Westministenders: Boris Johnson Broke The Law

RedToothBrush · 24/09/2019 11:05

ITS OFFICIAL
The Highest Court in the Land has ruled that Boris Johnson has broken the law.

Parliament is Sovereign.

Despite the calls for his resignation it is highly unlikely he will under the current political climate.

It must be stressed that the judgement was UNAMINOUS and went further than most expected, and took the hardest possible line again the government

The power now lies with the Speakers of the Lords and Commons to decide when Parliament reopens.

It also means that all the bills which were ended by proroguation are now back in play.

Expect a full backlash from the hard right attacking the courts are going full on 'enemies of the people'. This will be NASTY

The strength of this ruling does pretty much rule out another proroguation as the courts are liable to throw it out immediately if they try it on again.

Johnson is in New York. He needs to get on a plane very quickly.

I know if you are in the media one should not criticise the media, but there is something wrong - very wrong - with the ongoing over-reliance of BBC Politics on "Number 10 sources"

That's not a new discovery surely? The media has been over-reliant on being told what to print 'sources' or 'press releases' - for years. It does say 'ongoing' I suppose. Is he trying to correct matters overnight?

JustAnotherPoster00 · 24/09/2019 19:48

I am not, it was obvious that it was going to be a remain stitch up! It was never going to be anything else.

HAHAHAHAHAHAHAHAHAHAHAHA

AutumnCrow · 24/09/2019 19:49

Martin Howe QC ('Lawyers for Britain') on C4 is looking for a PM's resignation knighthood there, maybe, for services to anything other than law

DarkAtEndOfUk · 24/09/2019 19:51

Just, it's obvious some people are going to interpret matters like that. I'm not sure how we can all find some common ground here. There is little public trust going around.

Bearbehind · 24/09/2019 19:51

Wine downed flouncy 😂 thank you

placemats · 24/09/2019 19:52

BCF

That's your reply to me?

You are the very essence of a English person's views on Northern Ireland. And your reply was meant to make me tetchy.

Peace and love though. Is my response.

lljkk · 24/09/2019 19:53

For me, one huge positive out of Brexit (& Trump) is I now understand the Law so much better. What is due process, why do we have it, what function does it serve.

Why shouldn't majoritarianism or "Might makes right" just be the simple way to decide everything. What use is a constitution, convention or traditions?

So now I get it. Law which was such a boring dusty topic to me before, is the most exciting thing ever, of late. Me who always complained bitterly about having to live in the Paperwork age... I'm not moaning so much now.

The thing is.. Parliament can vote to change the constitution. Can vote to give the govt the right to Prorogue at any time, on a whim, no need to even ask the Queen. It's a beautiful system of checks and balances.

pumkinspicetime · 24/09/2019 19:55
  • Take Lord Kerr for example he works in the EU courts until recently when he joined the Supreme Court. Lord Reed, he is another face in the Euro courts. You are getting my drift right?*

This I always find odd.
The EU legal system offers a good range of employment opportunities I would have thought for those lawyers with the right qualifications. Why would people expect lawyers not to make the most of these employment opportunities?
They don't expect those with car assembly skills not to work in a BMW plant do they?
Or in an HR department for a company with headquarters elsewhere.

placemats · 24/09/2019 19:55

BCF let's call it a score draw and call a line under it.

You have no understanding of Northern Irish or Irish politics. I know both.

You have a personal view on whether or not a country should hold a referendum.

A personal view that doesn't accord with mine and shows a lack of understanding.

That's fine.

A precedence has been made.

Should be interesting for future Governments try to do the same.

Then watch the wailing and gnashing of teeth

Please can we have a GE and let people decide who they want in No. 10

mrslaughan · 24/09/2019 19:57

@AutumnCrow - he was doing a really good job at lobbying for the government...... I didn't hear his whole comment, but the one about not wanting parliament to interfere with the delicate negotiations....... which was ironic given previously the had an EU rep on who said v bluntly that the uk gov wanted to give the impression of negotiating, but are actually doing sweet FA

Parker231 · 24/09/2019 19:57

Can’t wait to see what happens next! Today has been a very good day!

TheElementsSong · 24/09/2019 20:02

WTF is wrong with wit now FFS? Confused

merrymouse · 24/09/2019 20:06

Placemats, if the EU referendum had been held along the same lines as the GF referendum, a government would have won an election on a leave manifesto, negotiated a deal with the EU and then held a confirmatory referendum before leaving.

We are in this mess because nobody took responsibility for what would happen if Leave won, including the Leave campaign.

BigChocFrenzy · 24/09/2019 20:16

I object to almost all referendums on principle, at least for the UK (and Germany)
but where they are appropriate, as in the GFA, it is essential that:

the 2 (or more) choices are clearly defined, with feasible plans of action for each
that the voters are given sufficient and truthful information
that there are clear rules and penalties wrt campaign funding and psyops targetting
and that it does not degenerate into a referendum on the govt

Outsomnia · 24/09/2019 20:31

Pare this all back to basics.

What will change? Nothing in my view, back to a bickering Parliament, no vote for Hard Brexit, no vote for anything really. So Johnson will still be PM (unless a VONC is imminent, and even then who knows?).

So plus ca change already.

If any other so called Democratic Country on the planet tried all these stunts there would be a lot of flack. Doesn't seem to be the same fightback here for some reason. Must be the Trump effect.

But looking at Trump today delivering his speech to UN, honestly. I felt so sorry for those in the auditorium who had to sit through that crock of dirt. And his hair reminded me of the top of Donald Duck's head.

Strange times alright.

boujie · 24/09/2019 20:32

God there are a lot of profoundly stupid people on this thread.

The vast majority of you know absolutely nothing about the law, and are claiming this is a some kind of travesty of democracy on the basis of your own cobbled together misunderstandings and half baked conspiracy theories.

There's no faster route to idiocy than opinions about the law in the hands of people too stupid and too uneducated to actually understand them.

PerkingFaintly · 24/09/2019 20:38

mineisawhiskeychaser, and since you are confident the ruling will not stop Brexit, why are you so upset about it?

The proroguing was not Brexit.

The proroguing was something unlawful done by Johnson in the run-up to Brexit. It's been quashed because it was unlawful, and now we can get back to the business of managing to Brexit.

There has indeed been a brazen assault on parliamentary democracy... viz Johnson's action in proroguing. The Supreme Court of the UK has upheld the laws and constitution of the UK. Aren't you pleased about that?

Outsomnia · 24/09/2019 20:39

Don't hold back there now @boujie

GoFiguire · 24/09/2019 20:42

I’m sorry @boujie I don’t understand what you mean. Can you break it down into billet points for me? Lovely, thanks.

boujie · 24/09/2019 20:45

@GoFiguire

Bullet points, is that meant to be?

pumkinspicetime · 24/09/2019 20:47

The vast majority of you know absolutely nothing about the law,

I know very little about any law other than family law and I am not a lawyer.

Happily we have a fully functioning legal system and I am okay with letting them do their job which they have done. Experts have their place.

boujie · 24/09/2019 20:50

Happily we have a fully functioning legal system and I am okay with letting them do their job which they have done. Experts have their place.

Quite right.

borntobequiet · 24/09/2019 20:54

Gosh, fun tonight. “Obnoxious dwarf” my fave insult. Was that from a legally qualified person? Dear me.
Wot larks etc.
