Council lorry blocking me won't move because he's on his break!

Just come out of my house to find a council lorry parked across my drive. They're doing some digging a few doors down. Driver sat in the cab, so i politely asked him to move back a bit to let me get my car out of the drive. Point blank refusal. Says he's on his break, he's legally entitled to his break and he won't move until he's finished his break. Then winds his window up. By the time I report it to police or council traffic enforcement he'll have moved it hopefully. So I'm stuck here, and I'm now going to be late for a GP appointment. There are some pretty inconsiderate arrogant sods out there aren't there?

I think this is the wrong way round, @PlainSpeakingStraightTalking.

It is illegal if you block someone's access to the public highway. So, for example, if you prevent them driving off their drive onto a public road.

He's not a distance lorry driver. His driving time is not an issue

Utter bollocks. Not only is his driving time restricted but the number of hours he can work (any work) in a day is restricted (assuming he drives for over 4 hours in the day) and the time he's allowed to work between breaks is restricted.

How in the world is this misogyny? The drive would be blocked whoever it belonged to. He didn't say "I'll park over that drive specifically to inconvenience a woman".

Tacho rules are much more complicated than just driving hours. If he is on a break and had to move in theory he has to start his rest time again.

However that isn’t the ops issue he should have ensured he was legally parked before clicking onto break (if indeed he is on a tacho)

Has he moved yet? I'm sure there must be an easily googleable number of m for the council to complain to a real live person about him to, whilst also tweeting it and anything else. Tell him loudly what you're doing and let him watch you doing it. He deserves all the trouble work give him over it, and how much trouble they give him is likely proportional to how much of a fuss you kick up to them about him. Go for it!

I would be taking photos of the van and now it is parked, the driver and the license plate and reporting it all to the council.

Get a taxi? Why should op have to fork out cash because some tosser has blocked her in? Would you have also suggested this if op was a midwife or carer and had multiple people to see today?

Even if he has a tacho, it's still not the op's concern if he is hard of thinking.

As soon as he said no my phone would have been out and recorded - So let me get this right. You have blocked my car on my drive and are refusing to move?
I wouldn't bother with pictures. The video would have been used to show him, the reg and how he's parked.

I'm sorry he's blocking you in but if he's on a tachograph he could get into serious trouble by driving when he's on a break.

He is sitting in the van whilst taking a break from digging a few doors down, so not an tacho issue.

Can you get a taxi?

I'm quite sure I would not be; why should OP have to pay for a taxi because of an arrogant worker?

Where does it say in the OP that the man in the cab is definitely one of the digging men and not someone who has just delivered the digging men a load of gravel or whatever?

He's an ignorant prick, there is absolutely zero excuse for his rudeness. Definitely take photos and a video immediately, I bet the coward will move as soon as he sees you but definitely still complain.
