The entire world's movers and shakers, swindlers and fakers, public money piss-takers will be watching in trepidation at what Trump will do to them. The entire world's great and the good, high and the mighty, shifty and flighty will be supporting Hillary. Will you be with the people supporting Trump?

Have you got the ice cream, the chocolate, the biscuits and the matchsticks to keep the eyelids open ready?

As a warm-up, here is Sky News's 30 minute documentary shown last night

"Trump. Could it really happen?"

What Hillary Clinton said about the rape case in writing was:

"[Prosecuting attorney Mahlon Gibson] called me to tell me an indigent prisoner accused of raping a twelve-year-old girl wanted a woman lawyer. [Prosecutor Mahlon] Gibson had recommended that the criminal court judge, Maupin Cummings, appoint me. I told Mahlon I really didn’t feel comfortable taking on such a client, but Mahlon gently reminded me that I couldn’t very well refuse the judge’s request."

In an article in Newsday in which the prosecutor was interviewed, this was reported:

"Cummings (the judge) agreed to the request (for a female lawyer), scanned the list of available female attorneys (there were only a half dozen in the county at the time) and assigned Rodham, who had virtually no experience in criminal litigation.

“Hillary told me she didn’t want to take that case, she made that very clear,” recalls prosecutor Gibson, who phoned her with the judge’s order."

In a CNN interview:

"Gibson said Clinton called him shortly after the judge assigned her to the case and said, “I don't want to represent this guy. I just can't stand this. I don't want to get involved. Can you get me off?”

“I told her, ‘Well contact the judge and see what he says about it,’ but I also said don't jump on him and make him mad,” Gibson said. “She contacted the judge and the judge didn't remove her and she stayed on the case.”

Why do you persist in misrepresenting the facts on this, claig?

Why didn't Hillary say that on the Hillary Tapes and whu did she say the prosecutor asked her if she could do "a favour"? Is that forcing her to take it?

'Why do you persist in misrepresenting the facts on this, claig?'

I am misrepresenting nothing. I am quoting what Hillary said on the tape in a recorded interview not what she said at another time.

See if this helps

My boss at work says "can you do me a favour and hang the trousers up"

Or the Godfather movies you must have seen those...

claig · 29/09/2016 13:26

'[Prosecutor Mahlon] Gibson had recommended that the criminal court judge, Maupin Cummings, appoint me. I told Mahlon I really didn’t feel comfortable taking on such a client, but Mahlon gently reminded me that I couldn’t very well refuse the judge’s request."''

So the Prosecutor tells the Judge which "woman lawyer" should be appointed because the defendant wants a "woman lawyer". The Prosecutor calls Hillary and genty reminds her that she "couldn't very well" refuse the judge's request, which seems to be the Prosecutor's request to the Judge.

I don't get it.

Which bit claig

The request for a female lawyer i should imagine is the defendent thinking that the jury would belive that a woman wouldnt defend a child rapist

If its a woman defending him he must be innocent because a woman wouldnt defend a child rapist

I dont know though, just guessing

claig · 29/09/2016 13:34

How does this work? Who pays for the defnece lawyer? Is this the State paying or is it private, is the defendant paying? If it is the State paying, can the defendant decide that they want a "woman lawyer" and does the entire judicial system, the Prosecutor, the Judge etc, all then comply with the defendant's wishes?

I don't know how the legal system works. Maybe some lawyers could explain it.

The lawyer, Ann Coulter, says that no lawyer is forced to take such cases in the States and that it is always the same lawyers who take Ted Bundy cases etc.

Also on tha tape, Hillary says she did not take hardly any criminal cases, so it sounds like criminal cases were not what she was experienced at. The defendant wanted a "woman lawyer" and the Prosecutor and the Judge and everybody seemed to go along with that request, but why would an inexperienced criminal case "woman lawyer" be chosen?

'The request for a female lawyer i should imagine is the defendent thinking that the jury would belive that a woman wouldnt defend a child rapist'

Exactly and it seems that the legal system facilitated this request of the defendant who was accused of brutally raping a 12 year old girl. Is this normal that they would all facilitate this request?

Listening to that tape and the stuff on the forensics and the affidavit stating that Hillary had been informed that the girl was a "fantasist" etc, it makes you wonder what goes on in courts.

Can someone explain why a Prosecutor should recommend a defence lawyer for the defendant to the Judge on a case?

Is the Prosecutor the lawyer for the victim of the crime or is the Prosecutor something else?

No idea

Could be a mix of things

A bad case lets give it to a woman so it doesnt fuck up a mans career?

Lets give the newbie a chance to prove herself?

Someone might have thought she would be good as a crimnal lawyer ....lets see if she is?

RufusTheSpartacusReindeer · 29/09/2016 13:46

The prosecutor doesnt really act for the victim

I dont think

I agree though , i think a lot of court stuff is just game playing

RufusTheSpartacusReindeer · 29/09/2016 13:48

I just looked up Ann Coulter

I would take her word on this as she didnt qualify until 1988 so you would imagine practiced law in the 90's

Which is a whole different country to the 70's Grin

claig · 29/09/2016 13:48

'i think a lot of court stuff is just game playing'

It is positively frightening when you hear Hillary talk about what happened with the forensics. Most of us are lucky enough never to have to go to courts, but if this is what happens, it makes you wonder what the hell goes on in them.

RufusTheSpartacusReindeer · 29/09/2016 13:52

Maybe claig they thought that the case was so cut and dried they could give in to his request for a female lawyer so he didnt have a leg to stand on defence wise???

Dunno

RufusTheSpartacusReindeer · 29/09/2016 13:54

I was in jury service once, two seperate cases

Quite shocking really but it did guve me a better understanding of how apparently guilty people can go free and innocent people jailed

I think it works usually, or maybe its just the best we have

claig · 29/09/2016 13:54

But when you take into account what happened to the forensics, it sounds like if that had not been messed up, it may not have been cut and dried.

RufusTheSpartacusReindeer · 29/09/2016 13:55

true

claig · 29/09/2016 13:57

'Quite shocking really but it did guve me a better understanding of how apparently guilty people can go free and innocent people jailed'

What is frightening is if the judicial system all know each other and ask each other if they can do "a favour". If you are rich or connected, maybe you can pull strings and the poor victims don't receive the level of justice they deserve.

Epstein did not get a very long sentence. It makes you wonder.

RufusTheSpartacusReindeer · 29/09/2016 14:00

I do think that might be more the case in the USA

That might just be me being patriotic though Grin " that would never happen here" type thing

claig · 29/09/2016 14:03

" that would never happen here"

Yes, but then you look at our Child Abuse Enquiry and the whole Jimmy Savile thing and the Guildford Four and so many other things.

RufusTheSpartacusReindeer · 29/09/2016 14:08

No i do agree with you

People in positions of power Sad

AppleMagic · 29/09/2016 14:12

My guess is that there were very few female lawyers qualified/experienced to handle that sort of case in the state at the time. It is in the prosecutor's interest to make sure the accused has a competent defence to ensure any conviction is secure.

I can also imagine that at that point in her career it would have been difficult for Hillary to turn down that sort of favour/request.

I also expect that back in 1980, Hillary didn't realise that every single word she said to a reporter would be forensically analysed to try and smear her as a rape apologist.

RufusTheSpartacusReindeer · 29/09/2016 14:14

Agree apple

Lack of foresight...thats her problem, and the whole woman thing obvs

RufusTheSpartacusReindeer · 29/09/2016 14:15

That was a joke

claig · 29/09/2016 14:16

What is great about the United States is that it is a lot more open than our system. There is corruption but a lot of it is at least in the open because it is a free society where they can't stop the truth coming out. That is why the whole world knows more about a lot of things that really go on in the States than they know about what goes on in their own countries. That is why we often think that these things only happen in America, but they happen in our system too.
