So the road is owned and maintained by the developer until it is fully adopted under a S.38. There would already have been various technical checks etc. Usually when the entire scheme is finished, they top off with wearing course and they're supposed to sort the s.38 straight after but it can drag on for years.

I work in development and in answer to your question why would a 9 yr old street not be adopted. People forget, it's at the tail end when all the houses are sold and often no one chases the developer so they crack on with their next scheme. It's not in the developers interests to not get adopted because often they have paid a bond, maybe £20k or £30k which they'll get back in completion, and they are liable for upkeep while they own it. If I found out my street wasn't adopted, I'd take loads of pictures of faults in the roads and pavements and with lighting columns etc and send them direct to the MD of the local regional developer insisting that they dealt with the problems immediately or you will go to the local paper. Hopefully that would be enough for them to kick someone in the technical team to get them to finish the job.

So we did it! All moved in. Buyers solicitor was a bit slack this morning sending the monies, in the meantime the developer called me to say they had chased our solicitor for an update and I told her we had vacated but the movers were going to start charging a waiting fee for anytime after 12, so they came and opened the new house up so we could unload. Sale completed around 1pm, purchase completed at half 2.
We are knackered but extremely happy!

@ulanbatorismynextstop - well, we haven't moved in yet ( still in enquiries stage )so I'm not taking photos JUST YET! Ha ha. Good idea though 🤣 it's the solicitors job to sort this isn't it? Plus have asked the local council via FOI Act.

Can’t believe we’re on page 31 already...I was way back on page 1 hoping to exchange before the end of this thread - we shall see!

Our sellers’ solicitor has finally stopped jollying around and decided to do some work. We had a frankly pathetic set of responses to our enquiries, but on the plus side they’ve finally, finally sent the fixtures & fittings and property information forms through. We’ve only been asking for them for about 6 weeks 🤷‍♀️ I actually rang the EA earlier asking if there was something going on that we should know about (genuinely started to wonder if they’d lost the forms somewhere or something) and she came back ten minutes later having spoken to the solicitor saying they’d finally been sent an hour or two before! We also now have a fixed date for searches coming back - this Friday. I’m going to try and get ducks in a row by then on the basis that we can still exchange on Friday (as per my plan) if the searches come back clear; if not, I’m going to push very hard for Tuesday to aim for completion on Friday 04/09. Suspect it will end up being the following week but I can dream!

Has anyone had any thoughts on thank you tokens for EA etc?? I’m planning to leave our buyers a card and a bottle of bubbly (the lady we bought our first house from did it for us and I thought it was a lovely little gesture and made a stressful day that bit better, so planning to do the same!) and I’d like to get a little something for the EA of the house we’re buying, who has been incredibly patient and helpful and tolerant through this whole thing. Any thoughts or ideas?!

@FourForYouGlenCoco I was thinking of sending my solicitor flowers when it’s all over, I don’t know if that’s a bit weird though? I know she’s just doing a job but we’ve not had to chase her or anything, compared to some of the horror stories I read on here she has been brilliant.

We are into week 9 now and waiting for a final report submitting. We wanted to have moved by mid August at the latest. Feels like it will be late September at this rate.

Sorry but I just need to vent somewhere. So we pulled out on our purchase at the weekend as we were told by the EA that the vendor & their solicitor was not going to do anymore to sort the legal issue and our solicitor wouldn't represent us with it hanging. Well apparently this was incorrect and the solicitor came back yesterday having basically sorted it with our solicitor saying they would now proceed-great.

However they remarketed the property Monday and increased the asking price (our sale price was agreed in March) and apparently they already have an asking price offer which is 7k higher than original offer! We're waiting to hear back from the vendor if they will still proceed or will go with the higher offer. We don't know whether to email the seller to ensure that they know the whole reason we pulled out or just leave it. Or whether we increase our offer, but out of principle I really don't want to, however we will likely end up paying that price on a different house and there not much about suitable at the mo. So stressed right now!

Joining Smile - we're FTB and had offer accepted on 7th August, we finished full mortgage application about a week after and had valuation come back about a week ago I think. We got solicitor instructed/asked to start searches about 10 days ago (delay with trying to get paperwork etc as their office is closed). Got a building survey booked in for about 2-3 weeks time.

Doesn't sound long ago at all when I'm writing it down but after an initial mad flurry it feels like we haven't heard a peep from solicitor or mortgage company for a while and haven't spoken to the estate agent since putting in an offer so hoping everything's ok from their end! As we haven't done this before what's the usual process, ie how much do you normally hear from everyone and how much do you have to contact them to check up? Should we be staying in touch with seller/estate agent? Not sure why we would but feels quite surreal just waiting without knowing what's happening.

We've had the call that they are ready to go, we've confirmed we want to exchange, so now I've just got to pray they can get a hold of our buyer to confirm he wants to exchange today! He can be tricky to get hold of so I'm feeling SO anxious!!! I can't take another night!

Do they have to get the confirmation on the phone or can they do via email?

@burnout101 So I have stated in touch predominantly with just our solicitor but have spoken to the estate agent to arrange dates for things like surveys and additional viewings. We are selling at the same time as buying and have heard virtually nothing from our buyers through the estate agent. Do you know if the chain is complete?

@SunshineAndSand20 - I think our seller isn't buying again atm, they're moving abroad and IIRC they're storing belongings with family so I don't think we actually have a chain either side. I mentioned to seller when we needed to go for 2nd visit that we had done mortgage application and were waiting for offer and they'll have been contacted by valuer and surveyor so hopefully they know we're moving as fast as poss. How regularly do you hear from solicitor?

New to the thread, first time seller! We've just listed it this week. Estate agents have been great, got us viewings pretty quickly and out of 3 viewers, so far 1 has liked it. 2 more viewings scheduled this week and the viewer who liked it wants to come back with her DH within the week too.
I've been so anxious about all this, but at least despite being a slight fixer-upper, the property is attracting viewers.

We've chosen a house we're really keen to buy, but they've been trying to sell for nearly a year and will put it up for rent if it's not sold within the next couple of months so that's stressing me out a little. On the other hand, our budget might be higher than we initially thought, so we will likely still find something that works, it just wouldn't be as much of a dream house as the place we've chosen.

I guess I'm just here to vent if things get crazy or we lose the chance to buy or favourite house!

We've exchaaaaaaaanged! Literally happened at like 16.58 but they just got it in. I am so relieved and terrified in equal measure! Completing on the sale Friday and purchase end of September, so not over yet but the stressful bit is done!
