DLA WAIT TIME THREAD 62

1000 replies

zoeybrooks45 · 11/01/2025 22:06

Please feel free to add your scan date and whether it's a new claim/mandatory reconsideration/change of circumstances or renewal.
New claims (NC) - people are being told the wait time has increased to 25 weeks! I would say most are done before this though around the 20 week mark?
Mandatory reconsideration (MC) and Change of circumstances (COC) is around 20-25 weeks.
Renewals tend to be between 15-20 weeks.
If you disagree with the outcome of an MR you can appeal and go to court (tribunal)
Scan date is the date DLA scan your application forms on to their system, if you downloaded your application forms then this will be from when your award will be backdated from. If you called up for forms then the date on those is the date yours will be backdated from.
If successful and claiming universal credit (UC) please update them as this will entitle you to disabled child element adding extra to your award.
DLA contact number is 121 4600 0800 121 4600

@Mumofnine Yes they do lift the benefit cap once you've claimed the carer element of uc or carers allowance the benefit cap will be lifted from the date the carers applies to but you need to put a message on your journal under " payment" and write, hello I'm now claiming DLA for child and the rate and I'm also claiming carers from ( date) please can you ask the decision maker to lift my benefit cap from that date and recalculate my previous statements based on a " supersession special circumstances" thank you.
The cap will then be lifted and under a supersession ( a supersession basically means when another benefit has been applied under your national insurance number and that other benefit give you an automatic entitlement to a recalculation of money you are owed due to a benefit cap lift or a previous backdated entitlement to carers, dla or pip. Hope that helps

Thank you so much for your response that's helped loads thank you. So will they backdate the benefit cap to my son's start date of DLA which was in August or don't they do this ? They lifted the cap for this month but I'm unsure if they backdate the capped money to the start of my sons DLA claim. I have asked them to backdate my child disabled element and carers element and it's gone to a decision maker now but I'm not applying for carers allowance. Thanks for your help x

PositivityRipples · 18/01/2025 19:21

@Mumofnine Yes they will lift the benefit cap to the start of your child dla award from August as that will also be the same date they will apply the carer element of uc from, so you will be exempt from the benefit cap from the start of the dla award, if its already gone to a DM of uc for backdated disabled child element and carer element he may also automatically lift your cap so you will get a letter in your journal with backdated all 3 but if they only back date the disabled child and carer elements after You've got that letter write a message in your journal that I've wrote above 😊

PositivityRipples · 18/01/2025 19:25

@Starboymummy it will say on your previous UC statements if you are under the benefit cap on money deducted off UC it will say benefit cap then it will say an amount in minus ££s..

For anyone else who doesn't know or didn't know if you are under the benefit cap and you claim carers allowance or the carer element of uc ( from the date you claim carers you're exempt from the benefit cap) so if carers is backdated you can ask the DM at UC to lift your benefit cap from the carers award date and they have to give you back ALL the capped money... They don't always do this automatically so you have to request it on the journal if you write ( under a supersession special circumstances) you would like it lifted from the carer award date they can't refuse ( a supersession is a DWP legal termology) so use this word 😁
Good luck everyone still waiting for DLA the wait is horrible, long and fucking annoying 😩 and I hope they get the wait times down ASAP.. Hold in there you're all doing amazing looking after your children they deserve to be able to have all they need to make things a little easier for them and you that includes the money... Let's face it the battles with schools, neurodevelopmental services, camhs and every other agency with a wait time of 100 business years is already hard enough without the dla wait aswell... Where's my damn money 🤪 I joke I joke

So much help info! This is amazing.

😍

PositivityRipples · 19/01/2025 00:09

@HM1111 you don't have to be claiming carers allowance, when you claim the disabled child element of UC you will also get the carers element so you will be exempt from the benefit cap...

CGBJ · 19/01/2025 08:04

This is honestly all I can think about at the moment.

Just wondering...has anyone been awarded HRM from a COC, for ASD, for either SMI or VUW? Or has it always been from an MR?

I'm just trying to mentally prepare for another battle but I don't know if I have it in me. X

Hi someone posted about being asked if they wanted backpay in one lump or instalments an it got me thinking does a backpay of dla affect UC, like earnings do?

Ahh I was embarrassed because my question was answered if I just looked at the next post lol

I knew about the disabled child element but I thought careers element was the same as careers allowance! I need to look into all this and find out exactly what I need to be putting in my UC journal

Thank you!!

You are any day now!!! The person said that the DM rang her yesterday and awarded over the phone

PositivityRipples · 19/01/2025 13:18

@HM1111 No carers allowance is a seperate benefit that UC take off you each month pound for pound so most people don't apply for it.
Universal credit have an option where you can go to report a change and you can report caring for someone who claims a qualifying benefit so a family member friend or child that gets DLA or PIP or the severe disability premium of pension credit.
So you report the change that you are caring for your child, you put the date of the DLA claim and they backdate it to the date the child started to receive DLA ( this also cancels all work commitments if you have any) and UC pay you the carer element of UC.
Hope that helps and makes sense.

Kc1999x · 19/01/2025 13:30

I claim carers allowance and it’s helped me out having that money every week even though it is taken off of my uc. So if anyone is thinking about claiming the carers allowance in my opinion it’s worth it! Obviously it’s not everyone’s cup of tea but a positive view on it🫶🏽

PositivityRipples · 19/01/2025 13:44

@Kc1999x yes I agree it is worth claiming in my opinion if you don't work as its paid weekly and then uc take it off you monthly but also pay the carer element ect.
Some people don't qualify though because of how many hours they work and the amount of wages they get. But if you don't work most defo it's worth claiming in my opinion.
