No i never got a text or anything i just kept calling them to see if a decision was made haha so glad thats finally over, theyve back dated to 31st July 2024 so iv let uc know aswell, im not sure how long her award is til I get the letter good luck to everyone still waiting!

Also, can anybody give me advice on universal credit. I was supposed to be starting back at university this September. I know I can’t claim carers allowance if I’m in full time study, however I’ve seen something about carers element and premium? Does this allow me to study or not? And do these automatically get added on when I inform if about the dla? And also, what’s the benefit cap? Sorry for all the questions there’s just a lot to it.

You will be able to receive the disabled child element now and when you become a full-time student. You will receive the carer element up until you begin full-time education. Once you are in full-time education, you will not be eligible for the carer element. See this ADM - full-time education is abbreviated to FTE.

There hasn’t been a COC awarded in a while, but a while ago they seemed to be going to DM at 28 weeks. I think the next person for a COC decision is @Greenyb i think their scan date it 14/2 or something like that.

I’m at 26 weeks today was told last week it could be several months before a decision now because the back log is so big, I haven’t seen many COCs done at all the last couple of weeks 🤦🏽‍♀️

I’ve called to check evidence I sent in because I sent it freepost and then was worrying incase it wasn’t received, it was scan on within a week and she said I have plenty of time to send in extra evidence COC are taking 27 weeks, she said more evidence the better because it helps the dms to get a better picture of your child. Really nice lady.

They say different things all the time don’t they 🤦‍♀️ I would imagine the person that said it will be any day can see that your close to being with a DM but the person this week didn’t really look into it and just see it wasn’t with a DM yet. Hopefully next week will be your week for a decision.

Anyone ever had another child's name on your statement of reasons 🤦🏽‍♀️ it's clearly my child's statements but has been incorrectly named on it , I have wrote this on the MR for his HRM because it poses a serious question and concern

@Abwill You should not have to wait for a MR if there has been a clerical / admin error.. Call customer services ask to speak with a manager and explain the situation and ask them to refer it straight back to the decision maker who handled the case.
Don't take no for an answer and also don't say on the phone or to the DM that's it's clearly about your child but with the wrong name.. Say you question the decision that has been made based on the wrong child's name on your statement of reasons and you want it referred back immediately to the DM

@flawlessflipper @Curlycookie5 I've just been catching up reading through the last few pages of this thread and just wanted to give some input regarding HRM through the SMI route..
I'm sure you are both aware that you have to prove the points through your own statements / sentences on the form and through professional evidence.
The decision makers are not medically trained they do not have a clue about illness and disabilities of children and different diagnosis they use a DM guide and the internal health care professionals..
For smi the child doesn't need an IQ test as they don't do these on children..
Two point do need to be facts
The child has a diagnosis
The child is on HRC
The rest of the point need to be proven by describing sentences from yourself and the professional evidence

You need to demonstrate a significant and lasting cognitive and social disability that severely restricts the child's ability to move around..
This involves demonstrating that the child has a substantial learning difficulty ( not disability)
The child exhibits extreme and disruptive behaviours, requiring constant supervision and needs physical interventions to prevent harm or damage.
The professional statements / reports need to be detailed showing
The child's cognitive abilities, social interactions and behavioural patterns as well as descriptions of the need for physical restraint and supervision.
So for example reports that state the child's learning age is age 2 even if the child is 7 isn't enough.

Any reports that state the child needs positive handling ( that's what professionals usually write they don't like saying restraint especially in school or nursery reports) any reports that state the child needs 1 to 1 or supervision, any reports that state the child has a risk assessment in place because of extreme behaviour and because the child does hit and use physical violence towards peers or staff or yourself..
The smi leans more towards behaviour restraint supervision and violence
The VUW leans more towards refusals that are hard to overcome because of a physical disability ie Autism..
Unfortunately lots of children are declined because the DMs are not medically trained and they need describers spelling out to them so they can follow their guide and flow charts..

That's why most HRM declines are overturned at tribunal because the evidence is there it's just not worded how the DM needs it wording 🤕

Keep fighting guys I know the forms are terrible and the wait is terrible and declines and MR are terrible but if you don't fight to get your child what they are entitled to nobody will but take care of your own mental health and wellbeing whilst doing so the process is draining and long ✨

@PositivityRipples an IQ test isn’t required. I specially said it is still possible to secure HRM under SMI without one. But you are incorrect to say IQ isn’t tested in children. It can be and sometimes is. I do this (and EHCP support) day in, day out and as such see hundreds of EP reports. My own DC have also all had EP assessments including IQ testing as children.

You don’t need to evidence a child has a learning difficultly. It is possible to prove all the elements of the criteria, including “severe impairment of intelligence and social functioning“, without. For example, by showing DC have difficulty applying their intelligence in the real world or have no sense of danger.

I’m not sure why you have tagged me in the rest of your post. I haven’t suggested anything to the contrary.
