To keep an item that I have received a refund for as it was lost?

I ordered some shoes from JD Sports, £40 and they didn't arrive for weeks. I contacted them and they agreed to issue a refund. Just got an update from Evri that the shoes are ready to collect. Ive already got the refund but would like the shoes. AIBU to collect the shoes?
I bought the item from the website as a guest with no account and used my bank card so don't think they can realistically charge me again can they?

Someone pulled this trick on her on Xmas eve - her busiest day of the year. Booked a £150 service, cancelled at 15 min notice and then "sent the money to charity" and accused her of being greedy. The shop sold the trainers. They refunded. Pay them for the shoes OR return them. It is nothing to do with Charity or giving, if a shop or business wants to donate to a charity they will do this already.

Your DC cannot resell an appointment time with 15 mins notice which is why they are expected to pay.

The trainers can be returned to the store and resold so no one out of pocket.

Items returned will not be re-sold. They simply go to waste. I would bet my house if OP lets JD sports know, they will say just to keep them. They have already written off the loss. The courier will have been expected to re-imburse them for the loss.

Eh? Surely by refunding the money, the contract becomes null and void? Both parties back to their starting position.

And your analogy is irrelevant - you’re equating a retail purchase with providing a service (it’s building a wall, not buying one!)

You seem to be coming at this from the angle of whether you’d get away with it (i.e. whether they could charge you again) rather than what’s the right thing to do. Integrity is about these kinds of choices.

If you still want the shoes then collect them, but also contact JD Sports again and offer to pay. They can’t make you pay the increased price and how to make it all work is their problem to solve, not yours, so most likely they’ll tell you to just keep them anyway - but your conscience will be clear.

I'd collect them and if you want to keep them send an email to customer service explaining they've now turned up. I think they'll likely say keep them.

You bought some shoes. They didn’t arrive in the time they should have. Then JD Sports sent them out anyway / haven’t cancelled the delivery. Their fault, their loss. I would collect the shoes and not think twice about it. The cost to JD Sports of you contacting them about returning would likely be more anyway, they have to take your call, find your order, organise return postage, process the return their end etc etc.

You refunded me as the item took too long but now if has arrived.

I'd do this before I collected so thet I'm not going out of my way if they want them back

They may say whatever keep it or they may say don't collect and they will arrange it to go back to them. But at least you have been honest

Absolute rubbish. ‘ Dishonestly appropriating property with the intention of permanently the owner of it’ is theft. The shoes belong to the retailer because they have refund the OP for the value of them.

Would you go into the shop, hide the trainers under your coat and walk out without paying because this is the equivalent of that. Money Saving Expert has articles on this.

It’s not being a ‘martyr’ to not be a thief. I can only assume the OP does not work in a job where integrity is important because if my employer found out I did this I’d be sacked.

I ordered a fairly expensive dressing gown for my mum which ( I thought) didn’t arrive.
The retailer was very apologetic and sent a replacement immediately.
Some weeks later I looked in mum’s wardrobe to see 2 identical dressing gowns.
She was in a care home presumably they get lots of deliveries.
Anyhoo I contacted the retailer and offered to pay which they accepted.
I couldn’t have it on my conscience .

Just send an email? They'll get it tomorrow or whatever and then op will know what to do

Its not hard to email customer services with order number and explain.

If op doesn't collect, she can't be held responsible for the cost of sending them back if the company does want the trainers back. If they say keep them, then she can go collect the parcel.

Yeah, that’s how I’d see it. The shoes weren’t supplied as ordered. The seller accepts that and has refunded.

Now that the shoes have turned up, that’s the seller’s loss caused by late delivery.

Flipping heck OP, come on, you tell them what you told us OP:

I ordered and paid for the item
It failed to turn up
You issued a refund
They have since turned up, and I want to try them on
Retailer, how should we deal with this?

It's called covering your arse OP, also known as honesty, transparency, etc.

Alternatively, you could keep them and take your chances, bit harder to back pedal with honest intentions if they put you on the spot, though. You may just come across as underhanded and sneaky at best, or maybe we'll just call it dishonest.

Wont be the crime of the century, but it depends on what standards you have and are happy to live by.

If you still want the shoes, go and collect them. Email them to say that's what you've done. I bet their system can't deal with it so they'll say keep them anyway.

Some people on MN are incredibly sanctimonious about this topic OP. The reality is that most large companies allow for the costs of their own errors and don't want to waste time correcting them.

I worked for a call centre for an online retailer. Customers could order extra things for electrical appliances we sold with us, not online. Examples include vacuum cleaner attachments, breadmaker tins.

If a customer rang to say that they have not received their order, we offered a free replacement or refund. Often customers rang back a week or so after the refund saying they have received the order and waited to pay. Our system didn’t have the facility to charge customers like this. So got them free.

Tempting, but nah, believe in being honest. You could see if like the shoes then contact the company, offer back the money? They may even just say keep the shoes anyway for being honest, I had that twice being in the same situation.
