They could have had the battle over Henry without the stabbing. R and U could have kidnapped him in just the same way, after Helen had left and gone to live at Bridge Farm. Rob would have claimed Helen was not capable of looking after Henry etc etc.

Anyway. Thanks for the CC prosecution link. This is what I meant about this legislation having no teeth. Just how many women will actually take themselves off to a police station, or call WA because their partner makes them feel like shit? They won't - because the first question they'll be asked is has he been violent? And when they say no the police will do this Hmm face and start looking shifty.

He was handed an 18-week prison sentence, suspended for 18 months, and ordered to pay £100 compensation.

Riiiight ...

First prosecution for CC: and the problem only came to light when it escalated to violence.

I disagree with the grumpy/sad faces about this. I think this is a brilliant result. I thought this would be a difficult crime to prosecute successfully and I'm glad it has happened.

This is where the story line should have gone. Can you imagine the whole of Ambridge talking about Rob if he'd been convicted?

And remember that any stepping out of line results in the suspended sentence being imposed. All it would take is a comment from some one like Jazzer or any of the Grundy men that real men don't behave like that for Rob to throw a punch. Off to jail - do not pass go.

The thing about pricing Sara Is IMO we should pay more (if we can afford it of course) for quality products otherwise all that will be left on the market will be tinned eggs from China fgs.

R4 We don't actually want Rob in Hampshire, thank you very much. I'm sure there must be a tiny uninhabited island off the coast of Northumbria somewhere which would suit him down tot he ground. Or North Korea, perhaps. He would go down a storm there.

I agree with Lass, I was quite pleased to see that there'd been a successful prosecution under the new law. I was concerned there was a danger it would be viewed as toothless because so often convictions depend on one person's word against another. I did wonder in this case whether the partner got advised to plead guilty because he made it too obvious in talking to his lawyers that he could see nothing wrong with the way he behaved.

I also thought the sentence was reasonably OK. Not only has he got the danger of it being activated if he puts a foot wrong, but it's on his record and is something he will have to declare (at least for a time) when applying for jobs. Am I right in thinking it could stop him getting a visa for some countries including the US? And I assume the fact of this conviction could come out under Claire's law?

Forget for a moment that Helen stabbed him more than once and so acted disproportionately. What I'm curious about is whether or not you can physically defend yourself against a mental assault and plead self-defence.
In other words, can a woman who is being coercively controlled and driven to utter desperation lash out physically against her abuser and offer the same defence in court as she would if he were beating her?

I ask this because it seems to me that Helen wouldn't be treated the way she is if she had physical marks of abuse. The victim of CC still has the difficulty of proving it.

Enoch I think the answer is that CC wouldn't be a defence to the fact of the assault but would be a factor in determining her state of mind when deciding which offence to charge her with, and a mitigating factor in sentencing. So she is more likely to be found guilty of wounding than attempted murder, because the latter has to show an intent to kill.

I missed Thurs pm's episode and my heart sunk at 2pm on Friday. It really sunk. I was glad it was all over and didn't listen on Friday 7pm. Phew. I feel better already. I feel the habit is breaking instead of me.

It all lies in the proof of CC though. Thus far Helen hasn't reached the stage of acknowledging what has been done to her or, if she has, she can't yet verbalise it.

I keep hoping a fellow inmate will take her in hand and convince her that she has to put up a fight.
