Neighbours painted out new fence

Discovered today that our neighbours have painted their side of our year old fence. They didn't ask. There are dribbles of paint coming through. I'll talk to them tomorrow but what is normal to ask for in this situation? For them to clean it? Replace it?

Technically it's criminal damage for them to have painted your fence without your permission. It's your property, not theirs.

I would say something but leave it at that. Would you be able to sand off the bits of paint that have come through?

Since it's the law that you own both sides of your fence, and there have been some batshit neighbour disputes have gone to Court there must be.

It's a niggle right enough @refreshingseahorse and they should have asked you first, but you would be batshit to say anything to them. Just sand it off as a pp said, or paint it over a little bit in the colour on your side. Suggesting they replace the fence is a new level of bonkers!

If there was a gold medal for the most epic First World Problem, you'd be the winner! This is a total non-issue.

Legally is irrelevant, the law is not going to have any impact on what the right thing to do is here, anyone who has ever used legal action for a fence has undoubtedly found there are no winners.
The neighbourly thing to do would be to post on Mumsnet to keep people here busy, and then go round and chat with the neighbours about it and come to an understanding.
I like the idea of asking for their paint and doing your side too, or if the chat goes badly better still getting a clashing colour and going over the top!

Be thankful of the colour used - I replaced all fence posts and panels around garden and one lovely ndn painted their side RED.

My side resembled the scene of a zombie apocalypse

Totally incorrect. It depends who owns the fence. If as in the OP it is the OP’s fence and boundary they need permission and now have to put right.

Yep. Which the OP could take them to court over. And they would win. Which would include costs. Been there. Neighbours had to replace the fence.

It's annoying and I get why you'd be cross but i dont think theres anything you can do now.

We had to pay for a new fence when the old one blew down. It was bad enough spending a few hundred quid on some wood. But it was made worse when neighbour sprayed his side grey. I fecking hate grey. Loads of it dripped through to our side. We had no choice but to also paint ours depressing grey too.

You could have painted your side any colour you liked. It would probably have worked better if it was a darker shade than the neighbours used. It’s your fence so it wouldn’t have mattered if you had dripped darker paint through onto their side of the fence that you paid for and which you own in its entirety.

I can't believe so many people are suggesting OP should basically suck it up.

A new fence costs ££££. Money that the OP had to work for. But she should just accept that someone decided to take it upon themselves to turn her expensive fence into a Jackson Pollock? Not a chance.

Really? We spent nearly £6000 getting a new fence around our garden as by some poor luck we own all the bloody boundaries. We go away and on our return discover the neighbours on one side have painted their side black and the top rip resulting in thick black paint dripping down 8 fence panels on one side. It looked absolutely hideous.

we went round and asked them to fix it and they laughed and said no way. So we sent a firm solicitors letter reminding our boundary with instruction to return fence as is and removed historic permission for hanging baskets attached to our fence. They also cannot have any climbing parts. Made it clear if it went to court we would be seeking costs.

They took legal advice who told them they had no hope so they had to replace the entire fence.

sorry but absolutely no way am I paying thousands for a new fence to have it looking crap.

As someone who has paid for a fence and their neighbours painted it blue on their side and some blue paint dribbled through - I thought, oh the blue looks quite nice on that side, and carried on with my life unperturbed.

😂 I have an irrational hatred on non natural colours on fenced.

the blue long dribbles down my fence in what was quite a small garden caused me a weird level of rage!!! Double sided fences are they only way!

my dad once put in a new fence on a house he was selling. The neighbour pained ‘her side’ pink. It dribbled all down the beautiful fence and looked dreadful. The night before the estate agent was coming to do the photos. There was a quick 8am run to the builders yard to replace the panels.

You paid for the fence presumably but is it a party fence according to the deeds?
Our fence at the bottom of our garden is ours but the fences between us and our neighbours either side are party fences. Did you check the deeds before you erected it or ask the neighbours to contribute towards it?
