Gym response to being flashed in ladies changing room?

A male entered the female changing room and flashed at me late last Saturday night. I was alone and naked. I reported to the gym who have said that they checked the cameras three times and can’t see a male entering. It must be on there somewhere it happened, I’m raging about it and the response. I want him identified so I can report to police.

I didn't get the police involved, luckily my boyfriend lived next road, i went back there, gave description, boyfriend and his friend followed him...got out car and steel toe capped boot kicked him in the teeth whilst on his knees apologizing...i was happy with that!!.
If i didn't have that option i would have reported it to police

I can't believe you think this is OK and are telling your little story like it's a flex.

You were sexually assaulted by a criminal. You and your boyfriend (and his knuckle dragging mate who was only too glad to lend his fists) are also criminals. They could have murdered him, and it very well could have been the wrong person. You left your kid with someone and identified this guy from the back seat of a car while you had two neanderthals no doubt whipping themselves into a frenzy at the prospect of getting to kick someone's head in? Yeah there's no room for error there 🙄

I hope your partner and his friend have been held to account at some point over their lives. There's no chance this was the only time they've committed assault. Violent men are violent men.

This was my first thought.

I'd contact the police and let them investigate. At the end of the day, this DID happen so it's not possible for it to not be on the CCTV assuming that they have adequate coverage. This man was not a phantom, so there's a simple explanation like covering up for a staff member, not wanting the CCTV examined for some other reason, invalidating insurance by not having adequate CCTV and not wanting that to be discovered, not bothering to check it at all etc. Let the police sort it.

As others have said, go to the police.

My suspicion is that it is a member of staff, but it is for the police to prove if that is the case.

I worked in a large gym, this sort of thing was not uncommon.
Literally every week I would deal with one man in the female change. They all accidentally wandered in. Never ever did a woman accidentally go into the men's side.
The whole staff men and women at my gym would have believed you without cctv. We were all sick of dealing with the dreadful men and we were angry that the women and girls couldn't use the gym in peace.
Apart from the police you should make a complaint about how the gym have handled this.

I have no care... the right thing was done. 32 years ago..would have took ages for police to come out..not risking him doing to others. Hopefully he would have stopped eh.. with his toothless mouth. Oh btw...my daughter stayed in with his friends girlfriend whilst i sat in the back car..gave i.d...spotted him as i couldn't see from back seat...we stopped..i properly identified him.. and he got less than what he deserved. So don't even go there with me

Inform them that as per U.K. Data Protection law and specifically your right to access, you are officially making a Subject Access Request for footage covering the entrance to the changing room between [start and end time] on [date].

A subject access request would enable you to get footage of yourself, not of other people.

You're right, but putting the request in will mean someone in a central function will view the CCTV and pull it from the system . That takes it out of the hands of the local staff members and preserves the footage which is important as the police may move so slow the footage is deleted before they even ask for it.

I think you should:

  • go to the police and quickly before they erase CCTV footage
  • make a complaint to the gym management for how this has been handled so far. If it is a chain also complain the gym head office.

The police can access the CCTV.

Also I would think that this guy might have done this before and/or might be going around gyms/swimming pools in the area to play out his sick fetish and will do it again and even escalate if not caught.

The police might already have similar reports from other places.

Agreed - a subject access request will get the info in front of David Lloyd’s legal team who should be able to take it from there.

(It’s also very time consuming and expensive to deal with these requests so very useful if you want to kick up a fuss!!)

You don't know it "got the job done" and once they got to the man they could have called the police and held him in "citizens arrest" till police arrived to properly arrest him, and as PP said offence put on record. This would have been miles more helpful.

Also wondering if her 1 year old witnessed the boyfriend's violent attack, that would have been more traumatizing than the flashing itself.

Opinions are one thing, using those opinions to then go a kick someone’s teeth in are quite another. One is not illegal, the other is an illegal violent assault.

If you can’t see how the two are different then you are as bad (stupid) as the person in question.

If all of us thought the way that you both do, then we’d be living in complete bedlam, with every person meting out personal justice however they please. In fact, we did live that way once, a very long time ago. Then someone had the good idea of bringing in some mutually agreed law and order.

This is worrying and at the least they need to put new cameras which are at a different angle in. I was reading about Flip Out in the papers yesterday- 11 people broke their backs and it was minimised.

That man has got away with flashing. Do you think he is going to stop now or is he going to escalate? How many other women are going to have to go through this before anything is done. It is important to have a procedure and manage it. To take things seriously because of the danger of reputational damage, not to mention the victims.

If this continues, women will leave the gym in droves, it will get a terrible reputation not to mention lawsuits.

They need to take robust action now, reassure you and keep you informed.

No it wouldn’t.

if she made a dsar the request would go to the privacy team and / or a lawyer.

the person dealing with it WOULD HAVE to look at all the CCTV from the night in question properly. As a legal professional, if you watched CCTV which showed someone being flashed, you would be obliged to do something about it.

The OP could also ask for how the complaint has been dealt with in her DSAR.

Plus, a DSAR is expensive and time consuming to deal with, meaning her complaint is likely to get far more attention and therefore be dealt with better.

Why oh why do people post about things they clearly don’t have the first clue about. Truly baffling.

It matters because the gym say a male didn't enter.

Who are they calling male matters because a male did enter. If they have footage of a person entering the changing room who they don't think is male on whatever grounds - then they do have CCTV.
