Council lorry blocking me won't move because he's on his break!

Just come out of my house to find a council lorry parked across my drive. They're doing some digging a few doors down. Driver sat in the cab, so i politely asked him to move back a bit to let me get my car out of the drive. Point blank refusal. Says he's on his break, he's legally entitled to his break and he won't move until he's finished his break. Then winds his window up. By the time I report it to police or council traffic enforcement he'll have moved it hopefully. So I'm stuck here, and I'm now going to be late for a GP appointment. There are some pretty inconsiderate arrogant sods out there aren't there?

What an utter twat. Surely that is illeagal? I would drive my car right up to his van and sit with my hand on the horn until he moved. Or better yet when it's time for them to go home, go and stand next to his van so he can't move it without knocking you down, he's not going to do that is he!

I'm sorry he's blocking you in but if he's on a tachograph he could get into serious trouble by driving when he's on a break

The taco graph would clearly record a minuscule amount of movement - consistent with reversing to allow OP out. In any event he shouldn’t have parked there in the first place.

Can you get a taxi?

Why should OP have to pay out to cover someone else’s appalling behaviour?

He's not a distance lorry driver who's driving time is being timed. He's a council workman doing repairs on the roads/pipes etc. Their work vehicles are parked up whilst they work and moved around as needed. When they take their tea break they sit sometimes sit in the cab, but there's no reason why he can't move it other than his attitude of "fuck off, I'm on a break"

He has been diggin - he won't have been driving for xx no of Hrs so the Tacho card "excuse" is rubbish and as Black Tea says shld park legally in the first place - he blocked her in so can't even say driveway was empty

This is a council lorry. He's unlikely to have been driving for hours! Probably started his shift at 9am or thereabouts, why would he be time limited on driving?

Maybe he couldn't find anywhere to park and was in danger of going over his hours, which can cause strict penalties.

And maybe OP had an emergency or job interview and his inconsiderate parking has cost her dearly. Why does his needs trump hers?

Chris It's not just long distance lorry drivers who are subject to these rules. DP drives a 7.5 tonne truck on a normal car licence around town doing collections and deliveries and he is on a tacho and subject to the same drivers hours rules.

Hold your hand on your car horn until he moves. Take a pic of him very obviously so he can see that you are collecting evidence.

The tacho is a red herring. He didn't apologise and say he was unable to move he said he was entitled to a break and wasn't going to move until he had finished it.

I'm astounded at the number of people who can't read.

He's not a distance lorry driver. His driving time is not an issue. OP said they are digging the road up. The trucks are parked up whilst they work and moved around when needed. You must drive past council workmen doing roadworks all the time!

He's not going over restricted driving hours. He's just sitting in the cab for his tea! And will then go back to digging. It's nothing to do with driving time and everything to do with his selfish attitude.

Are you and your council both on Twitter? If so, tweet a picture of the lorry which shows your drive and the registration plate. Twitter can get quite quick results.
In fact, take a photo quite obviously so that he knows you are doing it. Even if you don’t do anything with it. He will have to consider how he is going to justify his actions to his employer.

Council vans don't have restriction for driving on them they can drive when they need to, he is just being a twat. If he isn't allowed to drive then one of the other men who are out the van can move it.

Start taking photos - from the back first (registration plate) then across the road showing the position. Finally one of the twunt parked up as close to his ugly mug as you can get.....then peg it back home. He is selfish enough and unreasonable enough that it could escalate quickly.

This attitude from men towards woman is honestly tiring. I experience aggression from men on the road all the time. I have never experienced it from a woman. I know he is not technically driving but he is an arrogant arsehole.

I hope the OP is outside taking photos to report him to the council, as other posters have advised.

And I agree with @ChrisjenAvasarala - the tacho regulations are for long distance lorry drivers not council workmen, surely.
