ask what evidence did you send in for smi? Currently going down that route was this a renewal or coc?

Isn’t smi just for high rate mobility? You usually apply for hrm under smi or vuw criteria?

I hear everyone saying it's for hrm but i think the smi also shows points to award hrc. Whereas vuw is just mobility.

We have amazing (not!) Weather and one of mine has chicken pox ...

That may explain why it’s quiet on here and for decision then 🤔 I wonder if it will be the same next week we are in the south and they break up tomorrow. It’s so hard to do anything October half terms it’s always so horrible outside, mine will be bouncing off the walls all excited about Halloween all week 🤦‍♀️ I hope your little one is feeling better soon

I give up ringing now just get the same response over and over its in the queue been marked as priority for 3 weeks.
This process has been so stressful. Trying to put it out of my mind now and ring back once it hits 30weeks.

It’s ridiculous that some in May have had calls from DM’s and were still sitting here in April not even with a DM yet!

That makes sense, all the stuff I have sent in for smi isn’t just based on the mobility side of it it’s my child in general all day, night, school and when we are outside.

SMI has nothing to do with care side of things its only a route for mobility. For high rate care they have to have needs all throughout the day and for a prolonged period at night

It confused me abit then because what I’ve sent in shows my daughter is smi through the care and mobility side of it but I suppose it’s as a whole your child being smi and that’s the criteria for Hrm.

I thought you was going to say up north somewhere, so were both in the south and have different half terms 😵‍💫 I always thought half terms was the same weeks anywhere in the uk 🤦‍♀️

No lol and some schools (both primary and secondary) have two weeks off lol
As they dont have staff development days during year.

It's ridiculous making everyone wait this length of time, state it is in date order when it clearly isnt in date order, I wouldn't mind if it was at least being look over and that's why they are taking time. I fear that it will be rushed like his renewal not read properly , not contact the professionals involved and be declined .

Wow that’s the latest MR I’ve seen done! When was your original SD?

I’ve literally just got off the phone to them and told me case workers are on the third week to the end of March 😂 my SD is 22/04

original scan date way the 18th of January. Unfortunately the decline was due to an administrative error on DLA side, they lost all my evidence and lied to me about it for weeks. Anyway regardless I was okay to wait up until 4 days ago when my daughters nursery cut her hours down to one hour a week because they was struggling with funding for here 1-1 while they await EHCP. Nursery manager explained that when DLA is awarded they can get some more funding to help. So I called up spoke to a manager and within 30hour a decision was made

I’m in Scotland and half term was last week and they went back to school on Tuesday, I actually forgot that awards slow down in the term times so thats why its been slow the last week X

The whole system they have is frustrating and obviously not done in date order like they claim.

Awaiting Tribunal date. Mr dec 2024 to July 2025. Declined hrm.. Tribunal logged 12th July. Still No response from Dla.. 🙄

Do they change decisions if extra evidence is received within 30 days?

Im not sure with COC. It might be best you calling and asking them as they would be able to give you an answer. Sorry im not much help as im doing my first COC.

No 🤦‍♀️ I’m so sorry it hasn’t gone the right way for you! That’s so bad! Definitely do a MR and keeps gathering evidence, did you do a statement with the smi tests in the end? One thing I wish I had done is highlight the evidence in the reports I used to back up my smi test. Keep fighting you know what your child is entitled hopefully you will get the right award with your MR 😞

I didn't do it through SMI as I didn't know about it until after I'd sent it, but that is what I'm going to do my MR around. We have a family support worker who is dealing with our respite care as we've been awarded it on a 1-2-1 award and we get 112 hours a year through our county council, she's just done me a support letter stating he is severely mentally impaired and then evidenced it within home and in the community and then put about how he has been awarded these hours and why, I'll speak to the school when he goes back next week and then I'll call his paediatrician, although I have everything that he sends me and I've also sent the reports from him off, which evidence his diagnosis, does he need to state the autism and ADHD severely mentally impaired him? Even though he has put all his diagnosis' on our letter from our last appointment? I'm so angry that they've not even mentioned his behaviour in the decision letter, I wrote 7 pages of what happens at home and in the community, and they've not even mentioned it.

Thank you, I'm just so angry with them, another 6 month fight and they didn't even look at everything in the first place. Yours should be with someone soon, if you're a week behind me, I'd say it would be assigned to someone this week x
