It depends. Unfortunately, the OP didn't take action against the directors as well as the company. However, it sounds like the new company has a very similar name to the old one. It may therefore be possible to hold the directors liable for the old company's debts.

Well done @Char1997 been cheering you on all the way through. Really hope you do get some compensation for all the hair you've been through. You are now a creditor in the Insolvency, make sure you write to them with the judgement and all the information you have about them starting up another company with a similar name.

just have an email from the insolvency company saying to list myself as a creditor and fill in a form however payout from the liquidation to creditors is not anticipated ☹️

typical isn’t it!

does ANYONE know whether if a company has listed another company as the company that they will continue to operate under whether I am allowed to claim from them?

let me know if you can see the attachment - but the box where at the bottom says “insert name under which the business is to be carried on” and that is the business with only one word different from their business name now.

Unfortunately the cost of Phoenixing (the insolvency practitioner’s Dee has to be paid for eg) means it’s unlikely they’ve done this just over the debt to you. Is there a Glassdoor entry that you can put a strictly factual review on? Or an agency who placed you with them? I suspect it will be difficult to get any money but there are other ways of deriving satisfaction from this. Is there an industry trade magazine? Local paper? Anyone who might report on the tribunal case is likely to also report on what they’ve done to avoid satisfying judgement. Their actions make them highly unreliable to suppliers to their business (including staff) - what’s the best route to get the story to them? Strictly factual with links to the tribunal judgement and company winding up otherwise you risk them having a poke for defamation. Not a hint of anything beyond the pure facts as reported by Independent 3rd oarties

Horrible people at the company, phoenix companies have a huge cost on society and i'm unsure why they're even legal. Especially when they trade the exact same way just under a slightly different name. I wish you the best of luck in securing payment, the most important thing is that you've won.

You need to take legal advice. It depends on the names of the old and new companies but it may be possible to hold the directors liable for the old company's debts.

Very difficult to enforce payment against new company but you need to know you have given it your very best shot after everything you have been through
TBF lots of people would lose their jobs if phoenix companies were illegal

What a bunch of wankers OP, but I check on this thread every now and then and I'm so glad that at the very least you were found in the eyes of law to be the winning party.
