Disgusting neighbour

So my neighbour pees in his garden everyday instead of using his toilet his garden is right Infront of our front door I walked out at 8 in the morning to take my 7year old daughter to breakfast club and got a full view of his penis in his hand because he has gaps in his fence I did kick off on him and let him know my daughter was with me and he did nothing proceeded to carry on peeing so I've reported him to the council and they aren't doing anything about it he's also been reported to the police who still haven't done anything this was October it's now February I've been told by police I need proof but if I was to get a video or picture of him then I am at risk of going on the sex offenders register

In Scotland if someone reported that act and stated that they feel alarm and distress it could fall under sexual offences (2009). Indecent exposure and breach of the peace.

You don't know what the neighbours intent is, - you aren't him - you're just assuming that he's not doing this to alarm people and calling other people emotional and angry when they disagree.

Why would someone choose to pee in a garden when they have an inside toilet?

Block up the gaps in the fence, from your side. It won’t look nice, but it’s better than the sight of his dick. If the council have an issue with you interfering with their property (fence), you can point out it was the only way to safeguard your child. I doubt they’d make a big deal out of it.

I knew someone that always peed in the garden in the day because it took him too long to get to the toilet.

No-one's assuming anything.

No-one knows what his intention is (that's up to a judge to decide) but in order for him to be prosecuted, it would have to be proved that his intention was to cause alarm or distress.

The law is the law no matter how much we may dislike it.

Neither the police or the council have chosen to do so.

Perhaps the OP should get back onto them and ask why.

The council's suggestion was that she moves house (unhelpful) but the OP hasn't stated why they think that's a more appropriate course of action.

I’ve just re-read this post again - if the man didnt turn round when you were peeking thorough the gap in the fence and ‘kicked off on him’ that implies that he had his back to you so how were you able to see his penis?

I think OP means he was facing in her direction, but didn't turn around to stop her looking at his penis through the gap in the fence.

you could always keep a bucket of cold water by the front door. As soon as he starts chuck it over the fence and soak .him then say oops trying to get rid of the urine smell. didnt see you there. Probably wouldn't help the situation but by God it would feel.good.

This isn't a one off incident of someone being caught short on a night out and peeing in a garden on the way home. It's happening daily. From Oct to Feb - in broad daylight

Yeah maybe the OP should get onto the police and ask them why - but speaking as someone who has been a victim of crime on more than one occasion with police doing nothing for me (being stalked online and offline threats, photos of my house going on social media, packages sent to my home ) I can assure you that police don't always get it right and sometimes they can't even be bothered to take a statement from you when you report a crime

Just because the police haven't chosen to deal with this doesn't mean there's no crime been committed - but I'm sure people who know much more about the law than I do will already know that too.

He's probably in full view of other neighbours as well depending on the layout of their homes

Perhaps people might not understand how intimidating this is in real life for the OP to deal with. I would be completely horrified if a male neighbour did that.

No one wants to see someones genitals in broad daylight - this man must know this

At the very least OP I think you have the right to ask the council to sort out the fencing

Id be contacting a local councillor as well. It sounds completely intolerable.

I would be going to the local MP as well. And I would be asking to see someone higher in the police too - an inspector at the very least. There's no reason why someone needs to piss in their garden in broad daylight for months on end.

It's completely unstable behaviour and it's concerning.

For one I wasn't peeking the gaps in our fences are large enough to see through and he was on his back door step pissing out for everyone to see he was told multiple times I had a minor with me and she could see him did he stop no did he turn around no he didn't care knowing full well a little girl was with me

Well if the police and council aren't interested in his disgusting behaviour, it'll never change unfortunately.

All you can probably do is avert your eyes when you walk past.

There doesn't seem to be any other solution unless you can get a few neighbours together who also might be bothered by it, and approach your MP together?

So my husband does pee in the garden every few weeks- we were recommended it by a gardener to deter the foxes and badgers that were tearing up our lawn- but my husband only does it after dark so it is discrete. Your neighbour does sound odd to be doing this so blatantly, even if he did have an innocent reason.

Don't know why anyone would want to piss in a garden to deter foxes. Lovely creatures that have a very tough life. I'm happy to feed them
