Has anyone heard of dla overturning their decision within the timescale of the tribunal giving them to respond?
I'm probably wishful thinking. I submitted my online form for tribunal and on there said dwp have til 17th Dec to respond xx

How?! I got a stroppy DM today and I’m 17 weeks Tuesday. This is why there’s delays as they can’t even manage to do the correct dates. They haven’t even allocated people waiting much longer than that

I’d love to know how. Some are just lucky I guess

if you want to complain about DLA you have to call up they don’t have the online like UC😂 I’ve checked lol and the people on the phone can be idiots so you could call and make the complaint and they probably wouldn’t log it

😂 they defo won't log it lol there would be so many complaints they'd actually have to do something about it so easy way as on phone we can't prove we complained unless record the call and tell them you are recording it 😏

Thank you for such a lovely message! I'm just so angry at schools nurseries health visitors etc! She is non verbal still nappies her night needs are ridiculous not In school only for 1.5 hours a day and her aggression is extreme with a blood disorder on top of all of that! School did me a 4 sentence supporting letter absolutely ridiculous! Xx

Omg that's ridiculous re schools letter this is exactly what I mean they don't support parents but I don't understand why it's not being dishonest you just want detailed letter explaining her needs and support in school it's like the school think they are paying dla themselves..nobs
Your daughter is entitled to DLA guessing high rate at least tbh the fact she has reduced timetable and how she compares as they say to neurotypical child same age proves her additional needs just keep fighting and pushing I know it's exhausting but honestly fight for what she's entitled
Iv seen some parents ask for statement of reasons and take line by line to prove otherwise great example
My daughters statement of reason was 1 line .. needs at least 1 hour of supervision with bodily fluids.... completely ignored proof from 2020 on night time needs from gp but MR iv included prescription of melatonin and sleep clinic report
I can't get her to take the melatonin and sleep clinic haven't responded when iv informed him as they are tiny Slenyto or something brand but needs to be swallowed whole and she refuses can't crush them or chew them .. and the fight goes on school home dla Paediatricians 😰
But keep fighting hun don't let them get away with it x

Are you doing a MR atm? I've emailed her sen nurse who has said she will fight fight fight with me so that's nice I have somebody backing me she's told me to just take a breather now until the letter has arrived and then we will go for it. It mentally and physically drains you doesn't it!!! Also in the middle of gathering evidence for a ehcp! Xx

MistandFog2024 · 29/11/2024 14:54

@Scc1991 thanks for your reply. So it’s possible to not receive an acknowledgment letter at all then it seems. Surely can’t be too much longer til you hear if you’re almost at 20 weeks x

It seems like it is possible yes 😂 I phoned up after about 4 weeks just to make sure they received it and the told me they had. Maybe worth you doing that just to make sure they have it? Let's hope it's not much longer the wait seems like it's forever

Aww I am still gunna hold out slight hope then. If not I'm in for a long and anxious wait xx

I had an email from the tribunal service saying approx 35 weeks wait. I really hope not. I think with how delayed decisions are taking in the first place, we've waited more than long enough xx

Kc1999x · 29/11/2024 15:08

I don’t see why they decline then change it when presented with claimant going to tribunal just shows they aren’t awarding fairly or they’d stick to their decision

Chloe132 · 29/11/2024 15:45

I've just got of the phone from them again where it's 20 weeks they said its still not been allocated to a dm yet so they have now emailed a case manager so hopefully that will get it done

Chels2020 · 29/11/2024 16:04

So what’s the difference between case manager and decision maker

Absolutely 🤔
Good to know what to be prepared for as someone posted if they didn't tell us wrong information around 11 weeks to 15 weeks and said from beginning it's 25 weeks or so they wouldn't have so many calls x

Yeah I'm MR scan date 22.8.24
Original scan date 11.4.24
Currently 14 weeks plus 1 into MR
Itsgood you have someone to be able to help fight seems like most of the support runs away as soon as you ask for proof or statement so sad
Honestly never known fighting at every corner but this year I decided to try and be proactive been procrastinating for too many years as too much always going on but the lack of sleep part due to ASD 10 year old dd part DLA fight always thinking what can be used as further evidence
I can prove night time needs professionally from 2020 via gp and this year's sleep clinic Paediatrician wrote his report and support letter for housing too so hopefully they actually read it as I honestly don't believe they read anything about my dd 😒xx

New claim 22/07.

Received a text to say my child qualifies so rang up. Got through straight away and asked to be put through to someone to see what decision would be. My little one has qualified for high care for 2 years and I am over the moon for him. Finally after so long he is finally going to get all the extra support he needs. A long wait and I know some of you have been waiting longer. My heart goes out to you. Just so grateful. Thank you to this group for keeping me sane and good luck to everyone fighting for their child.

IMD39 · 29/11/2024 16:27

I’ve just called. My forms signed for 19th July. Been awarded until 2027! So happy. The first person I spoke to said a decision was made but they wouldn’t tell me what. So I rang back and they told me. So happy, hope everyone hears soon.

Good luck hopefully not to much longer for you! And I hope you recieve what your daughter is entitled to! It's disgusting how somebody who knows nothing about the child makes a decision! These children deserve so so much more than what they are having to deal with! I'd give anything to turn back time and not listen to oh she's fine just delayed and put my foot down from the first day of raising my concerns! But we learn on the journey don't we xx

So what’s the difference between case manager and decision maker

They’re the same person it’s just interchangeable they still make decisions. People either call them decision maker or case manager they’re responsible for managing the claims and make the decisions. Just an interchangeable terminology they use
