I can’t believe we have a part 3 🤣 this has provided some lighthearted entertainment at a time where I’m feeling really let down by someone I considered a good friend. So thank you! I have posted an update on thread 2, will post it here also.

I have sent the following text message ‘Having reflected on what you have said, how the airwrap was lost/broken or otherwise is irrelevant. I considered asking you for pictures of the broken airwrap or asking to speak to your sister to ask her what happened but it will get us nowhere. All that matters is I am down a Dyson airwrap and I want a new replacement. You’ll need to either transfer me the £399 tonight to pay for this or purchase it yourself from boots and send me the email receipt this evening. You can then sort out with your sister whether she is going to contribute to the cost of it. We can then put this behind us’

I have no interest in maintaining the friendship after this for obvious reasons. I am worried that she’s seen the thread (how can she not have 🤣) and knows this fine well so will have no intention of replacing it sadly.

I don’t think I’ll ever get the truth (was there even a wedding at this rate?! 🤣) all that matters to me now is getting a replacement airwrap!!!!

To go to the small claims court will take months/years to get any result, plus a £50 issue fee and £59 hearing fee. Plus time off work to attend a trial if it gets to a hearing (witness expenses are max £95). If it can be resolved any other way - such as by asking those who the friend has implicated wtf is going on - then that would be preferable

OP has a number of years to bring any claim so there is no need to dive down that route after 1 week.

Those fees will be paid for by the other party as it’s clear whose at fault. I think strike while the iron is hot and send the notification letter required now. Hopefully the threat of the shame of having your wages garnished will speed things up, if not, better to get cracking now rather than wait longer.

I think talking to the sister is fine. At the end of the day CF said she lent it her and she broke it. You need that back so you could see if it needs repairing. If CF herself is not responding anymore, its really your only option by going direct. I do think small claims is your next step unfortunately

Just wait until you do a £2600 tile job only to find out the next day the owners walk on the newly layed tile. When confronted I was told it was the way I left it and it wasn't their responsibility to pay for my mistakes.
I've never been paid and don't bother with court. That will just give u a judgement not payment. Best of luck yo you.

OP: My thoughts are that you should now leave it.

I’m not a lawyer, but I believe the 'contract' will be with the person you lent it to. Chasing the sister would only complicate things, and possibly indicate that you no longer require recompense from the original lendee and have accepted transfer of the contractual obligation to a third party. Very dangerous.

And under no circumstances meet anyone, or go to anyone's house. You may be accused of intimidation.

It's very simple: Person A (you) lent an item to Person B (the alleged CF), and you can prove you did so. It was clear that you expected it back; it was not a gift, wedding or otherwise.

Person B, despite multiple reasonable requests, has not returned the item.

If it were me, I would buy myself a new one now, then commence a small claim for the financial loss.

Waiting for a small claims order for her to go out and buy you one would be absurd. It will take months, and then you have to chase for her to actually buy the right thing.

Keep it simple, and remove any possibility of your receiving second hand junk. A straight financial claim, evidenced by a dated receipt, plus costs. It’s really easy. If she defaults on a financial award, send in bailiffs.

Your advice is spot on. CF is the person OP is in dispute with and she should not bother trying to contact CF's DS or DH - they won't do anything to help her and certainly nothing which could cause more trouble for CF.

@Toquerville is right when they say you could get a judgment (CCJ) but still not get the money owed - this can happen if the respondent has no job, little money and no assets. This is part of the assessment you make before filing a claim which, of course, is easier if you know the person and their financial circumstances (as OP does of CF).

Sorry for the lack of replies, it’s been a non stop day at work! I’m sure you won’t be surprised to hear that I haven’t heard from my friend.

I asked a mutual friend for her sisters number (did not tell mutual friend about the airwrap saga) and tried calling her on my way home from work. She didn’t answer, I wonder if it’s because it was a number she didn’t recognise. I left a voicemail and followed it up with a text message asking her to call me. Whether or not this was the right thing to do who knows!

I must sit down tonight and properly look in to the small claims process, it seems this may be my only shot at getting something back now

CF finally claimed that she'd loaned it to her sister and that her sister had broken it by spilling wine on it, as I recall.

I would be annoyed at the AW being damaged but accidents happen, what would annoy and upset me most would be the lies and disrespect from someone who is supposed to be a friend. OP I hope you get your money back or a new air wrap
