Manager said no to holiday request

I'm probably going to get my arse handed to me on a plate here but fck it.
I asked for two days off on Monday just passed
I asked 10 days in advance.
Just been told today that it's been refused.
I asked why, was told 'I don't know'

I am very hot headed and I have such strong temptation to walk put right now. (I have another thread about my contract if anybody cares)
I've been spoken to like shit by this manager, talked down to on a daily basis, I've been micromanaged.
I dread coming to work, I cry most days. Management allowed another employee to verbally abuse me and no consequences were ever brought to the other person.

Would I be totally unreasonable to walk out? The thought of never having to work in this place again gives me great relief. Or am I just being stupid and should suck it up

congrats! I agree, get signed off and don’t give them any notice. People like that shouldn’t be able to get away with it though, I wish you’d have complained.

Medical leave is not included as holiday leave. This can't be argued with by the management. Notice is good but we don't always know we are going to get sick. An actual medical appointment they can't argue with especially these days with waiting lists. You don't need to give info re the particulars that's not their business. You sound like you need to be looking for other work, maybe you are. Walking out without notice well could have various impacts including references.

There is no legal obligation for an employer to grant time off for a medical appointment unless it’s for a protected characteristic such as disability or pregnancy. They can ask that the employee rebook the appointment in their own time or if that isn’t possible, take annual leave, unpaid time off, or if paid, they could be asked to make up the time.

Yes, but it didn't sound like they were allowing the OP any of those options. At the very least you should be able to take annual leave and if you don't have any left, unpaid leave. It seems like there's a gap in the law here, you should be able to take time off for hospital appointments, as long as you present evidence. No obligation on employer to pay but definitely leave without question.

Congratulations on the new job OP. As you have so much holiday to take you shouldn't have to give your current employer much notice. All the best!

Well if they won't give you annual leave, what do you do, other than just phone in sick?

OK the kid's birthday could be celebrated on a day off. You might be able to miss a parents evening if you see the teacher frequently anyway.

But you can't keep missing things.

for the poster who needs to give a years notice for holiday 🙄 where I am we can put in for AL the day before.
Ive authorised parental leave for parents evenings as well, parental leave is unpaid and some of my team want to keep paid holidays in tact and take an unpaid afternoon off for kids.

Whilst I agree the manager sounds like they are being unreasonable it is incorrect to say they have to allow annual leave. They have to allow the legal minimum (usually 28 days in the UK for full time employees) but even that can be dictated as to when you can take it. In terms of when you can take your leave we were always taught “leave is a privilege not a right”. That said, your manager sounds a bit of a cock if they are unprepared to give a good reason for the refusal so I would look for a different job and when you get one tell your manager to shove the job.

If you leave you will be paid any accrued and untaken holiday up until your end date. It’s very common not to allow employees to carry over holiday they’ve not taken unless they have been on long term sick or maternity leave!

The ya bldefinitely need to speak to cab and get yer holiday pay, you are entitled to this at the end of your contract and I would sue their asses to get it, had a company try this with me, it's safe to say I got it all

Sorry trying to answer all the questions.
There is a manager above my own 2 but I fear this would make matters worse for me, I'm scared to rock the boat hence I haven't asked further about my contract (see my other thread)
But yes about 3 weeks ago I was called in to a meeting and pretty much told they don't believe my reasons for having days off when I was genuinely unwell and the amount of days I've had off has triggered this investigation and if they find out I wasn't off for legit reasons, I will face a disciplinary based on misconduct.

So since then I've kept my head down, worked hard, gone above and beyond. Staying late when I can. They say jump I say how high.

But this manager (started about 2 months after me) I get the feeling he hates me, I walk om egg shell around him. One time he caught me sitting down and says I'm not entitled to a break because I'm still on a pt contract, so now I try not to take a break (doing 8 hr 45min shift). My mental health is wrecked from staying but I stayed because of the money and I had high hopes for a ft contract.
But I hate it, some times to not be caught sitting down, I sit in the toilets with a sandwich. I've never dreaded going to work before but I do every single day. Doesn't help that I was verbally abused by the other employee and they did naff all about it so now my relationship with the other employee is wrecked.

You really need to get some professional advice, EVERYONE is entitled to a lunch break of they work more than 6 hours a day, and I mean legally EVERYONE IS ENTITLED and he is breaking the law. If I was you I would collate everything you have resign and then take them to a tribunal for constructive dismissal. If there is a HR department you need to go to them or go above this guys head and tell his boss he is breaking the law

She can’t sue anyone as she hasn’t got two years service. And there is absolutely no obligation for an employer to pay an employee for untaken holidays unless they were prevented from doing so due to operational issues - in any event the employer would have to have allowed 28 days as a statutory minimum, and there is also no obligation to allow an employee to carry over any unused holiday to the following year. Where the employer is obliged to pay for untaken holiday entitlement, is where the employee leaves before this is possible. In that event the pay is limited to 28 days statutory and if the employee has to work a notice period the employer can insist that the employee take unused holidays as part of that.

She doesn’t have two years service, she has no protected rights, she can’t initiate a case for constructive dismissal or anything else.
