Westministenders: Boris Johnson Broke The Law

ITS OFFICIAL
The Highest Court in the Land has ruled that Boris Johnson has broken the law.

Parliament is Sovereign.

Despite the calls for his resignation it is highly unlikely he will under the current political climate.

It must be stressed that the judgement was UNAMINOUS and went further than most expected, and took the hardest possible line again the government

The power now lies with the Speakers of the Lords and Commons to decide when Parliament reopens.

It also means that all the bills which were ended by proroguation are now back in play.

Expect a full backlash from the hard right attacking the courts are going full on 'enemies of the people'. This will be NASTY

The strength of this ruling does pretty much rule out another proroguation as the courts are liable to throw it out immediately if they try it on again.

Johnson is in New York. He needs to get on a plane very quickly.

Supreme Court = friends of the people, protecting our MPs from being silenced:

"The government argues that the Inner House [Scottish court] could not do that [declare prorogation null] because the prorogation was a “proceeding in parliament” which, under the Bill of Rights of 1688 cannot be impugned or questioned in any court. But it is quite clear that the prorogation is not a proceeding in parliament. It takes place in the House of Lords chamber in the presence of members of both houses, but it is not their decision. It is something which has been imposed upon them from outside. It is not something on which members can speak or vote. It is not the core or essential business of parliament which the Bill of Rights protects. Quite the reverse: it brings that core or essential business to an end."

Heady stuff!

OublietteBravo · 24/09/2019 11:13

It’s my birthday. The SC judgement is just about the best birthday present ever.

MarshaBradyo · 24/09/2019 11:13

Incredible

TheElementsSong · 24/09/2019 11:13

PMK - I am delighted that the SC has upheld the law and the sovereignty of Parliament.

Not expecting any admission of wrongdoing from Brexiteers and their supporters though.

BBC live thread worth a read: www.bbc.co.uk/news/live/uk-politics-49807552

Isn't he in New York atm? With Trump and his gang? Trump's probably saying its fake news and not to worry about it🙄

first time for a smile for a long time...

Thanks RTB

I never go in the Brexit Arms, but what are our Leaver friends saying there? I bet they are mardy, but they are supposedly great ones for 'Sovereignty'.

Very quiet Peregrina. Hope the Brexit Arms Landlady has ordered in some extra barrels of bitter.

JohnnyHallidayVitToujours · 24/09/2019 11:15

Pls can someone remind me what PMK means?

BercowsFlyingFlamingo · 24/09/2019 11:15

@flouncyfanny I love it! I might have to see if there's a scarf that's similar.

@Peregrina all quiet in the brexit arms but I've just been over to share my happiness Grin

DadDadDad · 24/09/2019 11:15

I guess they'll have to cancel the Tory conference, so MPs can get back to work! Grin

Peregrina · 24/09/2019 11:15

Wow, I never knew there were so many ties with flamingo designs on them. Bercow is probably going to be overwhelmed with gifts of the same.

SouthernComforts · 24/09/2019 11:16

What does PMK mean? I've tried Google Blush

LOL - I posted this at 11:09 on the previous thread:

Predictions: "Oh noes, this will show the EU that we're a divided country, which they never would have realised without this terrible development" and "Well this is an irrelevance anyway because it's not going to unite the people." Also "It's the unelected elites crushing the proper People" and "The elected Parliament crushing unelected Dominic Cummings and Bozo."

Anybody care to cross-reference with a post at 11:10 on this thread? Grin

NoWordForFluffy · 24/09/2019 11:16

PMK

I'd anticipate legislating immediately that Parliament should sit all the way through til 31 Oct. As the government's own QCs suggested they should've done before this one. Might as well do as the government's own legal team suggested.

RedToothBrush · 24/09/2019 11:16

Reverse ferret alert

Nigel Farage @Nigel_Farage
The calling of a Queen's Speech and prorogation is the worst political decision ever. Dominic Cummings must go.

PMK = place-marking (sometimes accompanied by pictures of cats, for reasons that are escape me...)

Not quite a bumper sticker, but for one of the most formative judgements regarding our constitution in a generation, it's pretty punchy. You could certainly put it on a bus.
