He's 8, he has ASD alongside a learning disability, we have evidence of restraint from both his school and us.

Under SMI from what I understand it's: “to intervene and physically restrain the child to prevent them causing physical injury to themselves or another, or damage to property.”

He daily sensory seeks by biting himself or others causing us to have to restrain him, same at school, there was no mention of SMI in the reasoning whatsoever it was only about his physical ability

is it possible they’ve based his award against VUW rules instead of SMI?

It's possible, stupid if they did considering there was a whole document in there purely about SMI...

He also has refusal episodes which I included which is also part of VUW.

I just feel like they didn't go through it all, I'll happily post what I sent to them in terms of my own statements regarding it all

NC- sent in February SC- 25th
I received a letter this morning dated 16th April and that I’d receive an outcome with come in 15 weeks.
also they asked for a birth certificate, was u meant to send that off with the application? Or is it something they just ask some people?

I was asked for a birth cert for my son the last time I did a new claim.
With my other son and dd I wasn't asked for one.

I just phoned and a decision was made on my child’s claim but she wouldn’t tell me over the phone. Is there another option I can press when I phone back?

When I called earlier the person transferred me to someone who could tell me, that's very frustrating!

When you listen to all the options when you get to the last one regarding new claim or MR press 4

what was your for COC or MR

I changed my son's surname by deed poll when he was a baby to my surname. Letter confirming claim came yesterday and had his birth surname. Should I send his birth certificate, deed poll and his speech and therapy report that came recently. I'm guessing my national insurance or doctors may have the old surname and they're gonna wonder why I've used mine.

So after letting it settle over the last few hours we are still certain that they did not read the additional statements that we have sent, but unfortunately as im sure everyone is aware, once a DM makes a decision the only option is an MR so here we go.

The woman we spoke to that gave us the results was absolutely amazing and helped us do an MR over the phone after reading us the Statement of Reasons. Once she had read them i asked some questions about the statements and of course asked them to be sent to us.

She essentially agreed based on the statement it does not look like SMI was factored into the decision at all.

She also said she was unable to tell us what evidence was used in the decision which i feel shouldn't be correct?

So, the 25 week wait for MR begins. In the mean time i have contacted our sons Pediatrician along with the SENCO from his school to ask them for additional statements that we can use to form more evidence for him.

Looks like ill be here a while longer!

Thank you, im sure they didnt look at it correctly, because if they did they would have atleast mentioned that it was considered but was rejected because...

But all they said was "He doesnt require any aids to walk" not one SMI rule was mentioned, and when i've sent a 4 page document asking for it to be considered, if it was looked at they would have mentioned it!

I know they’re overstretched and swamped with a back log of claims, but they are obliged to read every bit of evidence sent in, and they obviously haven’t, so ultimately they’re not doing their job properly 😤 Why does it feel like we always have to fight for everything our children should be receiving as a matter of course? Good luck with that MR 👊

What was your scan date for coc? From memory we were around same scan date my sons is 3/11

Yeah mine is 20/11 and there’s some with October dates still waiting! They seem to taking over the 25 weeks now

I’m seeing a lot of people getting awards from this January scan date Jan and another from February scan date feb get awards in march and April and them people didn’t send in a bit of evidence I sent mine off 31/1 scan date 6/2 and heard only that they apologise for the wait and I’ve sent off evidence and everything

my friends called up for forms on 10feb scan date 11th march and she got a decision last week and she sent no evidence what so ever so I have no idea what the system is

Ahh okay I was thinking it was declined already but maybe bit of a wait - I have gone down SMI route for my daughter she received high rate rate was 4 in January. We have EHCP and a lot of evidence as she has pvl brain damage. But yet they have declined it after the coc form back last year
