To expect compensation from holiday company

Changing a few details and being vague to remain unidentifiable. My partner and I recently had a 2 week holiday somewhere warm to celebrate a birthday and anniversary. On day 2 of the holiday my husband was injured as a result of something breaking (that shouldn't have). He grazed his forearm from fingertip to elbow, slight grazing to the leg and suffered a bump to the head. He received first aid from a hotel employee including an ice pack for his head. The next few days were a write off until his wounds healed and he didn't feel so sore. I have pictures of it all and the bruises He still had 6 days later. It was reported at the time and the travel company representatives checked in on him.
On our return I submitted the photos and a report of the incident to the travel company for some kind of apology / compensation, but they have told us that is not possible as we did not get a medical report.
This seems so unfair and we are wondering if we should take it further. What are our chances? Anyone have any experience of this.

This was my first thought, when you are on blood thinners, you do bleed more easily, I would definitely have gone to hospital to get checked out. Unfortunately there’s nothing anyone will do without a medical report, even claiming on insurance would require a report.

An apology would have been very nice but total silence from the hotel.

You might have been able to get something out of the hotel if you had complained to them when you were actually there, but waiting until you got home to complain to the travel company is neither of those things.

And by something I'm thinking like a bottle of wine or a free dessert etc. If those scratches had happened to my child on holiday I'd probably have been happy if they gave them a Calippo

His hand does look bruised and swollen, but the picture's a bit dark. It sounds rather traumatic in any case.

Top marks for those legs though OP, 70 you say?

I got worse cuts and grazes than that on my arm and knee from falling during Park Run a few months ago. Flew to Canada the next day for a 2 week holiday 😁

Contact your travel insurance. That’s what they are there for.

Have you pictures of the broken floor? Did it get logged in the accident book (if they had one?).

I wasn't trying to drip feed, but someone asked about underlying health conditions. He is 70, had 2 strokes 18 months ago and is on blood thinners. It wasn't a chair. It was the floor!!!

If you were concerned due to the head injury and blood thinners at the time, why didn't you ask the hotel to call a GP or direct you the nearest clinic to get him checked over???

Insurance won't do anything without medical report
There was no medical report as they weren't concerned enough to go to doc so I'm not really sure what the OP expects

You were worried about the head injury on blood thinners and after previous stroke, but clearly were not worried enough. DH was deemed able to make the decision for himself that he needed no further care. He must have still had all his wits about him and showed no sign of serious head injury.

Yes I have photos of the floor.
This is the interesting bit. Following our stay we received the standard questionnaire from the hotel asking about our stay. I commented that I was disappointed that they did not check up on my partner following his accident and they replied that they were not aware of the incident. Don't know how the floor was repaired 6 days later if they were unaware.

You should go and watch a bmx race sometime those kids get injured 10x worse than that. They get bandaged up and get back on their bike for the next race without 30 mins.

I suspect it didn’t really ruin the next 6 days and you are in fact just trying to get some money back.

I think you have to separate the issues.

Floor breaking: was this in your room or a communal area- did you have a worse holiday as a result of any inconvenience directly related to the floor (eg having to move out of a bedroom)?

graze: in all honesty it doesn’t look bad enough to have much chance for compensation here. The elbow but could have been dressed fairly easily to allow for you to get on with the holiday.

bump to the head/impact on blood thinners: I think you might have actually had grounds here if you’d sought medical attention. The fact that you didn’t then becomes hearsay really.

I don't think you'll get anything if he didn't even see a doctor. That suggests it wasn't remotely serious.

a) that's a series of small grazes OP, stop being such a drama queen; and
b) if he didn't want to see a doctor then even he didn't think it was that serious.

I can't believe that anyone would 'take 6 days to heal' for such a minor injury.

Head injury + blood thinners normally means you need medical review - he would probably have been offered a CT scan in the UK.

Unfortunately you did choose not to seek medical attention and I do think it is fair that they would expect if the injuries were such that they required medical attention that you would be responsible enough to go and acquire it.

Holiday companies get lots of spurious claims and I think in this case you cannot expect compensation when you failed to seek a medical review.
It would be the case in the UK too.

Yup. Head injury on blood thinners and had to stay in the room for 6 days worth of holiday…. But not bad enough to get a medical report or even have a doctor check for concussion. Rightio!

Your 70 year old disabled husband fell through a floor and you didn't call an ambulance ? That's negligence on your part tbh

We got nothing from the hotel. They didn't even check up on him. It was the holiday company that checked up on him. I know it looks like a simple graze but when you are on blood thinners AND you have a head injury it is very worrying.
OK we may be out of order wanting compensation but not even a £10 voucher off our next holiday.
And yes we did have travel insurance, cost a lot due to his medical history. But nothing to claim there as he didn't want to see a doctor.

I would honestly find £10 more of an insult as it suggests he’s fine and they just want to keep you quiet.

They may not have been aware of the incident, but presumably if the board was broken someone in the intervening six days (most likely a staff member) noticed and reported it?

I've no doubt that the mishap gave you both a fright, and he was probably sore and grumpy after it.

However, I'm baffled as to why you didn't immediately seek medical attention since he is post stroke and taking anticoagulants. You both must have known the dangers of injuries causing bleeding when taking them.

I hope he's better now. I'd leave it and move on. Be thankful he didn't have a brain bleed is all I can say at this point.
