Need all your help in dealing with an annoying seller who stole my picture......

I just sold a Mamas & Papas cot on eBay last week. However within a couple of days of listing mine someone else listed one and used MY PHOTO.

Result was that various people e-mailed me asking if mine was the real one, or hers, and I suspect some people who might have bid didn't because they were suspicious about two listings with the same picture.

I e-mailed the seller politely and asked her to remove it. She replied with a rude and offensive message basically saying F off and Get a Life.

I reported it to eBay, but of course they haven't done anything about it yet, and her listing finishes tomorrow.

Sooooooooooo I wondered if anyone on here with an eBay account would fancy 'asking the question' of this buyer "Is your picture REALLY of YOUR cot, it's just that I noticed the same one on an earlier listing..."

or soemthing else just to make her realise she can't get away with this.

I feel really sorry for whoever buys it, because she is really mis-representing it by using a stolen picture...

nightowl - no, my listing has now finished, but I'm annoyed that this seller still has her listing up with MY picture.

I can't prove it, but I think having previously had two listings at the same time with the same photo negatively impacted the sale of mine....

P.S. the link is to this person's listing... please ask 'ElmoandTelly' if this is REALLY her cot!!

I have asked the question, but i dont think it will show until she replies to it, so i have also reported it as a fraudulent item! Hope this helps.

Couldn't you contact the bidders on her cot and say it is a picture of yours and so they should be aware that she is either scamming them or perhaps not showing her cot as it's not in as good condition as yours

Even if she replies she doesn't have to make the question and reply viewable in the auction details.

but you have a choice whether or not to show the questions on your listing dont you? i dont think they automatically show.

Perhaps I should create a new listing (for a day) which uses the same photo and says "spot the difference" - and links to my previous item!

Its completely against Ebay guidelines to take another photo- doesn't need to breach in any other way

Keep chasing Ebay but thats definite, DH has been in the same situation

However Ebay invariably wait untilAFTER the auction ends- Dh notified them of someone selling home made non CE checked DJ equipment (illegal I believe- but DH is the expert not me) and they dealt with it AFTER the auction! (And they have allowed him to put up more- grrrrr)

Hi, I emailed the seller to ask if it was her picture as I had seen it listed elsewhere, and she emailed straight back saying yes, would I like to come and view the cot! The cheeky mare!

Yes, she has emailed me back saying that it is her picture!! not posted the replies on the page though!! I think everyone should click on the 'report this item' tab at the bottom!

SoupDragon - yes, I did sell my cot for a reasonable amount, but as I say, I was also aware of people who e-mailed me who were suspicious of there being two listings with the same photo (I would be) so I may have missed out on further bids.

However it was her attitude whicg really p*ssed me off - to be honest if she'd replied saying, "fair cop guv, I'm sorry. I hope you don't mind but I couldn't be bothered to construct mine, I'll add a line to my listing to explain that mine is one like this..." then I probably would have said OK, don't worry, mine is ending soon anyway.

It was the fact she told me to F off and get a life that got my back up!

Thanks to those who've e-mailed/ reported etc... "any more for any more" ?

I've e-mailed her too, saying hers is clearly the copy, as the other one "I was bidding on" was an earlier auction, and why isn't she showing her own one?

Bet she's wondering what's going on now!

Legacy - this is highly annoying when people do this. I had 2 sellers copy a photo I had done, I could see my kitchen floor in the picture! I reported both sellers and they had their listing's removed before they ended.
Don't give up - report her several times until they remove it.
She is breaking copyright laws - this is your photo - not hers!

Why are people so bloody lazy? Why steal someone elses pic which they took time doing? grrr

"F off and get a life" is quite a blokey response, and if you google the name "elmoandtelly" you get links to PS2 gaming sites etc.

I bet it's hubby doing the eBaying and being a lazy git not photographing etc.. ?
