DLA WAIT TIME THREAD 62

1000 replies

zoeybrooks45 · 11/01/2025 22:06

Please feel free to add your scan date and whether it's a new claim/mandatory reconsideration/change of circumstances or renewal.
New claims (NC) - people are being told the wait time has increased to 25 weeks! I would say most are done before this though around the 20 week mark?
Mandatory reconsideration (MC) and Change of circumstances (COC) is around 20-25 weeks.
Renewals tend to be between 15-20 weeks.
If you disagree with the outcome of an MR you can appeal and go to court (tribunal)
Scan date is the date DLA scan your application forms on to their system, if you downloaded your application forms then this will be from when your award will be backdated from. If you called up for forms then the date on those is the date yours will be backdated from.
If successful and claiming universal credit (UC) please update them as this will entitle you to disabled child element adding extra to your award.
DLA contact number is 121 4600 0800 121 4600

SD 22/8.
please can I have some advice, I don’t know what to do. Last Thursday I phoned up and said I wanted to submit more evidence as care for DS has changed since I sent form for new claim off in Aug. They said that was fine and there was plenty of time to send in as 25weeks etc and I was only at 20.
i sent off letter for next day delivery on 9th. It arrived 10th and same day a decision was made for LCR. I was hoping for MRC based on his needs. I phoned today and asked if the decision was made after getting my letter or before. Waiting for them to call me back.
my question is, if I go down the MR route, do they stop the payment for LCR until they’ve made an MR decision?

That's annoying!

The man I spoke to yesterday said even after decision you get a grace period of 4 weeks to send any additional info to them for them to reconsider the award. He told me this is NOT an MR. He said it's always better to make use of those four weeks if you have any additional evidence.

Update decision made 14/1/25 after 26 weeks for MR decline again so tribunal it is good luck everyone

What was it you didn't agree with? If you don't mind me asking x

Mine was off the back of a renewal and I filled the form out with much more information and changes sent over additional evidence and im convinced (and also because agent told me) if it went to 26 weeks(as it did) they would just extend the previous award.

When i asked them for list of reasons the were the same a previous even though I had given them so much more info. So I was arguing the mobility side. And I made that clear .

They won't stop the payment no! You will still get that whilst awaiting the MR

I'm so sorry! It's mad the decisions are so wishy washy if I'm honest, it's like they don't all sing from the same hymn sheet.
Good luck with your next steps x

Unfortunately, they are definitely rushing making decisions when the time is up. Same thing happened to me! I sent so much evidence they didn’t look at and gave me a generic response. Take them to tribunal and hopefully they overturn before the 4 weeks up. Somebody on the previous thread got the decision from a decline to HRC and LRM. I am sorry you’re having to go through this. Sending lots of love xx

Rather weird that after speaking to school you get that, if you find out it's school that's fxcked it for you please make sure you let that school know that it isn't you they've let down but your poor child!
What award was you hoping for? X

Are new claims actually taking 25 weeks?

Chaz693 · 14/01/2025 20:56

COC 30/7

5 year old son, ASD, non-verbal and GDD. Just started SLD school last week. Still waiting but haven't called yet think I'll give it a go. He's currently only on MRC. Feel he's entitled to HRC but at the time of applying the first time I had a lot of other things I was dealing such as EHCP and fighting for a school place for him. Also applied for his mobility element. Not feeling hopeful that will get the HRC as didn't have much more evidence other than the fact he had been prescribed melatonin due to on going sleep issues. It's so hard to get evidence for it as obviously no one is there to do see the issues we're having. I also keep being told he should be entitled to HRM but again other than reports from paediatrician there's not massive evidence of the issues we're having when out and about. He just shuts down when out and at 5 it's becoming increasingly hard to carry him. Feel like we've already waited so long so if it's a no will have an even longer fight and wait for it.

Does anyone know the latest DLA would call you and whether they call on a private number? Missed a private call and stressing lol

tyravoss · 14/01/2025 22:51

Hey everyone my SD is 09/09 I'm so nervous lol all that goes through my mind all day everyday is this bloody claim 😩I'm usually silent but just want to
Know what you guys think gets you HRC, my son is undiagnosed but he mostly likely has autism and adhd, he's amazing but more than a hand full we can't take our eyes off of him for a second his not verbal and barley eats anything, He has no awareness of danger and runs in the road etc when we are out, I'm hoping that I filled out the forms in enough detail to really get the point across but I'm rubbish at putting things on paper! X

For HRC you need to evidence substantial day and night needs. So night time needs is when the child is awake for majority of the night or requires attention 3+ times a night or something like that. My son need supervision at all times as he’s a danger to himself and others and he is awake from around 1/2am in the morning and that’s him for the day🤦🏽‍♀️ my son is also non verbal, still in nappies and has a very limited diet. He gets hrc&hrm x
