Have other threads on here re leaving an abusive man with my 7 week old daughter after he tried to kill me

He has gone to family court and filed for me to attend a sitting in London in a few weeks

My daughter and I live away from there as we had to flee the abuse

Police investigation is on going can some one please help me with this

My solicitor was under the impression if he wanted to do anything he would have to apply to the family court in N Ireland
I do not want this evil man having unsupervised acesss as he has hurt me many times in front of her and put us both in hospital

What may happen next guys
Please please help
Please

Thanks all

And re FFj reading this thread
I have tried to change some details

Plus I need this thread as I have no idea about the next best steps and my solicitor is waiting to get confirmation from a solicitor in England
So I am reluctant to get this deleted just yet

Donkeyshot yes met already involved
What I mean is that they have to respond to court papers re my the allegations of abduction

Ps I don't owe rent as I left the flat after he tried to kill me
In fact I then transferred a couple of thousand after this as he said he would report me!!
Utter fool I am

As far as I can see, there are no other threads relating to abuse/Northern Ireland currently running which makes this one easily identifiable to those who may search for it.

I've suggested that you ask mumsnet to move it - everyone that's on here will find it. Please do so for your own safety and that of your dd.

Are you saying that he's alleging in court papers filed in the civil courts that you abducted his/your child? Why do you believe that the Met have to respond?

GettingABitDesperateNow · 06/11/2019 10:34

Maybe you need another solicitor? I'm not sure why your solicitor isn't answering these basic questions

looondonn · 06/11/2019 10:51

Yes fair point

Can someone tell me how to delete thread

Thanks so much for all the great support xx

You need to report your own thread.
I’ve also reported it for you x

looondonn · 06/11/2019 12:46

Thanks a lot

You don't need to delete this thread now - we don't want all the info posted here gone just yet!

Click on Report which is sandwiched between Add message and Message poster (top right of your OP and every response) and ask mumsnet to move this thread - I sent you the name of the board it should be moved to.

looondonn · 06/11/2019 13:11

Again thanks so much

Can't see the function
Have not heard back from solicitor
Anyone know the time frame to apply for dismissal ?

OP posts:
MrsBertBibby · 06/11/2019 20:28

You need to return the acknowledgement form, setting out your position, and if your ex doesn't accept the situation, the court is likely to re-list for proper argument and determination of the jurisdictional point.

looondonn · 06/11/2019 20:35

Ok just looked through paperwork
Will fill in with solicitor

So it appears I need to attend

Spoke to an solicitor in England today

How is this fair
We don't even live there
We fled for our lives 20 months ago 😢😢😢

OP posts:
MrsBertBibby · 08/11/2019 17:45

I would not advise in those terms.

The Court cannot expect you to travel for such a hearing. You need to request a hearing by video link, OR, if you are going to instruct a solicitor in Dngland to represent, ask for permission for your attendance to be excused provided you are available to give instructions by phone.

Or ask to attend by telephone. I've done 2 hearings in the last month where one party attended by telephone.

These are all extremely common accommodations in English courts where parties are overseas, or far distant.

The English solicitor is talking bull.

I am an English family solicitor, btw.

DonKeyshot · 08/11/2019 18:11

You DO NOT need to attend.

What does your N.Ireland solicitor say? If she is not up to the job you need to seek a second opinion from one who is because your dd's safety is at stake here.

PLEASE move this thread. The longer it stays here the more likely it is it will be found by those who do have your best interests at heart.

You can't not see the function - look at the top of any of your posts or of any responses and you will see Add message Report and Message poster. Click on Report and ask mumsnet to move it.

looondonn · 08/11/2019 18:35

Thank you
Thank you
I have not deleted it yet
As I do t know what to do
Waiting for my solicitor to give me more advice
So now I'm stuck apart from the great advice here

So I can possibly attend via video link? Or ask a solicitor to be there?
I thought it would be dismissed ???!!!
Help please xxxxxx

Should be moved to 30 days on here?

Shall I specify all this in the paperwork I need to send back?

OP posts:
DonKeyshot · 08/11/2019 18:50

I sent you a dm telling you where to move this thread. If you move it to 30 days it will be gone in 30 days and that won't be any good to you.

MrsBertBibby have given you sound advice. My advice is that you should be doing nothing as your solicitor should have this in hand. What has she advised and why do you think the Met will be involved in matters that have been filed in the civil courts?

looondonn · 08/11/2019 18:54

Sorry do excuse my stupidity in many ways

So - he has claimed I abducted my child
So the met have been instructed to inform the courts as to her whereabouts

Thanks

OP posts:
MrsBertBibby · 08/11/2019 19:01

Does he know where you are? Does he know you are in NI?

looondonn · 08/11/2019 19:08

Yes
He does

OP posts:
MrsBertBibby · 08/11/2019 19:09

So why do the police need to locate you? The court knows your whereabouts, surely? How were the papers sent to you?

looondonn · 08/11/2019 19:11

By him via signed for Royal Mail
This is all total nonsense

So am I ok to do nothing until I hear back with correct legal advice

When is the English case due in Court?
