Neighbour won’t give me my parcel

I ordered some things from a friend who accidentally sent my parcel to the wrong address (she put 1 in front of my actual number).
I know the neighbour has it as it’s been signed for on Hermes, I’ve knocked and knocked and I know they’re in but they won’t answer the door to me so I can’t get my parcel.
I can’t ask the seller as they have personal things going on and a very poorly DC so it’s not fair to put this on them. Anyone know where I stand please other than mailing them an envelope full of glitter? It was a lot of money and I’m very pissed off!

Put a not through the door asking for your parcel. Tell them you have been in touch with HERMES who have confirmed where the parcel was delivered.

And state the following...

The Postal Services Act 2000 clearly states that it is certainly illegal to open someone's post, or delay it reaching the owner.

The Act says:"A person commits an offence if, intending to act to a person's detriment and without reasonable excuse, he opens a postal packet which he knows or reasonably suspects has been incorrectly delivered to him."

Put a note thru asking them to contact you regarding the parcel that was delivered there. Tell her that the matter has been reported to the police and the courier has evidence that it was delivered there. Tell her you need to know if she intends to return otherwise the police have advised if you have another failed attempt then they'll pursue for theft.

If it had your name at the top then it belongs to you and doesn’t belong to them, they shouldn’t open it and its theft if they keep it. Ask politely and if they refuse report it, they’re not good neighbours to ignore you knocking.

I had the same with a Kindle Fire delivered to neighbours as none of us were in at the time. Thankfully I only had to go twice, but they were definitely in the first time I went, I think I must have tried during their dinner and they just ignored the door.
I hate going to other houses and glad I WFH now

Nobody is signing for packages atm. They will have taken a picture of it at the door - doesn't mean your neighbour received it - it will be hard to prove. It's down to the seller to sort they sent it to the wrong address

Sorry. Hadnt read all posts. Glad you got your parcel. Strange behaviour of neighbours but rhey are not as nutty as mine. I can understand them checking your ID as when the aigned for parcwl tbey became responsible for it. I always insist delivwries come to me and arw not left with neighbours. I prefer to collect if need be. Much less hassle. X

Wasn’t expecting this many replies. I got the parcel after being asked to show my drivers licence and a form of address even though they came to my house to drop said parcel off. Was very bizarre but I did get it.

Sorry to dissapoint that I didn’t do a Phil Collins outside their house. 😂

I would have been so tempted to ask to see their TV licence in return.

'I noticed during the times you refused to acknowledge me at the door that you watch it a lot. Perhaps that's why you didn't answer - did you think I was the TV licence person? Hmm. I will be keeping an eye on you. Please also provide your address in return.'

I would ask Hermes for a photo copy of the signature, put this and a note through their door offering to collect or include your address if they want to drop off instead. If you can prove to them you know they signed for this it might help. I know I have had issues where teenagers have signed for things - most adults think twice about signing for something if they don’t know the name on the parcel so assume a mistake has been made.

I ordered an expensive thing from Ebay, and the seller put the wring house number on it.

Legally that is HER mistake, and you are due a refund or a replacement.

I did manage to get my parcel, but it took a lot of hassle to get it back.

You are within your rights to get a refund.

Was it via Paypal?

Something similar happened to me, but in reverse. I sent something to the wrong address and the real recipient said she realised what had happened and went to the house and they refused to give her the parcel. I sent it RM.

They maintained that because it was addressed to them, even though the name is different, they said they were entitled to keep it.

I let it go, but am still not sure if it is legal as I did not want a battle.

If it was found that the courier had delivered to the addresses regularly and knew that the name did not fit the address, would Hermes then be liable? I suppose it would have to be proved he/she knew. If the courier did know the people concerned because of regular deliveries, could they be forced to demand the parcel back or pay on the insurance?

In law, is it only the name that is relevant and not the house number? If so it is surely a matter for the police as it is a criminal offence to open someone else's mail as far as RM is concerned. Does that apply to a courier service?

Perhaps someone on here with legal experience could say?

I’m having a similar dispute at present. My house name is Lakeside, my address is 1 Nowhere Street, Anytown. M&S sent me a parcel addressed like this:

Lakeside, 1
(two lines of unnecessary blank space)

Anytown
Nowhere Street
Postcode

So Hermes assumed the delivery address was Lakeside 1. There’s no street called Lakeside but there is a Cakeside. So they delivered the parcel to number 1 Cakeside. They said it wasn’t their fault because it was addressed to Lakeside 1 and they delivered it to Cakeside 1.

The dispute is still ongoing. M&S say they printed the correct address just the layout was wrong. It was clearly an L not an C, and the postcode was clearly for my house not for Cakeside which has a different postcode. Hermes say it’s M&S’s fault for not printing the address in a sensible order. The people at number 1 Cakeside don’t care because they got a free beauty advent calendar and they have no intention of giving it back.

How long have you been trying to sort this ?

Hi if you bought it on credit card their legal team will help you. As it’s theft ! The delivery would job taken signature a s that’s proof also ?
