Terrified of losing children 😞

Okay here's my story any advice please...
I'm private renting, our landlord is evicting us for 2 reasons...
he's selling (no argument ofcourse I understand he needs/wants to sell)
ground 13- we have deteriorated the condition of the property (this one I'm arguing here's why)
We have lived in the property for 10 years, we have had many structual repairs that needed doing, I approached the landlord who told us that due to us not ventilating property it's caused the damp and mould.
I went and bought dehumidifiers, opened windows etc... cleaned all the mould off however the mould would always return!
I called environmental health round an improvement notice was served to the landlord, he was advised of every repair that himself as a landlord needed to fix!
However this was not followed up as the envirmental health officer at the time passed away.
However the landlord was still aware of the problems and chose to not do them!
I contacted environmental health again recently as the damp,mould and other issues were still not resolving no matter how much we cleaned the mould or using a dehumidifier.
A new improvement notice was served to the landlord.
He has now issued us with a section 8 notice using grounds 1a and 13 :(
Again I'm not arguing that he needs to sell, but ground 13 I find extremely unfair as most of the condtion of this property is down to him!
He is now also increasing our rent :(
Ofcourse there are days we forget to open windows and we don't always keep the home to a high level of cleaning, I have depression and anxiety (have done since my son passed) my partner is autistic our 4 year old is autistic and I have a typical teenager!
If we're found to be intentionally homeless due to ground 13 the council won't help us and we are passed to social services which could mean we lose our children :(

Honestly my main worry is the whole intentionally homeless and social services being involved and taking my children, if I had a plan and knew that they would not take my children then I could relax :( it's honestly having a plan for worst case scenario

You've already been told numerous times on here that they aren't taking your kids.

The only way to ease my anxiety is to have a plan for the worse case scenario :(

Staying temporary with my parents is my safety net however being told social would not agree to this, I have no other plan :( that's when I'm terrified of the children being taken into care as we couldn't provide a home for them

For children to be taken into care, a judge must agree that they are at such a high level of risk at home that only separating them can make them safe. Does that sound like your situation?
I promise you, if I as a social worker attempted to go to court to ask a judge to agree removal on the basis that the parents were not entitled to help with housing, I'd be sent away in shame for wasting their time. I'd be told in no uncertain terms that the local authority simply has to provide them with a place to live and that's that.
In reality no such application would ever be made because to even apply to court a lawyer for the local authority has to give legal advice on whether the threshold is met and they would strongly advise NOT.
Section 20 is VOLUNTARY and cannot be used to remove children against parents consent.

Where are you up to with the council? I assume you're signed up for bidding on social housing?

You're being very passive and, while I appreciate you have hideous anxiety, you need to start acting in the best interests of your children and being proactive to try to resolve the situation.

No she's not. She's not entitled to any help from the council yet as she's not even been served with an eviction notice. She's done all she can at this stage.

It litterly is. There are 1.5 million children in England living in over crowded homes. Do you honestly think that them 1.5 million children have been taken away from the parents?

You have been told a zillion times you won't have made yourself homless. You have very good evidence of that.

I think you won't believe anything until its all happened.

I'm confused I thought op had been served with a section 8 eviction notice?

Section 8 is a notice seeking possession. It's advance notice that the landlord may seek an eviction notice if they don't leave voluntarily. It's not a notice of eviction.

Oh yes. Simlar to section 21. Basically a request to leave. if tenant doesn't they then seek a possession order?

Yes, but she can liaise with the council and go on the housing list. She can start bidding on available properties.

They might not have a duty to house her yet, but it would be pretty passive to just sit there waiting to be evicted in the meantime.

So no, I don't agree that there's nothing she can do.

I'll follow any advice/support given to me from the council or social services I just want my children safe with me :(

What makes me laugh is our landlord has left us with out a covered kitchen floor for 2 weeks!

He's known about the radiator in my daughters room being too small since 2024 and still not changed it!

It depends on the council some don't allow bidding until your actually homless

Keep going. Have you spoken to LA today? If not, can someone phone on your behalf whilst you are with them?

He's referred us to somewhere called "pathway home" no idea what that is

I'm praying they can talk to my landlord for me cause if I try to he becomes so horrible!

He's claiming on the 9th June 2026 this was the first day he has head of any disrepairs, however he has an improvement notice from 2024!

Op your not listening.
you aren’t homeless you’re losing the property you are in. You knew you were going to be evicted so put your energy into looking for a new home and in the meantime stay with your parents.
you have options that don’t involve you being homeless.

you say you have damp, no kitchen. The landlord wants you out, you’d be better off moving out and finding someone else. Then you’d wouldn’t have the stress of this situation.
I say this kindly, you have options, you need to stop worrying and start a plan of moving on and providing a decent stable home for you and your children.

Surely the fact they tried twice to get you out was a hint they wanted rid? Come on op.

You've posted this so much over here, on FB etc and everyone is reassuring you you won't have your kids taken. I know you've been through some awful heartbreaking trauma but you need to listen to the 99% of people trying to reassure you.

I am non stop searching for a private rent, it's really not that simple!

I have the right to stay here until we are legally evicted as I pay rent, the landlord has the responsibility to makesure the home is safe!

Will I take another private property ofc!
