To report to the police for obtaining CCTV in a swimming pool

So my partner goes to a gym where a girl also goes. They have a partner who is convinced that they’re having some sort of an affair and despises my partner. My partner and this girl are on friendly terms but he has a number of friends at this gym.

He’s always given my partner dirty looks and blocked him on instagram. Very petty things but it’s recently come to light that he’s obtained cctv, it’s then having a conversation in the swimming pool. How he’s got this I have no clue but it seems insane to me? Is this something that we can report? This seems like a breach on of privacy?

The swimming pool should not hand out CCTV no.

Are you sure he actually has it?

I’d advise your husband to cease his friendship with this woman (sounds like a lot of hassle) and report the husband to the police for harassment. Keep a log of any contact.

I cannot see why you would bother to continue a friendship with some random you met at the gym, if this was happening.

It wouldn’t be a police issue I don’t think more a data controller reporting issue if they have given out footage, however the women herself could have requested the footage under a SAR and she would be allowed it.

It’s not a police matter but I’d report it to the gym manager or report the gym to the Infrmation Commission for breaching GDPR

It would be a gdpr breach if they just handed footage to a random.

Though many local shops seem to hand over footage of accidents outside and of thief’s in their shops and nothings ever said about it.

He’s sent it to me, to incriminate my partner bit is not very damming evidence. There’s just 3 of them having a laugh for about a minute

Is it cctv footage or someone recording on their phone? Time stamps etc.

Maybe he’s just saying he has cctv?
I think firstly he needs to have a discussion with the gym manager, maybe area manager if it’s a chain.

I also wonder why, for the amount of grief going on, he doesn’t just keep his distance tbh, or why doesn’t she? I know they shouldn’t have to on principle, but if they aren’t actually friends, and just know each other at the gym, keep it to a quick nod or hello, do your workout and get on with your life.
Maybe he like the drama?

I would ask to see footage and find out how he got it - take it from there

so the recording is from about 18 months ago. It’s a recording of the CCTV that he’s taken on his phone. My partner subsequently went through about 4 tires within the space of a couple of months at the same time. We thought someone was poking his tires but that’s a different story. They do not have ‘regular’ communication

Your partner could ask the gym why the man was given the footage.

Tbh though, if I were him, I'd tell gym girl that her boyfriend's a nut and it's best if they don't speak any more because he doesn't want to be dragged any more into whatever shit they've got going on that would lead her boyfriend to get cctv footage of them talking and send it to his partner.

It's not really a police matter but you should report it as a data protection breach.

People are entitled to demand a copy of CCTV footage featuring them but the swimming pool needs to edit it so that other users can't be identified. The circumstances you describe would be a serious breach of the required standards and it's likely a heavy fine would be levied on the entity controlling the CCTV.

Your partner needs to stay away from it and this woman needs to be questioning her relationship if this man is capable of this , he sounds a bit unhinged .

But essentially I’d guess he’s having it off with this girl; the op has serious suspicions; the op and the boyfriend have already been in contact hence why he has the OP’s number; and the op had asked her partner to stay away from the girl but he remains very much in contact
