Is Angela Raynor a liar or is it all anti Labour media bias?

I’m well aware how anti Labour a lot of the main stream media seem to be so I wasn’t paying much attention previously to all the stuff about how she should have paid capital gains tax on her house, etc. she was adamant that she didn’t need to.

So it seems like she said it was her main residence so not liable for capital gains tax. But her husband and kids lived in a house a short distance away apparently for the first five years of their marriage which is unusual. A neighbour who lived next to her “husband’s” house said it was the main family home and Angela definitely lived there.

I’ll be sad if she has lied. Always thought she was on the side of the ordinary person. I guess the police/tax man might have a hard time proving anything though regardless of the neighbour’s statement. If all bills, etc were in the individual names there’s no evidence.

That's not correct - she needed to nominate the property within 2 years of her marriage otherwise HMRC make the decision for her based on the facts. I read that in the link provided by Merrymouse

Yes you do need to initially nominate within two years, but you can also subsequently flip the nomination I think.

Eta: advice from HMRC confirms this:

I also know how people try constantly to avoid paying.
It is pretty clear she lied.

It is also pretty clear how many people on this thread are blind to their political parties failings. I just hate them all.

I don't care if she is Labour or Conservative or SNP, she tried to avoid a very easy to avoid tax bill. I think if she wasn't who she is, she would have managed it without any scrutiny. I could have done this but I am honest.

She is as bent as the rest of them.

Better take your evidence to HMRC, they are pretty hot on tax evasion.

Its not about party loyalties for me, its about yet another woman being hounded by the (male dominated) press in a way that simply does not happen to men.

There is simply no evidence that AR lied to avoid tax.

I often wonder why so few women in politics etc, these sorts of witch hunts confirm why.

Presumably she answered those questions when the police investigated whether she had broken the law i.r.o where she was registered to vote?

They didn't investigate previously - they decided not to;

A GMP spokesperson said: “We have received a complaint regarding our decision not to investigate an allegation and are in the process of reassessing this decision. The complainant will be updated with the outcome of the reassessment in due course.”

The reply HMRC gave in the link above
says you can change the nomination at any time, so if you decide to sell one property and it is more advantageous to flip to it at the point, presumably that is what you would do.

But maybe ask HMRC using the facility above?

Why are you doubting that she told the truth to her tax adviser?

I am certainly not discounting it!

Its not up to AR to prove her innocence, its up to her accusers to provide evidence of wrongdoing.

Tax evasion is usually a criminal matter, so beyond reasonable doubt is the bar.

So why should she publish her tax affairs, do other politicians who have been found to have evaded tax by HMRC do so?

I think this is quite a clear explanation.

CGT is time apportioned and you wouldn’t be able to claim private property relief for a period that the house hadn’t been a main residence BUT you don’t pay CGT for the last 9 months of ownership anyway (18 months back in 2015).

I agree with @Tauranga. I'm going to have a whopping CGT when/if I sell my home because of a similar situation. We saw an accountant who said "This is what you'll have to pay". We have an accountant in the family and his advice was "Well, you might be able to get away with telling them blah blah (v similar to A Rayner).." while pulling a face. I'll be paying it.

An accountant would know that Angela Rayner’s explanation just showed she doesn’t understand CGT. They would also know that many clients pay the right amount of tax while remaining clueless about why, and many clients pay the wrong amount of tax because of ignorance, and later pay up and are just just charged interest and penalties with little fuss.

That doesn’t necessarily mean she under paid tax. The information required to calculate whether Rayner owed tax or whether she paid it is not in the public domain.

Ironically I suspect that if the shoe were on the other foot and this were about a Conservative politician, Rayner would be making comments that are similar to many on this thread - because her knowledge of CGT is patchy.

As far as I can see she didn’t lie.

Her explanation would have been correct if she wasn’t married.

She just doesn’t understand CGT.

Meanwhile, Tory Minister Michelle Donelan has cost the tax payer £34,000 in legal fees for tweets she made from her personal account, so def not covered under her ministerial roll.

This is relevant because it highlights the different treatment Tory women politicians get from the media compared to Labour ones.... i'll take this back when the Daily Mail goes after Donelan..... i wont hold my breath.

There is also no disputing what Donelan has done.

Realistically nothing has changed. If AR is found to have done nothing criminal, all is well. If she has, fair enough. The double standard will still apply - I am still not seeing any frothing in the right wing press about Michelle Donelan, who definitely did commit a crime, that is, libel, and has cost the taxpayer north of £30k. But that's fine because she's a Tory.
