Any foxes, moles and mink that you catch are protected under the Animal Welfare Act 2006. You can be jailed and fined up to £20,000 for causing unnecessary suffering to an animal.

must:

only use free-running snares, which relax when the animal is captured
Check snares at least once a day
Humanely kill any fox you catch while it’s in the trap or snare
Release all other animals unharmed – except grey squirrels and mink, which you must humanely kill

Well the rspca is taking an interest, so I assume what he did isn't automatically legal. I suspect prosecution would depend on whether he caused unnecessary suffering.

You can release them I believe but not relocate and release them.

As for left wingers enjoying killing foxes, this thread is nothing to do with politics and everything to do with the suffering of the fox he clubbed to death. People of all political backgrounds kill animals, it's not relevant to this thread.

I don't like the man but I don't see that he's done anything illegal as far as we know. He may have done but that's as much as anyone can say right now. According to his Twitter he called the RSPCA and they are aware of this incident.

Mind you I remember once when I called the RSPCA about a fox stuck in a vertically-sided moat and they refused to come out and help. It either drowned or froze overnight, I don't know which. Either way it definitely suffered, poor thing.

He will just say he killed it with one blow and it didn’t suffer. Nothing will happen to him.

But I totally agree that I can’t understand the mindset of people who would rather kill than help a wild animal. I’m sure he’ll back track and say it looked injured and he was doing it a favour, etc.

I doubt prosecution will succeed. It's not pretty but it's not illegal to club a fox to death.
Not saying I would do the same but I'm not in his shoes.

@halocompanach where have the RSPCA said they will be involving the police? I can see that they've asked for anyone with information to call them but nothing about the police.

I'd sooner the police and everyone else for that matter spent more time and energy on people getting clubbed to death than the poor wee little foxes.
