New man confessed to past poor sexual behaviour. How bothered would you be?

Been seeing a man for a few weeks. We get on famously. He seems kind, has his life sorted. I want to see more of him.

Last night he seemed nervous and told me he wanted to be honest and confess something. The something was that fifteen years ago he had sex with an ex-FWB when she was paralytic drunk and he was sober. Apparently he gave her a lift home after a work night out, some months after they'd last had sex. When they got back, he said she asked him to have sex with her, and despite her being too drunk to give informed consent he did anyway.
He said he'd regretted it ever since, even though she has never mentioned it again and the two of them are still friendly acquaintances.
What would you think of you heard this story? On the one hand I am pleased he told me, it was a long time ago and he obviously feels bad about it (worse than she does by the sound of it). On the other hand he did do it...

So who decides whether you (whilst drunk) can give consent, but this girl (who’s paralytic) can’t? Do we need a breathalyser to establish where drunk stops and paralytic begins? Or could they be one and the same depending on your perspective?

The person who was there said she couldn't consent. Stop trying to justify men ignoring women's lack of consent.

I haven't the faintest idea why you're referring to a grown woman as a 'girl'.

You have only known this man a few weeks. You are not invested yet. It's really odd for him to tell you this in the early stages of a relationship. Really odd. Cut your losses and dump him. Personally this kind of disclosure would really turn me off a man.

Just to point out that the woman concerned still being in contact with him doesn't mean that it was consensual.

As pps have said, she may have blacked out and not remember.

Also, she may not have recognised it as rape or may have written it off mentally as a mistake or bad sex or thought it was her fault, not his, because people's understanding of consent varies or their experiences lead them to tolerate ill-treatment and exploitation. Heck we get women on here often minimising things like their husbands raping them in their sleep, not recognising it or not wanting to acknowledge that reality.

There are few perfect victims who behave as you assume they will.

What did you say to him when he told you OP?

I can’t say that I can’t imagine sitting and listening as that’s exactly what I would do in frozen bafflement at what I was hearing.

Where were you when this conversation came up? Maybe not a pub date I think but I think I’d have felt a bit scared in my or his house.

When did he realise it was rape? And does he tell or new girlfriends quickly? What have they done with this info?

Yes - I have too many questions - this knocks all my shite OLD dates out of the water! But I shouldn’t joke - there can be no ok reason he told you - none.

Are you still texting and speaking? Really, just don’t - block and delete - there are so many averagely crap blokes out there that actually don’t have rape baggage.

Re: changing concepts of what counts as rape - back in the 90s & early 2000s I don’t think I ever had sex without being extremely drunk, and the same was true for most of my peers, male or female (ETA that I’m female). We were socially awkward teenagers who got helplessly drunk in order to socialise.

Now, this was not a good situation, in general - but it’s not something most of us would think to confess to many years on unless someone we’d had sex with did feel violated, and there had been consequences.

I also think a weird aspect of this was his having been sober. It’s not unusual for 2 drunk people to have a regrettable shag, but if one is falling-down drunk and the other is not drunk at all, this does seem unusual and predatory.

I don't believe that the crux of it is what you suggest. I think that the crux of it is whether that particular incident and this particular man are concerning. One interpretation could be that he took cunning advantage of a paralytic, vulnerable woman and is now confessing to get ahead of the game. Another is that he was asked to have sex with someone, did even though she was drunk and he wasn't, and feels so guilty about it that he wants to get it off his chest even though she still considers them mates and has never herself raised it.

I dont get how anyone can jump to either conclusion.

He said she couldn’t consent. Whichever way you look at it, he is a rapist.

that doesn’t add up. 15yrs ago, she never mentioned it and they are friendly. Why on earth would he tell you about it? Sounds like BS and something is looming. I would run away at top speed.

He may well have spiked her drinks. She may only have a vague recollection of events. Or he is telling the truth. Perhaps he's an absolute fantasist? Only he knows what actually happened and either way it's bad.
I agree with others that it is a very strange confession after all these years.

I would think he is playing you and trying to get in your good books by pretending to be the good guy who feels guilty.
Who cares what he did 15 years ago? If he’s my age (50s) we were taught when young to never be so paralytic you couldn’t give consent. I appreciate things have changed but a good chunk of people still have this way of thinking in the back of their minds.

From what he said he has just felt guilty about it for years because he knows it was wrong, and wanted to tell me because he wanted it out there. Why he wanted it out there I don't know. Maybe he thinks it's the worst thing he's ever done. Maybe he has done far worse and wants to test my boundaries. Maybe her version of events is different (although like I said she certainly seems friendly on the texts). I don't want to come to any conclusion and therefore don't want to either dump him or not dump him!

This sounds exactly like something a rapist would say.

he’s telling you for a reason. I suspect there’s more to the story, or he’s seeing what you’ll tolerate. That story is so vile that there must be a reason behind him sharing it. It’s like he’s trying to spin being a rapist in to him somehow being the good guy. Those of us that have been in the same situation as his friend are telling you he’s not a good guy. Please believe us and leave.

I do understand why you’re trying to see his perspective and you want to believe that he is a man who feels guilty despite the woman ‘apparently’ being fine, but I think you’re being optimistic to put it mildly.

I agree with what others have said in terms of a Clare’s Law request, but also would say that there might not be anything on record and that doesn’t mean he is a nice man.

In terms of your saying, ‘She still considers them mates and has never herself raised it’ - in terms of not raising it, do you mean, with the police? If so, that’s not unusual and doesn’t tell you much. If you mean never raised it with him, you only have his word. I understand that you’ve seen messages between them that look friendly, but having been in a similar situation to the woman I would say that doesn’t tell you a huge amount. A lot of women who have been raped in that situation blame themselves or don’t want to make accusations that will blow up their lives given they may not remember what happened and were in a vulnerable state. As an aside, how did they end up in a situation where she was so very drunk and he was sober….

I would also ask yourself whether you would be ok with it if he did that to you - I appreciate he may have recognised the error of his ways and never do it again, but equally he felt it was ok to do at the time. (And, I don’t agree things were different then - decent men have never wanted to have sex with someone totally out of it.)

Only you can decide what you’re going to do, but please do it with your eyes open. Take care of yourself

Never be afraid to walk away when someone reveals something of this nature in a relationship. It's unsettling and very concerning. He was sober, she wasn't.

He's also given you his most sanitised version and laid some of the blame towards her. If a friend had told you this had happened to her years ago how would you feel?

There are many other guys you will get on with famously who don't have something they need to confess three weeks into a relationship.

You need to get away from him.

I think anyone with healthy boundaries that knows what a healthy relationship looks like would not be questioning this They would just get away from him.

Talk to people close to you that you fully trust and maybe consider some sort of therapy because it is genuinely concerning that you are considering staying with this man and aren’t seeing the huge red flag he is waving right in front of you.

Please get away from him.

As pp have said, the most concerning aspect here for you, is him telling you.

Why has he told you that? Is it to gauge what you'll accept? To get his story in your head first? Because he has some weird complex about what he did? There's a self-serving reason he's told you, the woman he wants to impress/be with, about the fact that he did something that would legally be considered rape, and is still friends with the woman now.

It's a big red flag whatever his reasons, frankly.

A sober person can tell the difference between someone who is drunk enough to be a bit disinhibited but still sufficiently aware and in control of what they’re doing to give meaningful consent, and someone who is off their face, struggling with motor function, slurring their speech and not making full sense, nodding off, behaving out of character, etc.

It's his own description. That's the thing, isn't it? It doesn't really matter what each of us has done while drunk, how any of us sees the finer points of drunken consent, or what exact words OP's boyfriend used. It doesn't even matter whether she felt, the next day, that she'd not only consented but insisted.

This isn't 2020s sensitivity-informed hindsight, either, he knew at the time but wasn't 'strong' enough to resist fucking a woman he believed was non-consenting.

This in itself is very worrying. Now we've also got concerns over why he's landed this on you, @Inengland, yet not on the woman he believes he raped. And why it still looms large in his mind 15 years later. So large, in fact, that he just had to tell you about it after knowing you for only three weeks.

He must have told his previous girlfriends this story, or a version of it, however many women he's dated in 15 years. Has he never been able to talk to anyone like I can talk to you? Bullshit. He puts his 'I was nearly a rapist' guilt story, or a version of it, out every time.

The question is why he does it. Up to you if you want to stick around and find out the hard way but, as @MsJinks says, It’s strange - but useful - guys do this. In my experience, and many others, they're telling you something they've done far more than once and intend to carry on doing.

This is important. Like so many others, I had plenty of very drunk sex in the early/mid 2000s as a teenager – drunk enough, I imagine, that neither party would be considered capable of consent much of the time. But none of us realised that, back then, and we all thought that the other person's active and enthusiastic engagement was 'enthusiastic consent'.

Whereas this guy was completely sober, and admits he knew the woman was so drunk that she was incapable of giving consent. He knowingly took advantage of her drunken state and her vulnerability, to get his end away. That's predatory, it's gross, and yes, it's rape.

Be glad he's told you about it so early on, OP, so you can get rid easily before you get attached.

He's also taken a huge risk because if the woman he did this to ever does raise it with police, he has confessed to you and you hold evidence that would help her case.

The fact he's taken such a huge risk telling someone he has known for such a short time is also concerning, that he senses he can win you over, or that there are other power dynamics at play in who he is, ie manipulation disguised as vulnerability.

Someone who is still pretty much a stranger, feels 'so comfortable' with someone he barely knows that he 'unburdens' himself after 15 years. I'm sure it was done in a "you're so special" "I've never felt like this" "I feel so comfortable with you/want a future with you" kind of way.

Nope. There is absolutely no other reason than a manipulative one to share his feelings of "guilt and remorse" with you. There really isn't. He's good, isn't he? He's got you trying to put some kind of spin on it to yourself so you can justify staying with him. Good luck
