To take my son's sweets back to the shop?

I was in the park today with my kids, boy aged 10 and girl aged 5, my friend and her kids, boy aged 11 and girl aged 4.

The boys started to get a bit bored so I gave them my card and said they could go over to the shop and get a pack of 6 ice lollies for us all. Son started to say he doesn't like ice lollies as they are "melty and annoying" this isn't true, he eats ice lollies all the time but whatever, I relented and said he could get a SMALL sweet instead. I clearly specified one sweet, about the size of the ice lolly. Other kids just wanted ice lolly. Fine.

Son then comes back from the shop. Says he does want ice lolly now and proceeded to pull other stuff he got from his bag. One massive bag of crisps, like a sharing size bag, and two big bags of sweets totalling £6 plus the £1.50 box of ice lollies he now says he wants one of.

I said no, he's taking the mick and he knows better than to abuse the trust I give him when I give him my card.
I told him he could have an ice lolly only now and I took all the other stuff back to the shop. I didn't shout or get angry or anything but I was firm and told him no, he's not keeping it.

DH thinks I should have just told him off but let him keep the sweets and crisps.

It is YOUR fault you gave him the card. It is not the shop keepers fault.

You should bear the consequences and not the shop keeper.

Throw the sweets away or give them away. But don’t involve the shop keeper.

Is it even legal for you to give him your card?

How strange that you think I'm blaming the shopkeeper.

I told him he was wrong and why in front of his friend and I confiscated his stuff. I thought this was sufficient and didn't feel he needed to be humiliated as well.

think you dealt with it all brilliantly tbh.

Other posters just seem to get on this app to moan at you about something you didn’t actually ask about. Now it’s ‘fraud’ if you give your kid your card to pay in the shop... It’s fraud if my mum gives me her card to get a few bits at the shop… Ok guys you’d better call the police on me…!

I’m actually surprised the co-op let you return it.

Didn't even question it and it didn't occur to me that they would
The items were unopened, undamaged and still very sellable. Why wouldn't they take them back?

YANBU at all, I'm surprised anyone would think so. In fact I think you handled it very well. I don't see why returning it is a big deal either, shop just puts it back into stock and refunds it.

BeyondMyWits · 29/07/2023 17:11

But the shopkeeper will have had to bear the consequences of your actions.

We would never put edible goods back on a shelf if they had left the shop. We have no idea of how those goods have been treated... none.

Every card transaction costs us money too. So you cost someone money, to teach your child a lesson, caused by your own inability to follow the terms and conditions of every bank or credit card.

I might not necessarily have taken the sweets back, but I definitely would have confiscated them and not allowed him to have them (they'd be hidden and then go into general "household treat" circulation after an appropriate amount of time had lapsed).

Actions/decisions have consequences.

I agree with this. He definitely wouldn't be keeping them.

Because they sold them in good faith?

I would have taken them off him but I wouldn’t have taken them back. Not fair on the shop to inconvenience them for your poor decisions

People change their mind all the time and you know people are allowed to bring things back once they have purchased them.
I run a business too. People mess you about all the time, getting you to drive miles to quote them and then never getting back to you, saying they are going to order snd then ghosting you etc etc. It's just business.

And anyway, it wasn't a small independent corner shop. It was a co-op. They are on shift until whenever anyway and there wasn't a queue.

Bloody ridiculous giving him your card! Doesn't it tell you not to share your pin with anybody, which I presume he'd have to if the contactless didn't work (which often happens).
I wouldn't have taken the items back but I also wouldn't be trusting him with my card any time soon ever and he'd have an ice lolly or nothing.

When does contactless not work? Iv been using it for years and never had it not work.

Tapasgoofy · 29/07/2023 17:31

I don’t see a problem with him having your bank card. My daughter has our joint account card on her apple wallet.

I would of taken away the sweets but I wouldn’t of embarrassed myself by returning it to the store for a few quid.

No one buys a pack of crisp and then returns it as they decide they don’t want them anymore. That’s odd.

What statutory rights? You don't have a right of return because you've changed your mind.

If you use it for multiple large transactions in a short time period, if you use it in multiple locations a long distance apart in a short time period and basically whenever your card issuer’s algorithm thinks the transaction might be dodgy and therefore triggers a request for the PIN.

Actually, legally shops are not required to make it so people are ‘allowed to bring things back’ (unless they are defective). Some shops may allow it out of goodwill but that’s all.

I’m pretty sure that for hygiene reasons, food taken out of the shop and returned would have gone straight in the bin. I certainly hope so!

What statutory rights are you talking about?

Nobody is entitled to a refund just because they've changed their minds. Many retailers offer it because they know they can just re-sell the items, or because it's easier than arguing, but it's not a legal entitlement.

GonnaGetGoingReturns · 29/07/2023 17:49

I thought most co ops the smaller ones anyway were franchises. Yes, they could not refund you and they may do, but your son has bought the goods with your card.

A bit stupid to allow him and anyone else to use your card. He’s too young to properly know the value of money and is easily influenced so that’s why he did what he did.

This is when the OP is digging herself a hole and making herself look even more silly.

This isn’t the shop keepers fault, they didn’t force her child to buy the sweets!

Plenty of times!!!
I've often been told I'd have to insert my card because it hasn't recognised the contactless part!
How interesting that hasn't ever happened to you!

They are so there is every chance this was effectively a small corner shop which had to take a loss on the items as they couldn’t be resold once they’d left the shop.

CarmelfromNorthernRoundup · 29/07/2023 17:55

I would have made him put it in the food bank box

Deloresadores · 29/07/2023 17:56

Did he know the prices? Were they clearly displayed? Seems a bit pathetic to be this angry. Just keep them and give them to him over a few weeks.

Yes, it happens frequently.
