Hi All,
Just an update. We now have a date set for a judicial mediation as she requested one. It still seems to me and my representation that she still hasn’t got any legal advice as her documents and the “evidence” she wants used at the hearing is all very unprofessional and doesn’t really make a whole lot of sense? she’s attempting to put far too much detail into it which ends up making it completely irrelevant.
Anyway, we have the judicial meditation video call on 11th of September. I don’t understand why she requested it as I can’t see her backing down and I’m most definitely not going to. The longer and longer this goes on the more annoyed I become at how badly she treated me and how many excuses she has tried to make up.
Again, I will continue to keep everyone updated! Thank you to everyone that has kept up with this and continuously wishing me good luck! I appreciate you all and hope you are all keeping safe during this horrible time!x

There is a fine line where a little bit of brains isn't enough to let you know how little you know - Dunning-Kruger and all that. Even when people like that lose (usually with a collection of fleas in their ears from judges) it's never their fault. It will be "the judge was biased" or some increasingly fantastic conspiracy theory involving race, sex, illuminati and (if you are very very lucky) an unhinged rant about pollution causing bad judgements in trials as an historic fact. (When you consider the astounding things you do see on YouTube it's hard to believe they mainly pedestrian compared to what isn't posted ...)

What does she think she's playing at by not getting legal advice? If she had, this would have all been sorted long ago.

I know nothing about the processes here. If she doesnt have legal representation, can she appeal the decision (if she loses) and try it all again with legal support? Or is the decision binding?

No. Lack of legal support in the initial hearing is not grounds for an appeal. It is only possible to appeal an employment tribunal decision if it is wrong on a point of law, i.e. the tribunal got the law wrong.

Just to add, getting the law wrong also covers applying the wrong law or not following the right procedures. It is also possible to appeal if the tribunal had no evidence to support its decision or was unfairly biased towards the other party, but successful appeals on these grounds are rare.

Good luck! I was made redundant during maternity leave and had to settle as I couldn’t risk going to court and how drawn out it would be! I’m horrified how long this has taken but am so pleased you have pushed through despite the stress and pressures of the newborn! It’s people like you who pave the way for equal rights! They wouldn’t have withdrawn if you were a man who was having a baby - and I understand it’s different in the short term but in the grand scheme of working maternity leave is such a short time!
Really sending you all the positive vibes I can!
