To keep an item that I have received a refund for as it was lost?

I ordered some shoes from JD Sports, £40 and they didn't arrive for weeks. I contacted them and they agreed to issue a refund. Just got an update from Evri that the shoes are ready to collect. Ive already got the refund but would like the shoes. AIBU to collect the shoes?
I bought the item from the website as a guest with no account and used my bank card so don't think they can realistically charge me again can they?

She said it would be greedy to keep both of the pair of shoes, so keep just one shoe, and donate the other shoe (of the pair) to charity. It appealed to my silly sense of humour.

This. Have had this happen to me and friends, have contacted companies in the past and they always say keep them,.now I wouldn't even bother asking.

Do you consider yourself a "good" person? Honest? High morals?

I would always at least offer to send stuff back. We were delivered a fibre optic xmas tree this year. Never ordered one. Rang up and asked them to pick it up. But as we had no account, no paperwork, just a random tree, they couldn't work it out and said, merry xmas, keep it.

Same end result as just keeping it. But I can still consider myself morally sound.

I would let them know.

I got a refund for something from albeit a smaller company and then a few days later, it did arrive so I got in touch and they kindly said to keep it.

Each to their own but I personally would have felt uncomfortable not getting in touch.

I think to be honest they won't have the facility to keep track and this sometimes happens and they know this. I'd personally keep it as frankly stuff not arriving is a waste of your time and has caused you hassle to sort.

I onfe had this with some curtains. For some reason they got delivered twice but I'd only paid for them once. I tried to do the right thing. Contacted the company who appeared to understand and send me free a return label. Sent them back and then they refunded me....tried to get in touch and explain that they weren't meant to refund me and was told there was no way they could u refund me and that was the only way they could provide a return. Made no sense to me.

Before they were hacked, I ordered a few things online from M&S. Had an email to say the things weren't in stock anymore and they sent a refund. A week later the items were delivered. I rang customer services and said i wanted to pay for the items. They said it was a glitch in the system and that I should count it as good luck! I couldn't have just taken the times and the refund without trying to rectify the matter because I'm not a thief. You know what you need to do if you're a decent person.

I don't feel particularly bothered by multi million pound retailers with insurance for losses being done out of a £40 item here but when do we start holding those same retailers and their courier companies to the same standards as we are holding individual consumers to? You pay for a service and when they don't uphold their end of it, why is it on the customer to do ALL the running, both in terms of sourcing a refund in the first place and then trying to find out what to do when the original item turns up? I had paid for next day delivery on an item that didn't turn up for over a week so why wasn't I automatically refunded the money I had paid for expedited delivery? If companies want to make it as difficult as possible to contact them, or to fob customers off with stupid AI chats, then on their own head be it. Customers just won't bother.

I don’t think this is theft. No reason I just think that way. They inconvenienced you, probably claimed it back somehow or just wrote it off.

I’m also a terrible procrastinator so if it wasn’t going to benefit me I know there’s not much chance of me returning or making that phone call.

I ordered a card game of Pokémon Uno and instead got posted 2 X vaping kits. I contacted seller and waiting for a prepaid envelope to return them then get my card game. Keeping something not paid for is theft.

I had something similar happen with two of the same cashmere cardigan being posted out by a company when I’d only paid for one. There was an option to return one for a full refund (and then keep the duplicate for free). Just because I could do that, I wouldn’t as it felt immoral. I contacted the company and asked if they wanted me to send back the duplicate, they took a while to come back to me but basically told me to keep it.(it’s a very nice cardie and now the duplicate sits on the back of my chair at work for chilly days.)

I don’t think I could keep the money and the shoes in your situation, I think I’d go with doing nothing until Evri returned the parcel to sender.

Surely JD would have claimed through the delivery company for the loss of the parcel, so the item now belongs to evri? Who have told you the parcels there so 🤷🏻‍♀️ JD couldn't charge you for the item if they had made a claim for the loss to evri?

Of course they could; apart from the fact you have assumed JD is already in the position to claim from Evri (probably too soon), their contract with Evri and who has to compensate who and / or refund if the item later turns up is of no consequence to OP’s contract with JD.

Why? it makes no sense! This is such off thinking. DS provides a service - think nail bar. She charges if cancelled at less than 2 hrs notice, which is very fair. Someone pulled this trick on her on Xmas eve - her busiest day of the year. Booked a £150 service, cancelled at 15 min notice and then "sent the money to charity" and accused her of being greedy. The shop sold the trainers. They refunded. Pay them for the shoes OR return them. It is nothing to do with Charity or giving, if a shop or business wants to donate to a charity they will do this already.

I think it was humour. It made me laugh.

I ordered something from Amazon that was usable but not exactly as advertised.

They refunded and sent me a return label. I packaged it up, sent it off. A few weeks later it was returned by customs to say as it contained a lithium battery it couldn't be sent.

I called Amazon, they sent me a duplicate return label. I called Amazon again, they weren't sure what to do and would call me back, they said maybe I might have to return it to them but would let me know.

A year later, I found it in the hall cupboard, realised Amazon hadn't done anything about it and so it's now in use.

I would do my best to talk to the retailer and work out what to do. Often they will say keep it - or just not do anything as the person in the end of the phone can't work out what to do.

I had this before - the item never arrived so contacted customer services and then two items arrived and they refunded me. So contacted them again to say could they collect the extra one, and how do I pay them back, and they sent another item and another refund! I contacted them again and they said they didn’t understand what I wanted and asked did I want a refund lol. So I gave up. I tried.
