Fine. According to the ruling, if a woman really does pass that convincingly as a man, she can legally be excluded from a single sex space. That's because she will be perceived as a man and cause the same distress, alarm and self exclusion as if she really were one. It's also an acceptable cost in maintaining single sex spaces. In all safeguards, you sometimes keep out the wrong person, but that's how it has to be to keep out the right people.
That does present a problem for the TM but that's their problem and their doctors and surgeons should ensure they are fully informed.
However, a woman needs to do much, much, much more than have short hair and no makeup to actually pass as a man.
