Is my sisters accident my fault?

—my sister fell over my child’s toy in my garden and broke her nose/hurt her front teeth.
-I called an ambulance, cared for her, hubby sent text afterwards, I said I’m sorry this happened.
-after I was saying how awful, I googled what happens when you bang your teeth. Kept saying it’s awful.
-she doesn’t remember me saying sorry but I guess she was in shock.
-we have a difficult relationship but have been getting on well recently.
-she phoned me to say if it was at a restaurant then she would sue them, implying that I should give her some compensation. (Because my mum said “she just wants an apology” and she said in the background “no I don’t, I want more”)
-I said are you joking and laughed. She look offence.she said speak to my lawyers (she doesn’t have lawyers so I did t know how to take this).—I was really upset. Accused her of asking me for money to fund her extravagant lifestyle.
-my mum was on speaker during the phone too. She said sister just wanted an apology.
-seems like she wanted money and because I got upset she was blaming me, changed it to wanting an apology. She said she didn’t think I was sorry it happened. I feel I’ve been very compassionate. Not sure what else I could’ve done?
-need outside opinions as I have no clue whether it’s me or her that’s in the wrong. I’ve apologised to her but she doesn’t care how hurt I feel about the phone call, especially when I feel like I’ve supported her.

Tell her that, in the words of Judge Judy, it was "an accident" and not an "on purpose". You didn't even need to apologise, you did nothing wrong as you didn't put the toy there deliberately to trip her. You've sympathised with her as regards her injury. End of story.

Its obviously an unfortunate accident. I'd apologise again tell her you cared for her etc and leave it at that. If she pushes it she'll look stupid and petty.

Even private residents have a duty of care do no I’m not being ridiculous. She could go to a No Win No Fee solicitor and they would see if you could be proved to be negligent

Sorry if this is a dick comment but did you really call an ambulance for a broken nose and busted teeth? And they came out quickly?
that surprises me!

you’re definitely not liable for any damages, let her talk to ‘her lawyers’ lol she’ll just waste her money.

separately, why on earth did you phone for an ambulance? She wasn’t at deaths door and needed a paramedic. I’m guessing someone could have driven her to the hospital or a taxi.

Your sister is being unreasonable about wanting compensation - these things happen and she should have been more careful.

Did she fall into/onto something?

I once tripped up a kerb whilst pushing a bike & only grazed my knee!

I knocked my teeth out tripping over something at someone's house. My front four teeth. It cost me 5k to get them sorted.

5k that I paid as it was no one's fault I tripped (and definitely no one's fault that I apparently don't put my hands out to break my fall).

I’m more pissed off you called an ambulance! For what?? She needed an emergency dentist not an ambulance.

On your other point no it’s not your fault. I’ve tripped over DD’s toys countless times, my fault for not looking where I was going. She’s being an idiot.

Its because of people like you OP why i waited 2 hours for an ambulance with my oxygen sats at 80 and my heart rate at 149 and severe chest pain

(No taxis in my area in the middle of the night)

I'd have apologised just out of good manners but I wouldn't actually feel I had anything to apologise for. She tripped over a toy at a house where children live. She should have been more vigilant, you are not to blame at all.

Yea she's being ridiculous. Too late now but I would have got her flowers or made a gesture to say sorry before she got upset- just to be kind not because it was your fault specifically

I’m really clumsy, I would end up mega rich if I could sue every time that I tripped.

Tell her to sue your dc, it was their toys not yours.

Do you not have Public Liability Insurance on your home insurance?
If she has had a hospital admission and has hospital notes/evidence of pain/shock then claim on that.

There was a lot of blood pouring out everywhere but whilst on the phone it stopped so she went to minor injuries in the car with my mum

I would still send flowers and wish her well.

Definitely not, sending flowers could be deemed that you accept you were in the wrong, which you’re not.
Perhaps you should send her a bill for replacement or repair, for any damage to the toy, as she was careless and not looking where she was going. Then I would go NC, no family is better than family like her (or your dm).
