Furlough holiday

I am furloughed still and work for a large international company. There are only a few off us still furloughed 2 in my office only.

I received an informing me that all holiday from last year that was carried over would have to be used in the October. I know the reason why it is cheaper for them to get part of the government to pay it.
My issue is that those that have not been furloughed are allowed to carry over their holiday for the next 2 years.
I really do not think this is fair as they are treating us differently.
I have contacted HR for clarification but they have not answered my emails.
Is this lawful.
AIBUto think that they are treating us unfairly.

I think this is one of those situations where you need to have a hard look at yourself and think is it right to be moaning about not carrying my holidays over. You’ve had 6 months off work, just move on.

I think it would be fair if they asked you to take 10/12 of your holidays by the end of October and no one else was allowed to carry over holidays.

But your right in the current set up it's unfair. Refer to your contract of employment. What does it say about you being required to take holidays and holiday carry over? That still applies even when your on furlough.

I guess your colleagues and other posters ( it seems) also think it's unfair that you've been sitting at home at 80% pay while they have been working but that's not your fault.

I think I'd be more concerned that I had a job come 31/10.

You have asked the question on mn and are still disputing the overwhelming majority answer.

Save your energy on this fight as furlough is soon over. Many redundancies are predicted, therefore the carryover of holidays for 2 years may well be a futile argument.

Like @CandyLeBonBon I am self employed - in the travel business.
I have not earned a penny since February, I have worked under very nasty circumstances sorting out client's cancelled holidays and refunding them, and I have received ZERO pay.
And, on top of all that, because my clients got all their money back, then, when I DO start earning again (whenever that may be!), I will have to pay back any commissions that I had already been paid on bookings that were cancelled - so far about £3k.
Oh, and I will not be taking holidays because if I don't work then I can't earn. (not that anyone is booking anything at the moment anyway!).

How do you like that scenario?

Does it put into perspective just how self centred and petty you are being?

You have been paid £2500 per month for doing nothing. No, it may not have been "easy" for you but, Good Lord, your's was one of the best scenarios in a shit situation, and I think you need to grow up and shut up because if you express this whinge out loud, in real life, then you are likely to get torn off a strip when so many people have had it so bad.

Totally op, you have been well ripped off. I suggest you go into your office and start screaming at HR to give you your entitled holidays. They absolutely cannot take those away from you. Shock

The thing you're not understanding OP is people are allowed to carry leave over because they haven't been able to take it yet because of business needs i.e. too much work during lockdown/rest of year.

You have been perfectly able to take as much annual leave as you like because you've been furloughed and you would have been paid 100% for those days. The 'its not a holiday because they could call me back in 24hrs' doesn't wash because if you book annual leave, just like if you were in work, then you're on annual leave and you can go away or do whatever it is you wanted during that time and work can't just call you back from it.

The only reason you've not taken any holiday during the last 6 months is because you've not had to because you've been off anyway so what you were really hoping to do is have 6 months off and save all the holiday you've accumulated during that time as well to use when you get back. Can you honestly not see how unreasonable that is? This is coming from someone who was also furloughed and had to use AL during that period.

I would count yourself lucky to be getting £2500 a month, if you were in Australia it wouldn't be 80% (even capped), everyone furloughed was on the same $1500 (£850) a fortnight.

All staff at my company have taken a 20% pay cut ( now 4 D pw )whether on furlough or not. Those earning more than the furlough have been topped up to 80%. I've had 5 days off since March and have to fit in 25 before the end of the year otherwise I lose them. Those on furlough get their holiday pay at 100%. Those of us working only have to take 4 days off to cover a week which is fine so long as we can take it. We can carry some but not all of it

I am likely to lose half of my entitlement as I just can't fit it in but those on furlough get paid more than me. I understand it but it doesn't feel fair. But it's exceptional times. If I heard someone on furlough whinging about having to take their hols, whilst I can't, I wouldn't be too impressed. I have a job and I want the company to survive.

You are luckier than a lot of people so stop complaining.

If I were you I'd keep quiet and try be a model employee and ask about when you may be able to return to work because you miss out so much, rather than complaining and demanding more holiday. If you're still on furlough there is a risk you'll be out soon so you don't want noise about you trying to create legal problems for your current employer if you're soon going to need to interview with the competition.

So glad I don't employ you OP. I'm a business owner and to ensure staff get paid in full I wasn't paid at all for 3 months and yes I have mortgage etc to pay too. I've had 5 days off since Xmas. And no prospect of any AL until the pandemic eases. Count yourself lucky you've been paid anything.

YABU I'm back at work now (social care, furloughed only because I'm extremely vulnerable) my company has just announced an extra day's annual leave for all those who have worked through the lockdown. I don't qualify. Am I at all put out by this? Of course I'm not! I had nearly four months at home!

What is unfair is that we are not allowed to carry our holiday over even though we've worked throughout and some of my colleagues found it really difficult to take time off. Our leave year ends this month.
The only difference we had was those on furlough weren't allowed to change the booked days off, we were ask not to if possible. I had no choice but to cancel my Easter week as I was too busy, took it in August

I haven’t read all of the thread but I fully understand where you’re coming from,OP.

In my case though, I was furloughed, was paid 80%, was paid 80% for BH too, I asked if I could take AI in Aug whilst still furloughed, was told no! Employer has said he’ll look into the holidays Hmm I think he wants me to just give them up.

In normal circumstances I possibly would but (without going in to huge detail) he’s a person who treats people like shit and I might have to dig my heals in! Contract issue possibly coming up too (which is another story).

The staff which have been in work, have been paid 100% etc told me how lovely they found it, no traffic on the road, the environment we work in so much easier, they didn’t work fully, not like when we’re absolutely in the middle of our busy season! Tbh, I would have preferred to be in work than furloughed on 80% (which was absolutely fantastic and something I would never have imagined) than to try and get through homeschooling DS, which was harder work! and the thought in the back of my mind wondering if I’d still got a job!

In our case all the male staff were brought back early!

So, I still have my annual leave! Do I just let it go or ask my employer to cash it in, making up for the fact I haven’t had a pay rise for over 3 years!

Wish I’d taken my AL whilst on furlough now. Still furloughed and company has announced redundancies will happen and that some jobs have been identified as definitely going and they’d like some to voluntarily go.

I’m in a department that will have high redundancies as the company can function without my dept. Even those not furloughed are likely to be at risk.

I knew the minute I got the info that I was being furloughed that it was a teeny step from them to redundant and that if there was hot list, my dept was at the very top.

I’ve been applying for jobs since June, when others went back but I wasn’t asked. Unfortunately my industry is one that has been hit hard and won’t recover for a long long time, if ever. So as you can imagine, jobs are scarce.......

I’m sure everything will be alright though if only I can roll over all my holiday to next year or perhaps my next employer?
