@daisymill that's very advance packing. What gap are you planning between exchange and completion? But i get it's gonna be harder to do with a baby etc!

So it's been a busy weekend for me. Looks like my sale is back on. Apparently a lot of confusion and miscommunication. My buyers always intended to buy it for themselves but thought to make it easier they'd buy it with the tenants and evict them themselves and didn't realise the problems that would cause!

So my agent has taken it on themselves to find my tenants a new place so they can put in their notice (one month) rather than me issuing a S21 (three months) but apparently my buyers are willing to wait as long as it takes (which signals to me they actually want to live there rather than rent it).

As for our purchase it's full steam ahead. had all the documents on Thursday and went over them yesterday. Still hoping to exchange in a month or so. Fingers crossed.

Silly question, but will the EA tell us what to do next? We accepted an offer on Saturday, but have no idea what to do now. Reading everyone’s posts is both informative and overwhelming!
To those of you packing, how long did you wait to start doing this?

Estate agents are so frustrating. I emailed ours on Thursday and chased this morning- no reply!

I emailed the solicitor 10 minutes ago - she's replied straight away despite having worked on our case yesterday!

Maybe the solicitor should keep some of the estate agents fee!

I'm impressed by my vendor's EA, more so than with our own one although they're ok. Vendor's one is more responsive to emails than our solicitor.

Found out today that vendors have found an 'end of chain property'. Is this the same term as 'chain-free'? If so our chain would be FTB-us-vendor-vendor's house. I'd be super happy with that.

Countdowntonap- have you found somewhere to buy? Next step is instruct solicitor and sort the initial paperwork I'd think.

@countdowntonap are you buying or selling. If selling you just need to appoint a solicitor and let the EA know who it is. If buying you need to appoint a solicitor and start sorting a mortgage (either directly or with broker) and see if any friends have recommendations for a surveyor too (although i'd hold off on that til you've spoken to a mortgage company). Then wait for all the paperwork :)

We have received the contract and TR1 for our house. We really are getting turfed out of here. Our solicitor is getting all the ducks in a row so that by the time we get the survey completed and mortgage offer, all that needs to be done is request funds from the bank and exchange and completion asap.

We are yet to receive the TR1 and contract from our vendors. I can understand that they are waiting for the survey to be completed on their house before they continue with the process.

We drove past the house yesterday and we saw the vendors removing a lot of their stuff from the house. Progress there too then.

@Baxdream other way around with us, our EA is pretty good at responding, our selling solicitor hasn't yet replied to my emails from last week, doing my head in. We have a different solicitor acting for our purchase, she's amazing, she responds within the hour almost every time. I really wish she could be out selling solicitor!

EA has emailed me to say buyer has signed and sent contracts. I must buy her a bouquet of flowers as she has been so good at chasing and keeping me right up to date (since my complaint!) I think she is going above and beyond at the moment.

No word from my selling solicitor so looks like I will be doing a cringeworthy "you're working for me" complaint to him too!

@Notyetthere does your contract have a clause in it about one party paying the other party a fee to cover legal fees when notice to complete is given? Does anyone else have a clause like this in their contract?

@Lemonylemony we have something weird in ours about having to pay our buyer's solicitors £240, I've no idea why, I probably should have challenged or asked but I haven't!

We put our London flat on the market almost four weeks ago - we had eight viewings before we decided to drop the price (we're looking for a quick sale as we want to move into a new build). We had five viewings over the weekend with another three booked in this week but have heard NOTHING from the estate agent today despite me nagging them for feedback :-/

I swear this house selling lark is ageing me prematurely!

@Lemonylemony ours has £150 in it for our buyers to pay it only if completion is delayed by them beyond completion date. This would be the solicitor fee on top other fees if it all went tits up.

After hassling our EA, we spoke to one of the Directors there. Apparently the guy we deal with was meant to have called us last week... ho hum.

Anyway the good news is that our buyer is happy with the searches and is ready to move on to the next stage.. I presume contracts? Do I need to do anything or do we wait for the buyers solicitor to contact our solicitor??

At least we have the EA Director helping us now so he is going to call us again tomorrow... let's see! My DH saying that we weren't terribly happy with their service I think may have helped!

We have now got the searches back.

Hopefully just solicitor's enquiries to do now. Road still showing as private, although Barratt told us it would be adopted at some point in the future by the council. They just need to confirm that to the solicitor now.

Then need communication from the management company.

We've got contracts to sign! But still no mortgage offer. The contract is blank next to "completion date" - how can I sign a contract and agree to be penalised for failing to complete on the agreed date if there is no agreed date? Or is this standard practice?

Need to ask solicitor for clarification. I wish they'd explain things a bit more, instead of just sending a blank email with an attachment.

@Lemonylemony We do!

"If either party fails to complete...defaulting party shall pay £150 towards the legal costs..."

Our contract also says the sale includes contents indicated on the attached list - but there is no attached list. Grin I don't understand anything. Going to have to call the lawyer and have him talk me through it.

@BigHuff the completion date won't be inserted until exchange of contracts - totally normal, don't worry Smile the contract isn't binding for you to buy on the completion date when you sign, it's binding when you exchange, which your solicitor won't do without your permission.

How long is it usually between signing contracts and exchanging? (Well we've signed the contract and TR1 to sell but haven't signed to buy yet). We've had mortgage offer and searches are back. Oh and we've answered all queries.
