Landlord chasing rent - AIBU?

missverstaendnis · 02/10/2022 13:09

I am feeling rather upset after receiving an email last night from my landlord informing me that my rent was overdue for payment (due on the 1st) and to make arrangements ASAP for payment.

For background. For the last 5 years of living in this house my rent has been on a monthly standing order for the 1st of the month. This has ALWAYS been paid, have never been late to pay rent EVER.
Fast forward to this month as the 1st falls on a Saturday, DDs/ Standing Orders get paid out following working day (tomorrow, the 3rd).
I have never wasted a thought on this nor has it ever been raised as an issue.

Called the landlord to inform of this to which I was told her needs to pay his own outgoing on the 1st and that rent needs to be paid on a 1st of each month. I wasn't believed that payment will automatically go out Monday morning.

So I have cancelled my standing order and made a transfer last night to him.
Now it looks like it was too late to actually cancel the standing order from leaving my account tonight, so I will be catapulted into my overdraft.

Who is being unreasonable here -
landlord for requesting payment on a weekend and chasing me on it on a Saturday night with a harsh email,
or me for not monitoring that the 1st fell on a non-banking day and not cancelling the standing order sooner to arrange for the transfer on the morning of the 1st?

You’re unreasonable bottom line to be late with your rent, but obviously as you’ve been there 5 years and this must have happened before without comment, it’s wrong for your landlord to approach it rudely. But was the email “harsh” or just business like?

errnerrcallnernnernnern · 02/10/2022 13:19

YABU I’m afraid. If the 1st falls on a weekend, then you need to ensure the money gets to him on the Friday.

Itloggedmeoutagain · 02/10/2022 13:20

Surely it's happened before.
Fairly sure all my payments that are direct debit go out on the date regardless of what day it is.
I'm a landlord and I'm sure all my payments have all been received on the right day.
When I was in a salaried job I think I was paid early if it fell on a Saturday

EndersGame · 02/10/2022 13:21

It must have happened in the past and it's not the landlord's fault that they also have bills to pay. You should have ensured it was paid

AnyFucker · 02/10/2022 13:21

In 5 years the 1st of the month has never fallen a weekend before ? 😵‍💫

What date does your rent / mortgage payment go out if its due date lands on a weekend?

Yucca78 · 02/10/2022 13:23

Your LL is an arse

HappyBinosaur · 02/10/2022 13:24

In my opinion YANBU.

I’m a landlord (not as a job but because circumstances have meant that I no longer live in my house so someone else does) and my tenant pays me on the same date each month.
However, if that day falls on a weekend it sometimes goes in on the next working day which I acknowledge is what can happen with standing orders. If it was late because she just didn’t pay it then that would be different.
I’ve deliberately chosen a date for her to pay that is before I need the rent money to pay the mortgage so if it’s only a day or 2 late it doesn’t matter.

missverstaendnis · 02/10/2022 13:24

Why would I have to pay rent early?
Thanks for clarifying, I will now cancel the standing order completely although I was asked to have this in place by the landlord.
What happens with the double payment? Do I request to have it transferred back to me? Or do I just have to suck it up as it is (as I have learnt know) my mistake in the first place?

(not in UK) for my Standing orders i can tell the bank, each time i set it up, if it falls on a non-banking day, if i want it to go out in advance or on the next banking day. Can't you do that?

actually, that's a good point. I might arrange to change the standing order to be a couple of days earlier so even if the 29th was a weekend it would still reach him by the 1st. I quite like having all my monthly outgoings set up, would be an endless task to manually transfer every single bill each month!

FurAndFeathers · 02/10/2022 13:28

Either get them to transfer it back or to keep it for next month. They don’t just get it as extra!

My bank takes the mortgage payment a day early in that case.

Unusual. Most DDs would go the next working day (and always have for me).

genuinelyaskingforafriend · 02/10/2022 13:29

You are definitely not being unreasonable.

You set up a direct debit for the 1st snd the bank pays it when it's open. That's what happens with my mortgage and other outgoings!

HappyBinosaur · 02/10/2022 13:31

@errnerrcallnernnernnern @NoWordForFluffy
My mortgage lender (TSB) definitely takes it the day after a weekend or bank holiday.

In fact it has happened this weekend. Usually comes out on 1st but hasn’t come out yet and will come out tomorrow.

My wage, however, would go in early.

Pinetreesfall · 02/10/2022 13:32

Just make a manual transfer for rent. I do this so I always pay it on the correct day that it's due.

Although I accept that my tenants (who do pay by standing order) will pay their rent on the next working day if their payment date falls on a weekend.

mrs55 · 02/10/2022 13:32

He is being ridiculous all dd and bills don’t come out on a weekend anymore if he needed it bang on the 1st he should of had it set up for earlier, I wouldn’t of even transferred it to him and let the normal payment go out tomorrow! It might bounce back if you don’t have an overdraft in place. Seems the ll is making his poor decisions on you everyone knows that about the weekend payments he’s being an arse!

You either pay rent early or on the day. You don't just go, oh never mind it will get there 2 days late.

Yes ask for it back

Pepperama · 02/10/2022 13:35

About the double payment: explain what happened and ask them if they’d prefer to reimburse or keep for next month (if you’re ok without it - if it creates probs just ask for it to be reimbursed)

LateAF · 02/10/2022 13:35

The LL should set the payment due date up so that any bills he needs the money for aren’t late if that date falls on a weekend. Yanbu- this is standard practice for standing orders for the payment to be made on the next working day if it falls on a weekend, and it’s something your LL should have mitigated for.

I personally wouldn’t have cancelled the standing order.

Harridan1981 · 02/10/2022 13:36

His DDs won't go on a Saturday either. They will go on the Monday. He sounds pretty intolerant.

girlmom21 · 02/10/2022 13:36

If it's due on the 1st set up your standing order for the 29th or 30th to avoid this issue.

missverstaendnis · 02/10/2022 13:36

properdoughnut · 02/10/2022 13:32

I genuinely have never wasted a thought on this before as it has never been raised. It makes no difference to me personally/ financially to have it go out next working day or day before the weekend and I stupidly didn't think it would for the other party either if it never has been mentioned.
So no, I didn't go 'oh never mind'.
