You did not want them on your land to begin with so why are you annoyed you are not legally allowed to clamp them? Yes you were right to lock them in to teach them a lesson but surely you are now wasting your own time by dragging this on. Open the gate and get on with your life.

@godmum56 yes we've read back - OP could have let them out when they came and visited her DB, she could leave the keys in a designated place, she's made every excuse not to get the car returned to them and seems to take delight out of doing so

(the fact she's posted that on this thread so many times actually puts the owner in very good standing for any legal case he may raise)

Yes he turned up when the OP was out and she told him she would be out. She also told him he could come at 7.30 to collect it and he didn't. Why the fuck should she work around him, especially as there's still not been an apology

she has given him times to arrive when she will be available and he has not turned up....it has also been pointed out that where there are gates or fences, whether or not they are closed when the parking happens then the leagal protection is on the side of the landowner or their agent and not on the side of the vehicle owner.

we seem to be attracting the wannabe lawyers club today

It is a criminal offence to clamp, tow, block-in or immobilise a vehicle without lawful authority on private land under the Protection of Freedoms Act 2012. Lawful authority to immobilise or move a vehicle is restricted to a number of organisation such as the police, DVLA and local authorities.

To commit this offence a person must intend to prevent the owner/driver from moving their vehicle.

Well Op hasn't done any of these things. She simply shut and locked her gate - after telling him that is what she will be doing and gave him time to move his car.
He CHOSE to ignore her and leave it there.
She has also tried to locate the CF and subsequently been in contact with him to arrange a time for him to collect.
He CHOSE to turn up when she said she wouldn't be there to unlock the gate.
He also CHOSE not to turn up when she said she would be there.

He also still hasn't apologised. And also now has hundreds, if not thousands, of women around the world thinking he is a knobhead.

And honstly I think hes damn lucky it's OP's land he chose to park on, because I think there's a fair few of us that would've let the twats tyres down by now.

I've only just come across your threads OP but bloody hell, what an absolute CF!!!!! Firstly for parking there and secondly for messing you around with the collection of his 'beast'.
Your DB sounds very funny but I'm a bit sad that he's had to go home and he'll miss the finale!

Aren't we forgetting that OP did challenge him when he parked up, and he said he'd be back in a few (maybe 5, not sure) minutes to move it? Yet he clearly felt entitled enough to just leave it until HE was ready?!

Would the FC be classed as lawful authority to tow it?

Does that card ever work? If their perceived importance is in how well-known they are - and the fact that they have to ask the question suggests that they aren't that well-known - surely everybody is just going to answer "Not a clue, mate" or "Clearly some sort of arrogant idiot" (or the amazing airport check-in desk assistant who instantly put an announcement on the tannoy to the effect of 'we have a gentleman here who doesn't know who he is - is there a carer in the building whose charge has gone missing?!')

What is the likelihood of the question not yielding an embarrassing and humiliating (for the would-be celeb) reply?

I don't think the CF parker thinks he's lost any dignity at all
You asked him not to park there so he left a note telling you that he couldn't see another convenient spot
He told you when he would come to pick it up, you said that wasn't convenient, he turned up anyway and said to your brother "why would he think there was a problem collecting it"
Today, or tomorrow, or next time he wants to use the car, he will tell you when he's going to turn up again. He won't ask. If you say that time isn't convenient and tell him another time, he will tell you he can't turn up at the time you suggest and arrive when it suits him.
He'll keep doing this until the time he wants to turn up happens to be when you are around. Then he's won.
You are a woman and what is convenient for you is completely irrelevant to him
