Just watched Biden's speech in Delaware, talking about Trump's hearing about the ACA at the supreme court after the election. (I think that's right? I may have got mixed up). Can he really still go ahead with this if he loses? I'm assuming then that the ACA will be ended. What happens then???
Yes he can, the POTUS' 'powers' don't end until Inauguration Day in January. The period between election and inauguration day is called the 'lame duck period'. Traditionally the outgoing Administration & Congress table a lot of things pending the new Administration & Congress members. But it has also been known as a period where the outgoing POTUS signs EOs for his own agenda and Congress rushes through their 'pet' legislation whilst they still have the numbers. McConnell is planning a few of those having to do with things opposed by or favored by the Democrats. IIRC the filibuster and court packing are in there somewhere. And you can expect to see Scrotus do blanket pardons for his 'loyal' cronies as well as his children & son in law. It's said he may even blanket pardon himself.
As far as what happens to ACA, the new Congress and POTUS are able to draft their own 'new' version of the ACA (called something else). They just have to be sure to avoid the thing(s) the SCOTUS ruled were unconstitutional and used to throw the current ACA out.
