ITS OFFICIAL
The Highest Court in the Land has ruled that Boris Johnson has broken the law.

Parliament is Sovereign.

Despite the calls for his resignation it is highly unlikely he will under the current political climate.

It must be stressed that the judgement was UNAMINOUS and went further than most expected, and took the hardest possible line again the government

The power now lies with the Speakers of the Lords and Commons to decide when Parliament reopens.

It also means that all the bills which were ended by proroguation are now back in play.

Expect a full backlash from the hard right attacking the courts are going full on 'enemies of the people'. This will be NASTY

The strength of this ruling does pretty much rule out another proroguation as the courts are liable to throw it out immediately if they try it on again.

Johnson is in New York. He needs to get on a plane very quickly.

Parliament will now sit again. This is not "a bad thing". That's what parliament should be doing. I'll criticise our MPs for what they do or don't do, but to claim that they shouldn't be meeting tomorrow is absolutely wrong. Anyone who's doing that, just stop

I have stated on previous threads that this is an opportunity for us lawyers to help people understand why this matters. People should know how laws get passed, the difference between prorogation, recess and dissolution. That this country does have a constitution, most of it is actually in writing but not codified in one place. The country has a representative democracy and a constitutional monarchy and relies on the separation of powers.

The more people can understand about this, the better for democracy.

So please don’t come in slinging insults instead be part of the education process.

You must know by now that there isn't the slightest possibility of you educating people who are actively opposed to understanding or accepting your position.

I've seen death threats to those judges today. I'm simply not going to listen to some quasi-ideological bullshit about 'stitch ups' or 'brazen attacks on democracy' like it's a legitimate viewpoint worthy of a respectful debate.

The truth is these statements are stupid, ignorant, unfounded and despicable. Anyone with a bona fide desire to understand the democratic function of the courts could easily do so. If they're on a thread like this making statements about attacks on democracy, you already know they aren't in good faith. This isn't lack of education, it's ideology.

I'm not sure that Whiskey realises that Lord Kerr of Tonaghmore , former Lord Chief Justice of NI, member of the Supreme Court, is not the same person as Lord Kerr of Kinlochard , diplomat and drafter of A50 and as it happens, not a lawyer and not a member of the Supreme Court HmmConfusedGrin

Maybe the posters are ideologues but not everyone reading them is. My view is that there will be people reading these threads who are trying to make sense of the whole situation and the more cogent, clear explanations we can give to counter the “enemies of the people” twittersphere narrative the better.

I am not, it was obvious that it was going to be a remain stitch up! It was never going to be anything else.

Hardly, given that the government case was based squarely on the argument that proroguing had nothing whatsoever to do with Brexit.

The Supreme court is packed full of EU remainers. Take Lord Kerr for example he works in the EU courts until recently when he joined the Supreme Court. Lord Reed, he is another face in the Euro courts.

Well, no, The fact that someone has worked in the past for some country or organisation doesn't automatically change their political views and affiliations. You might as well argue that anyone who has ever had a holiday in the EU must be a remainer.

This is an out and out brazen assault on our democracy, but most of us saw it coming. I would have been more surprised if the result had been anything else.

How can something which stops the PM from preventing our democratically elected Parliament scrutinising the government's actions conceivably be an assault on democracy?

I swear, bot programming round here is getting ever more incompetent.

The government has basically admitted guilt. As amber Rudd rightly pointed out. They need to stop staying the judgement is to frustrate brexit, because it rightly shows that the proroguation was for the reason they have been found guilty of, to stifle parliament in the run up to Oct 31.

What's laughable is the likes of Rees mogg saying they are elitist, since he's worth 150 million and went to eton, where lady hale was brought up working class.

And Geoffrey cox? I'm shocked at him. He's apparantly said no prorogue would be legal in the last fifty years based on this judgement. Eh no Geoffrey. The issue was it was five weeks. Not the normal week. None have been so long as five weeks in the last fifty years.

The EU have already said they would give an extension to avoid a no deal exit but it might be for a much longer period.

So if BJ-Cummings is forced to ask for an extension by law - they can also read the reason for it (eg a GE once the extension is agreed).

But at least now the prorogation never happened Parliament (given that the UK apparently voted for taking back control and "returning" sovereignty to WM not that it ever left ) now has time to make it explicit what it expects from an extension.
