Waiting times for DLA for new claim 2021

Hi the DLA received my claim on the 1st April 21. Does anyone know the current waiting times. Thanks

@10brokengreenbottles I have asked my health visitor about getting my daughter a EHCP but she said that children have to be in a nursery or school to get one and as nursery won’t take my daughter I can’t get one, but Paed has referred her to an early years SEND team for help with nursery

Recived a letter saying they are looking into claim and outlining what will be done if not enough evidence. Didn't mention school but i thought they automatically send them a form of questions to fill out? Do anyone know is they send the questions straight away? There is a new sendco taking over after 2 weeks and i am hoping current sendco gets questions before she leaves since she has been so supportive and wrote a letter in support of dla

@10brokengreenbottles I'm from Scotland I was gave part of the education plan what is a CPS when it comes to nurseries and schools here most asn school are full and children are been put in normal schools and nursery regardless of there need my nursery have just brought in asn support for ariah x

If senco has written a letter they may not need anything filling in fingers crossed

Peppa that isn't correct, DC do not need to be in nursery or school. You can apply for an EHCP yourself, IPSEA have a model letter you can use. There's also specialist nurseries that have assessment places.

Gem DWP don't automatically approach the school or any other professional. In fact, more often than not they don't ask for any additional information, especially at the moment.

Mumof5babies I hope DWP stick to what the said, but normally they don't said originals back, which is why the form tells you not to send them. In future if you need to photocopy anything libraries often have photocopying facilities.

Em a CSP is a co-ordinated support plan, a legal document setting out DC's needs and what provision they require. You can appeal if a placing request for a special school is refused. Enquire can help. I don't know enough about Scottish education law, but in England there's no legal definition of 'full' and being 'full' is not enough of a reason on its own to refuse admission to those with EHCPs (England's equivalent of CSP).

@10brokengreenbottles i know hun but nearest library is a good 3 mile walk not good with little ones in tow triples the time. Loads better when they're in school can get around faster. I'll definitely be chasing it up hopefully they'll stick to what they said 🤞

@10brokengreenbottles I have a getting it right document the nursery gave me to give them I'm not sure if that counts but I asks for and education plan and gave them the form of what they were asking for and that's what I was given they also filled in the part of 3rd party so hopefully that enough in scotland no school can reject asn pupils whether normal or asn but because all schools have asn programmes asn children are been put in normal schools it's affecting them a lot there at times been isolated from other pupils and the council are saying they have waiting list for asn school as there to full.There are children I know who are in nappies don't speak at all and are been feed with tubes in normal schools it's a shame for them but there saying any school can bring in extra support for them but it doesn't seem to be working because there are people taking there child out because the pressure it's putting on the child and the teacher doesn't know what to do it's quite bad in all honestly even when the teacher supports asn school the council are rejecting them x

Ems don't always believe what the council tell you. They will tell you what they want you to know and their version on the law. Check with someone like Enquire. It is the same in England, LAs make you their own illegal policies. LAs often say DC should attend mainstream provision but it is possible to challenge the decision, and parents mostly win appeals.

Mainstream schools may have to admit DC with ASN but sometimes SS is the right place for the pupil. Parents are often fobbed off with LA support documents rather than a CSP (or EHCP in England).

In scotland we go to news papers or MSPS as the councils don't listen just hop it changes soon make me worry just now and she's not at school yet ...ohh I hope they gave me the right form I will just have to wait and see now

So my neighbour has just been round postman has put my mail through their door 🤦‍♀️. I have a sorry we've not made a decision letter dated the 25th august when i spoke to them on the 18th they said they'd sent a letter already lol. Apparently they will deal with it as quickly as possible I'm not hopeful but we'll see

They can help more than you think @Edsgirl there technically head of your constitute so they do have a big part in your councils I've seen msps help people get houses and help get additional support but they may tell you to write to council first given the fact your child hasn't been in school a year something should be done your child is entiltled to education and they have to meet there needs but again mainstream school are having to accommodate just now because there not building more asn schools but more children are been diagnosed with asn now and it doesn't make sense to me them not building more it's a shame for them x @Mumof5babies it's good they have sent a letter I will keep my fingers crossed for you hopefully we'll all hear soon my eight weeks is up on the 8th but I think it will be 10 before I get anything x

Btw MSP is what we call mp in scotland because its a devolved government sorry x

Edsgirl Does DS have an EHCP? And does he attend SS instead of MS?

If DS has an EHCP but isn't in SS have you had an early review? If not, you should ask the LA for one. You can also ask for a reassessment of needs if you believe one is needed. The LA still have a statutory duty to ensure all the provision in the EHCP is delivered. If they refuse you can begin Judicial Review proceedings.

If DS doesn't have an EHCP you should apply. IPSEA have a model letter you can use.

Separately to EHCPs the LA have a statutory duty to provide education to those unable to attend school due to their health, including MH, or SEN. This may be home tutoring, online, hospital school, small group tuition depending on individual needs. If the LA refuse you can begin Judicial Review proceedings.

Fingers crossed for you hun mines 8 weeks today they recieved it and 8 weeks tomorrow since they scanned it in hopefully it will be given someone tomorrow with it been 8 week mark was still waiting to be allocated last time i checked. Fingers crossed you hear something soon too

@Ems1991, we'll see how good she is just newly elected for the North Lanarkshire region, she was gonny contact Head of education right away. Felt I couldn't do anything without a diagnosis, school wouldn't provide online learning for him phoned them yesterday spoke to his s2 head got the ball rolling. X

@10brokengreenbottles, Evan doesn't want to return to Ms, I have mentioned this to his school and our msp but was told this isn't always the best route to take, my boy just wants an education. X gonna be difficult him no been for a Yr. X

The head of education should do something he has the power to raise it so don't take no for answer it's not right them not giving work to him I'm shocked the school is helping you in anyway 🤨

The head of education is who you need to speak with it's neglect on there part and make sure you use tell them thatt if they say you they can't help tell them you want it raised in first minster questions it sounds extreme bit I have seen people get help this way and it should work x

Has anyone had any problem with universal credits and getting them to back date it to the day the claim was awarded as all I'm getting from them is I reported it late which they know isn't my fault because it only just got awarded but it has to go to a decision maker now to say where they will pay it from that date. I don't understand how they can penalise us for not telling them sooner when we can only tell them once the decision is made
