So it's not really breaking news - in the original CA judgment they chucked out the argument based on a couple of UN conventions, basically on the basis that it had been settled in the Gard case that our best interest law doesn't breach that convention, amongst others. That was covered by the original refusal of permission to appeal, it isn't a new decision.
I'm not too sure how they argue it can go to the Supreme Court in those circumstances, but no doubt we'll find out. Let's hope it's not the subject of another thumbs up video.
