Council lorry blocking me won't move because he's on his break!

Just come out of my house to find a council lorry parked across my drive. They're doing some digging a few doors down. Driver sat in the cab, so i politely asked him to move back a bit to let me get my car out of the drive. Point blank refusal. Says he's on his break, he's legally entitled to his break and he won't move until he's finished his break. Then winds his window up. By the time I report it to police or council traffic enforcement he'll have moved it hopefully. So I'm stuck here, and I'm now going to be late for a GP appointment. There are some pretty inconsiderate arrogant sods out there aren't there?

As others say it doesn't matter whether he's on a tachograph, he is entirely at fault for parking across the OP's drive.

For all the self important misogynistic driver knows she might well be an on call health professional, or due to start a shift in an essential service with an overworked skeleton staff, not "just" caused to be late for a GP appointment.

me i'd go raging up the road at anyone working they ask them to move truck , lean on horn, start screaming at him its an emergency I have to get to gp, make his break as lousy and miserable as I could. But then I like playing the hormonal bitch

Take photos of him parked over your drive whilst in the vehicle and report him to your council.

I had a neighbour's scaffolding company try this one on me- he had parked up the top of our street blocking about 5 houses from getting out, at school run time too.

Asked him to move very politely and got 'I'm on my break', so I smilingly told him he could either move so I could get my children or he could go and do it since I was blocked in.

A grumpy teenager would have been proud of the grunt he gave as he grudgingly moved.

i'm assuming if its a council vehicle he's not doing long journeys etc and is only parked there because they're digging and its convenient (for him!)

I would report to the council.

I'm sorry he's blocking you in but if he's on a tachograph he could get into serious trouble by driving when he's on a break. Can you get a taxi?

Irrelevant. If he drives for more than 4 hours a day in a commercial vehicle of (I think) 7.5 tonnes or more, he needs a tacograph.

For all we know, he could be driving all day around all the road building sites in the council area delivering supplies. The OP hasn't said whether the driver is part of the road building crew or is someone who has just delivered to them.

Of course he should not have parked across the OPs drive, but if he has a tacho, which he could have, he cannot move.

Actually it isn't. Preventing access to the property is illegal, but they didn't think that through, preventing exit from the property isn't illegal.

Its the other way round, it is illegal to "cause an obstruction to the public highway" which is what the driver is doing by blocking her in.

Yes definitely take his Reg Number and report his sorry arse. Not only is it ignorant, but supposing you were bloody paramedics that needed to access that space.

He hasn't been driving for over 3 hours, he is on a break from digging the hole. He needs to be reported so he doesn't block driveways in future.
