When I did ring about the mr they said 3-5 weeks, but I can't see it being that quick

SweetSugarPlum · 13/11/2024 11:54

OSD- 06/06
Declined- 11/11
Going to MR, is anyone able to help me with what I need to write in the letter asking for a MR please?

Abwill · 13/11/2024 15:08

@Mumrobyn4 oh gosh now I'm thinking should I cancel ours too , I've sent no extra evidence just more information literally two days before they made the decision which wouldn't have got there in time therefore wouldn't have been part of the decision making , I may just call tomorrow and ask there advice of what would be best

Mumrobyn4 · 14/11/2024 09:39

Its hard isn't it because we know are kids are entitled to it but it just depends on which decision maker you get, and with the MR they look at the whole claim again. Iv seen someone get awarded hrc and lrm and asked for a mr and won she was awarded hrc and hrm but her award time was reduced from 2032 untill 2025!

Mumrobyn4 · 14/11/2024 09:40

Ask for a written statement of reasons why the child was declined, then you can look at it and argue each point.

Abwill · 14/11/2024 13:24

I'll call in the morning the thing is I forgot about asking for them and I've just written it all out in the letter why I feel he fits the criteria, two days before he was awarded I sent extra information off to support his mobility because I felt I just didn't give enough on the form and information provided however that obviously didn't get there in time for decision so the award went of the limited information regarding mobility so I've put in the letter a paragraph explaining this so hopefully they can see primarily although I know the hole claim is looking at again it's the mobility that was lacking the supportive information however that is now there and can that be looked at . I'm a bit annoyed though because I did call the day after posting to say could a note be placed on our information to say no award be made till this information reaches the dm , however he said oh just make a MR if needs be like its a easy process lol xx

Waitingmummy · 14/11/2024 19:43

I need help please my child's DLA award has been reduced from Higher rate care to Lower rate care and low mobility rate. I have sent so much evidence including CAMHS, SCHOOL REPORT, HOUSING ETC. I raised a concern with the DM who should contact me (I'm trying to avoid going through an MR as long waiting times) how can I prove the supersession isn't legal?

cooperbug · 27/11/2024 20:59

My daughter’s DLA renewal has been declined, her needs are the same if not worse than they were almost 2 years ago when we originally applied and were granted. I am going to appeal it but what is the process for this? So disappointing

Abwill · 28/11/2024 11:06

So when you do a renewal they don't look at your past claim information so you need to put absolutely everything down again plus what ever else has worsened , ring up ask for a mandatory reconsideration and a reason of why denied and then send that back to them as to why you disagree giving all your supporting evidence x

4outof4 · 30/11/2024 12:24

I received a text to say they've decided my child qualifies for DLA last Saturday, received a back payment on Tuesday but am yet to receive a letter detailing the award. From the payment I believe they've changed from middle to high care which is what I was disputing.
MR was received by them on the 28th June. So that has been 5 months wait.

It's basically a new form. My mind is blown with my path at the moment though my friend sent a renewal from in which was processed in less time than my form took to be scanned into the system.

Charzoe13 · 30/11/2024 15:48

I got a letter yesterday regarding my sons appeal to say the evidence I have submitted has been rejected and the appeal will go forward. They have this agenda that he doesn't hold a danger to himself regardless of the steps I take to safeguard him prior to that being an issue. Does anyone have a ball mark on how long I will have before I have to go to court and b**ch slap them

Matilde08 · 03/12/2024 22:47

Hi ✨️ 👋🏻

Have not been on this forum for few months after 7 months for them to make a decision for my son with scan date 22.11.2023 and decision date 17.06.2024 .
That affected my mental health massively. Anyways becouse of them not making decision based and accordingly on his special needs but other circumstances..I put down MR... sent out everything at the beginning of July and got letter from them they scanned it 19.07.2024
Have had one letter during this waiting time with saying still looking at it and I don't need to do call or anything and it can take up to 15 weeks. Week 20 now and just wondering when I can expect anything..something 😔

Hey, I spoke with someone yesterday as my scan date is 18/07 so 20 weeks on Thursday. She said that MRs are usually getting picked up by a decision maker once we are at 20 weeks, but it still could be up to 25 weeks wait. It depends on the decision makers work load. Hope you are feeling a little better, this whole process is really draining! X

Thank you 💐 Honestly it toke half of my year away with so much anxieties as it turned into 33 weeks wait till they made their decision and they treated me not well. After I put down MR ..I decided to just patiently wait..again... and focus on other stuff as it affected my mental health massively. But obviously it's back of my mind and now that it's more than a year since original scan date..I start to wonder when there's light at the end of tunnel. I'm so pessimistic I'm ready for tribunal already 😩

Good luck to everyone to get some answers before step into 2025

I seen someone had theirs looked at a lot quicker due to their mental health. I’ve been struggling with the anxiety side of it but I’m on another forum with some lovely people, they have helped me through it especially on my down down days! You’re nearly at the finish line, I’ve seen the average they are getting done is at 21weeks so maybe another week or so. I have everything ready for tribunal too if that helps. Remember you’re not alone there is a few of us in this situation! And you have got this!!! X

Sarahdestiny · 12/12/2024 18:25

Currently on month 8 since I logged my tribunal appeal..still no hearing date is beyond a joke anyone else the same or is it just my area that's taking so long #derby Mr decision made over a year ago so is such a long draining process and currently awaiting ehcp decision also 😅 so stressful hate waiting

Bearintheredhat · 13/12/2024 12:24

Yes @Sarahdestiny , we’re on the six month mark now, we’re West Midlands.
our tribunal has been sitting waiting since June. I phoned and all the paperwork is in order, we’re just waiting for a date.

fingers crossed we’ll hear by easter

Sarahdestiny · 13/12/2024 12:55

@Bearintheredhat thank you did you just ring the number on the letter ? X

Bearintheredhat · 13/12/2024 14:24

@Sarahdestiny
I had uploaded a personal statement in support of my case in August and logged into the tribunal website to check that it was there…it wasn’t. I had used the wrong file format I think? Anyway, phoned the tribunal people to ask about it and while I was there queried the length of time we had been waiting.

She said it’s a minimum of 5 months wait at the moment with no upper limit.

Im sorry, I can’t remember where I got the number from.

You can ask for just the mobility side of the award to be looked at but they will look at the whole award again. Award can be higher or lower or taken away altogether x

Sara2209 · 02/02/2025 20:15

Thank you for your prompt response.
I will call and first make it sure .

Abwill · 02/02/2025 20:36

We had the same situation and I just received the answer back as they are keeping the same decision (hrc lrm) as he doesn't have a formal ASD diagnosis to qualify for virtually unable due to physical brain development which he has got a diagnosis for 😩🤦🏽‍♀️ so I've contacted to say could this be looked at again before we take to tribunal, it's so annoying
