ITS OFFICIAL
The Highest Court in the Land has ruled that Boris Johnson has broken the law.

Parliament is Sovereign.

Despite the calls for his resignation it is highly unlikely he will under the current political climate.

It must be stressed that the judgement was UNAMINOUS and went further than most expected, and took the hardest possible line again the government

The power now lies with the Speakers of the Lords and Commons to decide when Parliament reopens.

It also means that all the bills which were ended by proroguation are now back in play.

Expect a full backlash from the hard right attacking the courts are going full on 'enemies of the people'. This will be NASTY

The strength of this ruling does pretty much rule out another proroguation as the courts are liable to throw it out immediately if they try it on again.

Johnson is in New York. He needs to get on a plane very quickly.

In the current political climate where virtually every news cycle contains a 'first', it's easy to lose sight of just how absolutely wild it is for a prime minister to be publicly recognised as a liar who misled the head of state. It just seems par for the course because it's Boris and we expect him to lie and to behave like a tyrant, but these truly are extraordinary times.

The Justices have just put themselves about our elected government, there will be grave consequences after this verdict. Not just for the Judiciary but for the country as a whole.

If indeed the supreme court is now in the position of king maker in the country, the justices will now need proper public scrutiny. The are no longer considered neutral, and the respect for the Judiciary and for the SC no doubt will be severely damaged in the eyes of the public.

They could not even confirm what law was broken...this is a modern day coup that we are witnessing folks. For all of these celebrating you clearly have no idea what this means.

It won't 'cancel' brexit, it will simply set a very dangerous precedent for the future.

It is common sense that a PM cannot suspend parliament every time it wants to do something (s)he doesn't like. Our system is that a PM only goes to the people every 4/5 years (usually) so the only accountability is to parliament. Take that away and you have a dictatorship. We don't have a written constitution in the UK (generally, except for things like the European Communities Act and the devolution legislation) so we don't have "laws" that can broken, we have precedent and convention.

No law has been broken.

I think we will see Boris Johnson disregarding another remain effort to keep us tethered to the EU and ignore the ruling is my guess.

She isn't able to constitutionally. She has to have utmost faith in the advice her government and Prime Minister give her. Which is why Boris position is untenable. How can she trust him now ?

If the Supreme Court had ruled that the PM can prorogue parliament whenever and for as long as he wants, that would have been better? Huh?

Yes, it will make some no-deal merchants more desperate and more determined. But at least if they want no deal they are going to have do it democratically, with parliamentary oversight.

That’s because the ruling was prorogation unlawful not illegal.

Well, quite. And god help us.

The Court found that there was no law that permitted this action.

Govts can only do what the law gives them the power so to do.

@Lweji - it's not her role to. She is meant to take advice from government. Believing that they would not intentionally break the law.

What will be interesting is her response - she should be asking him to come and see her and explain I would have thought - actually I would have thought that she should be asking him to resign
