CF county council has destroyed my wall!

I've name changed for this as it will probably end up quite outing...

The council are improving a 'road' next to my house, this road is not passable with a normal vehicle, only a 4wd. The posh golf course behind us wants to cut down lots of trees so need access for large vehicles, therefore the council have had workers there this week improving the lane.

I spoke to them about 4 days ago just to find out what they were doing (just being nosy!) and was told that they were improving the opposite end of the lane, but not my end due to funding.

I've come back from work today to find that they've decided to drain a large, muddy puddle (probably 40m long by 7m wide) by making a large hole in our dry stone wall and digging a trench onto our land, surely they can't just do this?????

Am planning on ringing them tomorrow and asking for the wall to be rebuilt and everything put back to how it was, anyone had a similar experience at all? I'm quite flabbergasted by the cheek to be honest Grin

I suspect that the plans haven't been read correctly.

That was exactly what had happened in the case I mentioned above. The in-joke was that the contractor had the plans upside down.

This could ultimately be a case for the local government ombudsman, OP.

They make some sizable compensation awards these days.

Thanks for all the messages, I've had an answer phone message from the guy at the council with a reference number for Monday

The note on the wall is a good call, I'll do that if I can't catch the workers Monday morning

No the dogs can't get out, luckily!

I've emailed our county councillor, so will see if she responds

At least they bulldozed the worst part of the wall, if I'm lucky it'll look better after they've fixed it Grin

They most definitely can't discharge waare flood water onto your land. You must sue for damage caused, they haven't a leg to stand on!

I've agreed to go out with a relative to the zoo on Monday so won't be here all day,

I would cancel that, because I would fully expect the workers to ignore anything I said.

If it where me I'd cancel the day out and sort this out. They will more than likely try and save as much money putting this right. You have criminal damage theft trespassing and contamination. They need to put this right as possible. Don't let them off the hook if you had done this to a neighbour the police council would be on you like a ton of bricks so to speak.

(I reckon) they misread a map & don't know it's (OP's) private land.

I'm currently hoping it's all a big mistake, and I'll get lots of apologies and they will put it right ASAP. If that doesn't happen, that's when I'll go nuclear at them!

Wow I'd be raging!

Years ago my dad caught some council workers in an old back garden of ours about to remove our fencing to create some sort of public walk way.
They had to be told (loudly and repeatedly) that they were on private land.

Not council workers but 5 years ago I caught contractors on my land about to cut down a line of my trees to improve the view of the new flats built above the tree line. It took me raging at them for an hour for them to actually get someone out to measure where the land boundaries were and they'd already managed to take down one of my trees. I am 99% sure they hadn't bothered to find out if the trees were theirs or not first.. if I hadn't been on maternity leave they'd have had the whole row down by the time I got home from work!
