Is my sisters accident my fault?

—my sister fell over my child’s toy in my garden and broke her nose/hurt her front teeth.
-I called an ambulance, cared for her, hubby sent text afterwards, I said I’m sorry this happened.
-after I was saying how awful, I googled what happens when you bang your teeth. Kept saying it’s awful.
-she doesn’t remember me saying sorry but I guess she was in shock.
-we have a difficult relationship but have been getting on well recently.
-she phoned me to say if it was at a restaurant then she would sue them, implying that I should give her some compensation. (Because my mum said “she just wants an apology” and she said in the background “no I don’t, I want more”)
-I said are you joking and laughed. She look offence.she said speak to my lawyers (she doesn’t have lawyers so I did t know how to take this).—I was really upset. Accused her of asking me for money to fund her extravagant lifestyle.
-my mum was on speaker during the phone too. She said sister just wanted an apology.
-seems like she wanted money and because I got upset she was blaming me, changed it to wanting an apology. She said she didn’t think I was sorry it happened. I feel I’ve been very compassionate. Not sure what else I could’ve done?
-need outside opinions as I have no clue whether it’s me or her that’s in the wrong. I’ve apologised to her but she doesn’t care how hurt I feel about the phone call, especially when I feel like I’ve supported her.

Look Im not saying where there's an accident there's a claim, but the truth is, if someone is hurt badly, on your premises , through your negligence , enough that they cant work, need surgery etc, then yes they have to claim. This is why most people pay for insurance

Ive posted above on this thread, it happened to me. I never even found a solicitor for 4 months after said accident, because I didnt realise at the time how badly injured I was, I lost my job, spent 4 months on the sofa and bed, and then months of physio and a change of job , earning less.

And seriously I think a broken nose and damaged teeth needs a bit or treatment not offered on the NHS so why should she not put a claim in? Would YOU walk around with an obviously broken nose and ugly teeth?

But what on earth is negligent about there being toys out in a home a child lives in, in an appropriate place for toys to be, which the garden, in summer, very much is?

If OP were hiding fucking bear traps out there... sure, that would be inappropriate, not what anyone would expect and failure to warn 'hey Sis, watch out for the bear traps' would be negligence.

You can accept that OP has a duty of care to people visiting her home... however a 'reasonable person' should expect there to be toys and thus, trip hazards, in and around a home with children in, including in the garden, in summer when kids play out.

Therefore the reasonable person would keep a better eye out for where they were stepping, and is responsible for their own safety.

Your sister is an adult and should know to watch where she steps, especially in (the garden of) a house where a young child lives. She can't expect you to walk with her every step and clean away anything she could stumble over. In a restaurant is a different situation, toys don't belong on the floor there - but still I would strongly recommend to check where you walk wherever you go, in a house, the streets, a restaurant'.....

Def not your fault but did you really need to call an ambulance? Could she not have taken herself to A&E? I think she owes the NHS and you an apology! An ambulance for a broken nose is such a waste of time and resources. She needs to stop being so precious!

I can’t believe I’m reading this! Your SIL is completely unreasonable and your DM is enabling this batshit behaviour! If I were you I would be very reluctant to have her around again as you might find she tries to spite you by creating other so-called unreasonable situation which she feels she can sue you for! I’m thinking just as revenge. Obviously I’m being very far-fetched here but I would be very nervous about her intentions given her reaction to this situation which was clearly her fault and because you are not pandering to her whims she may feel she wants to take revenge! I wish you all the best.

I'm back to the ambulance. Did you ring an ambulance because she was bleeding so much and you thought she'd pass out? I don't know why you didn't put her in a car immediately? Instead of ringing your mom or an ambulance. Do you have a car? If I'd fallen and was in pain in my brothers house, I'd be hoping that he'd get me to the hospital or clinic or wherever as quickly as possible.

The fact you accused her of asking for money to fund her extravagant lifestyle makes me think there's a pair of you in it.

It was difficult for me to give her first aid all I could do was ring people as I was alone with 2 babies and the one she was playing with was also covered in blood and screaming it was only later I realised it was my sisters blood she was covered in. Anyway the ambulance didn’t need to come my mum took her to minor injuries as I called her as well. It is hard as she is a very dramatic person if it was my husband who fell and broke his nose I don’t think there would have been as much panic all round.

I still think there's two of you in it. You're being a bit dramatic that having two babies means you're rendered useless in an emergency. It mustn't have been much later that you realised it was your sisters blood or you'd have been getting an ambulance for your baby too. You think she's dramatic in the immediate aftermath of breaking her nose and banging her teeth and she probably thinks you're dramatic for having two babies.

If I sued every time I’ve had an accident I would be rich! Unfortunately I’m just really clumsy and have no one to blame but myself.

I think you’ve done more than enough for your sister but maybe if you ask her exactly what it is she wants you to apologise for then decide what to do it would at least keep the peace. Good luck though, she sounds a total nightmare!

Accidents happen you were there you looked after her rang an ambulance. She wants an extravagant lifestyle she gets a job to pay for it.

For anyone who is interested it is now resolved. I rang home insurance as some of you suggested and they said they wouldn’t be able to do anything. They advised she ring citizens advice but my mum said she’s going to encourage her to forget about it. I sent some chocolates and a card as a goodwill gesture.

Maybe meet her at the front door and do a risk assessment next time she visits... Or meet somewhere else.. Tell her you can't guarantee her safety....

Surely you sue in situations where you have damaged yourself due to an unexpected and unwarned-of obstruction; a toy on the floor of a house where children live is not one of these.

Have you read OPs post? She was there with the kids, accident happened, ambulance called. Mum arrived, ambulance cancelled, mum took daughter to the hospital.

Stop fucking banging on about the ambulance, it wasn't used, at least read OPs updates

Just give her a verbal apology like she asked.

You also sound jealous saying she wants you to fund her extravagant lifestyle.

She broke her nose because you don’t keep your home tidy. Even if she’s had it re-set in the hospital she may require plastic surgery later on. Take a look at Cameron Diaz’s nose and how different her face looked after her nose broke.

You also don’t say what damage was done to her teeth. If the teeth were damaged at the root it’s possible the entire tooth could die and turn brown/grey. She may need expensive surgery to cap them. You’ve been deliberately vague on the teeth situation.

Just apologise.

@Idontjetwashthefucker I'm wondering why at no point did the op consider taking her herself. She's going on about the baby crying but she was able to make 3 phone calls over the baby crying. So I'm wondering why she didn't say to her sister come on let's go. Instead of ringing around for a lift.

It might be a good idea to transfer to another insurance company or revise your current one.

There is liability on my house insurance. There is also legal fees up to £50K. the cost might be high, but so is my peace of mind.
