ahhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhhh i need to rant

So after 8 weeks of saying they wanted tenants in situ and then realising they couldn't cos of their mortgage I renegotiated terms with my buyer which included appointing a new solicitor.

It's been over a week, my tenants have been given their S21 which the estate agent said they wouldn't do til the buyer confirmed their solicitor, and the buyer still hasn't sent their solicitor details and every day the estate agent keeps telling me today. On friday they said they were speaking to the solicitor that day but today they don't even have one.

Why does the buyer have all the power in these situations. I am so fed up with this whole process. I am tempted to remarket it now but don't want to piss the tenants off any more by having viewers come in and out.

Anyone know how long it takes for a deposit to be received when sent to the solicitor?

Hi @shiveringwiggles - if your seller owned the leasehold and then bought the freehold, the two effectively merge so the leasehold no longer exists, and they just own the freehold now. I've had this crop up a few times, usually with old, unregistered houses (not sure if yours is unregistered).

Obviously - disclaimer that i haven't seen the title so can't tell you if that's what it is but it may well be, in which case it's not at all an issue to worry about Smile

@Jujuball thank you. Turns out they've received part of it but not all of it, rest due tomorrow, it's so frustrating how fragmented this whole process has been!! I just want it over with!

Ooo, interesting! My house is 1930s so I would assume it's registered- it pops up on the Land Registry search tool.

Are there any other ways it could happen?

@shiveringwiggles hmm interesting! It's hard to say without seeing exactly what the title says, but if you're worrying then ask your solicitor to clarify exactly what the issue is. You're paying them to advise you, so don't worry in the meantime when there could be a simple answer hopefully Smile

Popping in again to say after no new viewings for a couple of weeks we've dropped our asking price. Fingers crossed it generates some interest as we've now lost out on the house we really wanted to offer on Sad.

@kerrymucklowe2020 I don't know the specifics but I know it can be a contentious issue with developers and councils arguing over it. How long ago was the development finished?

There's some ex military houses here that the council won't adopt the roads for, the maintenance is paid through a monthly service charge.

Does the legal info say if it will be adopted in future?

@shiveringwiggles now that is a bit unusual! I have had this before though - the seller's solicitor will need to apply to the Land Registry to remove the lease from the title (presuming there's a valid reason that it shouldn't be there any more of course).

The LR are quite slow at the moment, but the seller's solicitors can apply to expedite the application due to the pending sale to you so that it's dealt with quicker.

@kerrymucklowe2020 It depends when the builders finished the last house. They are still building (the very last house) where I am so the roads are yet to be adopted. I've been here for a while and imagine some of the original buyers were here 9 years ago!

@SunshineAndSand20 @notheragain4 I don't know when the last house was built ( will Google ) The development is finished. By the looks of it has been finished for a while. No maintenance fees to pay but one of my solicitors questions was asking who is responsible for the road/ land outside my house ( to be! )

@kerrymucklowe2020 yes I think we have that mentioned in our paperwork, is it some kind of protection to say the road is maintained until the council takes over, not sure who is maintaining it if the developer has left, unless they still have responsibility?

Apparently "part" of the deposit has been received, they are hoping the rest will be received tomorrow, so I'm hoping if that's the case we might be able to exchange tomorrow. I'm going to annoy my solicitor first thing and ask if we can exchange that day. Fingers crossed.

People do send their deposits in several chunks sometimes to avoid paying fees to their bank - it is pretty annoying when it would only cost them about £20!

Oh don't get me started. I'm losing the will to live. I'm assuming he's been a tight arse and not wanted to do CHAPS so done in separate instalments. I'd have paid the bloody fee if I'd known.

Although saying that not sure if it's to do with the HTB ISA and the way that's done? Yeah maybe it's that actually.

Either way. Aaaargh I just want this to be over!

HTB ISA bonuses are easy peasy - the solicitor tells the govt what day to pay it and it goes straight into their account. The client's savings that were in the HTB account are transferred to another of the client's bank accounts at the time of closing their account down (which they have to do to be able to claim the bonus).

Long winded way of saying that HTB shouldn't affect how they send the deposit, and yes they're just testing your nerves by the sounds of it Grin

@Jujuball thank you, it's so helpful to have someone around who knows what they're talking about, I'm one of those people that wants ALL the details, DH just wants it to happen lol. The last update from his solicitor said the rest should be in tomorrow, hopefully that means we can exchange tomorrow, I don't think my nerves could take another night!
