Hi, gone through a seperation from partner and we have toddler together. I moved out of his property and into mine due to relationship failing. This involved a 25 miles and I didn't tell him about it in advance and as a result he's not happy and .is trying to see child as often as possible and pushing for more access. I currently allow him to seems on every weekends for 8 and overnight once a month. He has pushed forward with mediation and prevented me registering child at nursery.stating PR and saying he could care for child meaning moving towards shared care 50/50.As a result we are heading to court and I wanted to know how the court is likely to look at this, I filed a specific issues order and he counted, I will struggle not having son with me and my solicitor told me to claim DV. Thanks

Why do you still think how happy you are with it is a driving factor in how childcare will be awarded? It’s not based on how the mum feels.

The officer seemed to suggest I was not being reasonable and is suggesting compromise to allow son to stay at ex's house for part of the week. I said I was not happy with this.

Well as Cafcass are involved they will now be making their own judgements so frankly you need to be looking at what they and everyone on this thread is saying ... you are not being reasonable.

JohnofWessex · 12/08/2026 07:51

Standing in front of the Judge and throwing a temper tantrum saying 'I wont I wont I wont' isnt going to do you any favours

Waitingforthetimetopass · 12/08/2026 07:56

You have been told repeatedly that what you want is not what is important here. The court won't care. What is best for your DS is what matters.

You’ve been so obstructive for your ex to see your child, that what you’re happy with now doesn’t matter. The services involved will be looking at what is best for your child, not you.

you really aren’t getting it, are you?

Cafcass and thejudge will be looking at the reasons WHY you are not happy with that. From what you have written it seems to be simply because you don't want to/will miss him/want to get rvenge on your ex for leaving you.

They will not care about any of those reasons. They will care that your child is able to have an equal relationship/contact with BOTH parents.

They seem to be proposing a midway point, that will be really difficult for me and ex

How will it be difficult for your ex?

Waitingforthetimetopass · 12/08/2026 13:07

Didn't your ex already offer to move halfway?

purpleme12 · 12/08/2026 13:14

Indeed...

Son will attend nursery but only once a week where I live. He will just want to spend that day with him.

Then save money on childcare and ex has ds?

Or am I missing something?

Why is that such an issue? You are creating unnecessary obstacles and it does not reflect well on you.

I'm not seeing why that's hard for your ex.

Liverpoolxxx · 12/08/2026 20:45

Your son is very lucky to have such a devoted and involved father. I really do not understand why you are trying to cut him out of his life. I hope the court gives him as much contact as they can for the sake of your son.

He's says that he wants shared care, I don't like this at all. I thinks he's trying to take my son away from me

He isn't just your son though, and he isn't a toy who you don't want to share ...he is a human being with 2 loving parents, who deserves the opportunity to develop a strong relationship with both of his parents, and wider family.

The more you write, the more controlling you sound. You don't want whats best for your son, you want whats best for you.

He is an equal parent to you. He wants equal time with his son. Why are you being so cruel to both your child and your ex and trying to block this?

Has he ever done anything to put your child in danger?

teacup35 · 13/08/2026 09:16

Imagine your ex had done this to you.

Imagine that, without telling you, he had moved your son 25 miles away from you.

Imagine only being allowed to see your son for 8 hours each weekend.

Imagine only being able to have your son once a month overnight.

Imagine being threatened that this once a month sleepover might also soon stop. Imagine how it would feel having to face never being able to have your son sleep over for the night. Never doing the bedtime routine. Never getting to hear him squeal with delight at bath bubbles and ducks or feel him snuggle in for a story before bed.

Imagine being told that on the rare occasion you are “allowed” to see your sweet angel, you’re not allowed to take him to see your parents and he cannot get to know his cousins - just because his dad says so.

Imagine, loving and missing your son so much that you change your work schedule in order to make yourself more available, but, despite being willing to drive to see him, your ex denying you this opportunity to spend time together.

Imagine how much it would hurt knowing that strangers were taking care of your son in a nursery setting instead of him spending time with you, despite you being available.

Imagine loving this little boy so very much, having been around him everyday, and then having NO say in his life from here on. Imagine your every suggestion being deliberately ignored.

Imagine how utterly helpless you'd be to improve his life or protect him. You wouldn’t be able to ensure he had the very best medical care because your opinion wouldn’t be asked, you wouldn’t get to ensure he had a wide range of experiences because you wouldn’t get a say in them. You wouldn’t get to feel secure in the knowledge that the nursery setting you’d picked was one both parents felt he was safe in because you wouldn’t have been consulted. You couldn’t influence his diet, bedtime, daily routines.

You are barely offering your baby’s father a hint of being a parent. Just imagine how absolutely soul destroying this would be for you if the shoe was on the other foot and he had done this to you and this was your reality.

It would be so much harder than doing the responsible, mature thing and deciding that even though you will miss him on the nights he stays with his dad, your son is benefiting from the love, time and attention of both of his parents, whom he no doubt loves very much.

You’re a mum. It doesn’t matter how you feel about your ex or how badly he broke your heart. Your feelings in this situation are irrelevant, and your sons are everything. If he’s a good dad, and you’ve given us nothing to indicate that he’s not, then your son deserves to have his dad in his life as much as he sees you.

It will suck not having your son ALL the time. But restricting access because you don’t like the man doesn’t just hurt your ex. It will hurt your son. If you carry on, you’ll have a very emotionally unsettled little boy and huge behaviour issues on your hands.

You’re a mum.

Put your big girl pants on and agree to a plan that allows your son to spend a decent amount of quality time with his dad each week.

Your son deserves the world. Give it to him. Don't half it.
