this was the item I found on consumer direct website
"If a price has been agreed between the salesperson and myself, can they change their minds?

If a price has been agreed between the sales person/manager and myself on a specific item (electrical goods), does he have the right to refuse to hand over the goods, which have already been paid for, if he then realises a mistake has been made on the price?"

"If you'd already paid for the item then you had a contract with the shop to buy the item at that price.

As the contract had already been made, it was too late for the shop to alter the terms of the contract and you're entitled to the goods you've bought.

It would've been different if you hadn't paid for the goods when the shop discovered the error in the price. No firm contract would have been made yet to buy them at the price advertised and the shop would have been free to change the price."

Obviously this does not refer to internet but could mean something.
Sorry its taken a couple of days for me to post but am off on hols tomorrow so hectic weekend.

phone consumer direct and explain situation - they were really helpful and will even tell you what to write in a letter.

Phoned them and I have to write a letter along with a copy of the email I recieved showing 'koyoto bedstead with storage.'

What are you putting in your letter ChrysantheMum?

I had a call yesterday and the lady said she was confirming delivery of my BED on Weds morning. Oh well, I will be refusing it but they haven't heard the last of me.

just refused delivery of my drawer!!

I rang additions and the woman just said no the coding is for the drawer, and i said but i ordered bedstead.

I just thought i can't be bothered with this and said can i have a refund, and it will go back on when they get the drawer back.
She then said

'we do have a special offer on today Mrs pirate, it's a double or kingsize satin duvet set with matching embroidered pillow cases...' to which i just burst out laughing and said 'yes but i havent got a bed to put it on'

oh well if was fun whilst it lasted !!!!

Thanks mutt, if it doesn't work I'll do the same as you and go to trading standards, I haven't got a legal advisor though!

mollysawally - by speaking to Consumer Direct you are taking legal advice and should put in your letter that you have done so.

state what you ordered.

state why you are unhappy.

stick some legality in there ie Sale of Goods Act 1979

say what you want them to do about it and when you want it done by ie I want my bed in the next 7 days.

Consumer Direct will go through it all, cannot speak more highly of them (and no, do ot work for them!). more than can be said for a certain company...sniff..

I know all of you have the law on your side and that the co reps shouldn't be rude to you but do any of you not feel that your actions could ruin somebodies job? It was very, very unlikely that this wasn't going to be a mistake. I think that you should all just swallow it.

Just because you are right about something doesn't mean you are right to act on it. Do it, by all means, but you all knew when you ordered these that it was unlikely that they were genuinely selling a whole bed for the price of a drawer.
There is every possibility, particularly in this economic climate that the idiot who made this mistake will lose his/her job if it costs them hundreds of pounds to fix said mistake. That is a chance that I would not like to have on my conscience. I think you are wrong in persuing it.

i don't think a huge company would have just 1 person that fingers could be pointed at.

and even if it did, that does not mean that they can get away with messing loads of people around.

it is this kind of corporate superiority as being demonstrated by the company in question that really gets my goat. even if they do have to hand out a few free beds, i think that they could afford it, tbh.

so my conscience is clear.

it is not just the matter that the offer has been made in error.

blatant ignorance of their own terms and condiions and also basic good manners are also in question here!

as have said on the other thread - it is the principle that is the issue, not necessarily getting the bed!
